A RESOLUTION ACCEPTING DEPARTMENT OF ruSTICE
GRANTS IN THE AMOUNTS OF $25,818 TO ADD AN OFFICER
ASSIGNED TO BIKE PATROL AND $32,662 TO ADD AN
OFFICER AS A SCHOOL RESOURCE OFFICER AND
APPROVING THE ATTACHED BUDGET ADruSTMENTS
COVERING THE CITY'S PORTION OF THE EXPENSE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the City Council hereby accepts a grant award in the amount of $25,818
from the Department of Justice allowing for a new bike patrol officer salary (90%); and approves
a budget adjustment increasing Personnel Services, Acct. No. l0l0 2940 Various, in the amount of
$28,687, by decreasing Federal Grants, Acct. No. 1010 0001 4309 00 in the amount of $25,818 and
Use of Fund Balance, Acct. No. 1010 0001 4999 99 in the amount of $2,869. A copy of the grant
award and budget adjustment is attached hereto marked Exhibit I'A" and made a part hereof.
Section 2. The City Council hereby accepts a grant award in the amount of $32,662
from the Department of Justice, Local Law Enforcement Block Grants Program allowing the
addition of an officer as a school resource officer; and approves a budget adjustment increasing
Personnel Services, Acct. No. l0l0 2940 Various, in the amount of $31,294; Motor Pool Charges,
Acct. No. 10102940 5331 00, in the amount of $1,971; Replacement Charges, Acct. No. l0l0 2940
5331 01, in the amount of 3,629; Vehicle Maintenance, Acct. No. l0l0 2940 5403 00, in the amount
of $960; and Fixed Assets, Acct. No. l0l0 2940 5801 00, in the amount of $2,500 by decreasing
Federal Grants, 1010 0001 4309 00, in the amount of $32,662 and Use of Fund Balance, Acct. No.
1010 0001 4999 99, in the amount of $7,692. A copy of the grant award and budget adjustment are
attached hereto marked Exhibit "B" and made aptrt hereof.

The recipient agreeB to comply with the organizational audit
requiremEnts of OMB Circular A-L28, "Audits of Statse and
Local Governnents". In conjunction with the beginning date
of the award, the audits reports period of the state or local
governnental entity to be audited under the single audit
iequireurent is .ranuary 1, 1995 to December 31, 1996. The
audit report must be substitsted no later than February 1,
1998 and for each audits cycLe thereafter covering the entsire
award period ae originally approved or amended. The
rnanagement letter must be submitted with the audit report.
Subs-quent audits musts be eubmitt,ed no Later than thirteen

SPECTAI, COIIDITIONS
The recipient agirees to sgbmit, itss corrective action plan
with the audit ieport to the DOiI Regional Inspector General
for Audit, when there are findings/recommendations disclosed
in the audit, report. The corrective action plan should
incLude: (1) speci.fic stePs taken to comply with t'he
reconmendations i Q) timetable for performance a'nd/or
implementaLion date for each recommendation; and (3)
description of monitoring to be conducted to ensure
implementaEion.
The recipient shall submit one copy of atl reports and
proposed publications resulting from this agreement twenty
tZOl daye prior to public release. Any publicationE
(writ,ten, visual, or sound), whether pr:blished at the
recipient's or goverrutent's expen6e, shall contain the

SPECIAL CONDTTIONS
The recipient agrees to eEtablish a trusts fund in which tshe
Bureau of ilustice Assistance will deposit all payments
received under thie award. For tshe purposea of this grant,
a tsrusts fund is an interest, bearing account Ehat is
specifically designated for this Progra:n. OnIy aIlo-rvable
progr€rm expenaes can be paid f rom this accounE. Thie fund
may nots be utilized to pay debts incurred by otsher
activities beyond t,he scope of the Local Law EnforcenenE
Block Grants Program.
The reeipienE also agreea Eo uee the grants amount in the
trusts fund (including interest) during the period not, to
exceed 24 months f rom the date of the f irst Federal palEtent,.
The recipient agreee to eqbmit quarterly financial reporte.
The financial r-port ie due 45 days after the end of each
calendar quarter. A final financial report is due L2O days
following the end of the grant period.
No fr.rnds shall be used to supplant gtaEe or Local funds that
would othenpise be made available for such Purposes.
The recipient acknowledges that failure to submit an
acceptable Equal Eurployurent Opportunity Plan (if recipient
is rEquired to submit one purEuant Eo 28 CFR 42.302), tshat'
is approved by the office for civil Rights, ig a violaEion

of the drawdown of funds.

gain in the number of law enforcements officers who perfor-t

SPECIAIJ CONDITIONS
4403 of the Defenge Conversion, Reinvegtment, and Transition
Aesistance Act of L992 (division D of Public Law 102 -484; 10
u.s.c. L923 note), a suitable preference in the employment

personnel using funds made available under this Progran.
The recipient agrees if funds are used for enhancing
security or crime prevention, that ttre unit of local
governnent
(a) has an adequat,e proceea to agsesE t'he impact of any
enhancement of a echool security meaeure that is undertaken
under subparagraph (B) of section 101(a) (2), or any crime
prevention progrErmg that are established under subparagraphs
(C) and (E) of section 101(a)(2), on Ehe incidence of crime
in the geographic area where the enhancement is undertaken
or the progran is eetablished;
(b) will conduct such an aageeenent with regpect to each
guch enhancement or progrErm; and
(c) will subtrtit to the Bureau of JueEice Assistance an
annual writEen asEeasment reports.
Ttre recipient agreeE that prior to t,he obligation of funde
aE least one (1) pr:bIic hearing will be held regarding t'he
proposed use of tshe palmrent under t}e Local Law Enforcement
Btock Grant in relation to its enEire budget. Ats t'he
hearing, personE shall be given an oPportunity to provide
written and oral views Eo the unit of locaL government about
the entire bud.get and the relation of the Grant to the
entire budget.
The recipient will hold the public hearing at a t,ime and
place that allows and encouragea public at,Eendance and
participation.
The recipient agrees that prior to the obligation of any
funds received under the Local taw Enforcement Block GrantE
Progrant, it shaIl eetablish or designate an advisory board.
While membership on the advisory board uray be broader, it
must include a representative fron --

The recipient agrees to comply with the financial and administrative requirements set forth in the current edition of the Office
of Justice Programs (OJP) Financial Guide.
The recipient agrees to comply with the organizational audit requirements of the applicable OMB audit circular. The first audit
report period should be for 0l/01/97 to l2l3l/97. The management letter outlining audit findings, submitted by the auditing
organization, must be submitted with the audit report. Grantee audit reports must be submitted no later than thirteen ( I 3)
months after the close of each fiscal year during the term of the award.
Recipients who receive $ 100,000 or more of federal funds during their fiscal year, are required to submit an organization-wide
financial and compliance audit report. Recipients who receive S25,000 to $100,000 of federal funds, are required to submit a
program or organization-wide audit report as directed by the granting agency. Recipients who receive less than $25,000 of
federal funds, are not required to submit a program or organization-wide financial and compliance audit report for that year.
Note: If your audit disclosed findings or recommendations you must include with your audit report, a corrective action plan
containing the following:
l) The name and phone number of the contact person responsible for the corrective action plan.
2) Specific steps taken to comply with the recommendations.

The recipient shall submit one copy of all reports and proposed publications resulting from this agreement twenty (20) days
prior to public release. Any publications (written, visual, or sound), whether published at the recipient's or government's
expense, shall contain the following statement: (NOTE: This excludes press releases, newsletters, and issue analyses.)

The recipient agrees to provide information required for the national evaluation.
The recipient agrees to provide $3,629 over the grant period in a cash match. The recipient is reminded that the match funds
are auditable under Special Condition #2 and will be binding to the recipient.
The recipient agrees to submit, at a minimum, semi-annual reports on its programmatic activities. The first programmatic
report will be due on January 30, 1998, covering the period of October - December, 1997 . The next report will be due on July
3 I , I 998 and cover the period of January - June, 1998. The next report should cover the next six month period and is due thirty
(30) days after the end of the six month period for the term of the award. A final report on the programmatic activities is due
120 days following the end of the grant period.
The recipient agrees to establish a trust fund in which all payments received under this Program must be deposited. For the
purposes of this grant, a trust fund is an interest bearing account that is specifically designated for this Program. Only
allowable program expenses can be paid from this account. This fund may not be used to pay debts incurred by other
activities beyond the scope of the Local Law Enforcement Block Grants Program. The recipient also agrees to obligate and
expend the grant funds in the trust fund (including match and interest earned) during the 24 month term of the award.
The recipient agrees to submit quarterly financial reports. The financial report is due 45 days after the end of each calendar
quarter. A final financial report is due 120 days following the end of the grant period.
9 . The recipient agrees to supplement and not supplant state or local funds.
The recipient acknowledges that failure to submit an acceptable Equal Employment Opporfunity Plan (if recipient is required
to submit one pursuant to 28 CFR section 42.302), that is approved by the Office for Civil Rights, is a violation of its Certified
Assurances and may result in funds from the award being frozen, until such time as the recipient is in compliance.

support personnel, that the units of local government will establish procedures to give members of the Armed Forces who, on
or after October I , I 990, were or are selected for involuntary separation (as described in section I l4 I of Title 10, United States
Code), approved for separation under section ll'14aor I 175 ofsuch title, or retired pursuant to the authority provided under
section 4403 of the Defense Conversion, Reinvestment, and Transition Assistance Act of 1992 (division D of Public Law
102-484; l0 U.S.C. 1923 note), a suitable preference in the employment of persons as additional law enforcement officers or
support personnel.
13. The recipient agrees if funds are used for enhancing security or crime prevention, that the unit of local government --
(a) has an adequate process to assess the impact ofany enhancement ofa school security measure that is undertaken under
subparagraph (B) of section l0l(aX2), or any crime prevention programs that are established under subparagraphs (C) and (E)
of section l0l(a)(2), on the incidence of crime in the geographic area where the enhancement is undertaken or the program is
established;
(b) will conduct such an assessment with respect to each such enhancement or program; and
(c) will submit to the Bureau of Justice Assistance an annual written assessment report.
t4 The recipient agrees that prior to the obligation and expenditure of any Local Law Enforcement Block Grants (LLEBG) funds,
at least one (l) public hearing will be held regarding the proposed use(s) of the grant funds. The recipient will provide
notification to BJA, through the submission of the Follow-Up Information Form, on the contents of the hearing. BJA will
review the form for compliance with enabling legislation and issue to the recipient a Grant Adjustment Notice (GAN). Until
the issuance of the GAN, the recipient may not obligate or expend LLEBG funds. At that hearing, persons shall be given an
opportunity to provide written and oral views to the recipient on the proposed use(s) of the grant funds. The recipient will

The recipient agrees that prior to the obligation or expenditure of any Local Law Enforcement Block Grants (LLEBG) funds, a
designated or newly established advisory board will meet to discuss the proposed (purpose area) use of the grant funds. The
recipient will designate the advisory board to make nonbinding recommendations to the recipient for the use of funds under
the LLEBG Program. Membership on the advisory board must include a representative from the following, however it may be
broader:
a) the local police department or local sheriffs department;
b) the local prosecutor's office;
c) the local court system;
d) the local school system; and
e) a local nonprofit, educational, religious, or community group active in crime prevention or
drug use prevention or treatment.
The advisory board must review the proposed use of the funds under the LLEBG Progtam.
The recipient will provide notification to BJA, through the submission of the Follow-Up Information Form, on the advisory
board. BJA will review the form for compliance with enabling legislation and issue to the recipient a Grant Adjustment Notice
(GAN). Until the issuance of the GAN, the recipient may not obligate or expend LLEBG funds.
16.The recipient has certified it is in compliance with the Public Safety Officers Health Benefits Provision (section 615 of the FY
1997 Omnibus Appropriations Act) and agrees to remain in compliance during the term of the award. This provision requires
the unit of government which employs a public safety officer (as defined by section 1204 of title I of the Omnibus Crime
Control and Safe Streets Act of 1968, as amended) who retires or is separated from service due to injury suffered as a direct
and proximate result of a personal injury sustained in the line of duty while responding to an emergency situation or a hot
pursuit (as such terms are defined by state law) with the same or beffer level of health insurance benefits as would be paid by
the unit of government at the time of retirement or separation, under a normal retirement plan.

2. why isn't a check with the award document?
Because you need to let OJP know which one of the two methods of payment
you want to use to receive money for this grant award.
What are the two methods of payment?
They are: ( l) Lener-of-Credit Electronic Certification System (LOCES); and
(2) Phone Activated Paperless Reqfest System (PAPRS). LOCES is fully
automated and requires the use of a PC and modem. With PAPRS, you use a
touch-tone telephone to request funds. The system provides information about
the status of requests and automatically schedules approved requests for
payment. Payments are electronically forwarded to your bank in both
methods.

4. How do I get more information on LOCES/PAPRS?
There is an additional FAQ in this award package that explains how to use
LOCES and PAPRS and who to contact.
6. What are my reporting responsibilities?
Financial reports, A.K.A. Financial Status Report or SF-269 are to be
prepared every calendar quarter and submitted to the Office of Comptroller
Attn..: US Dept. of Justice - OJP, OC Control Desk, Washington, DC 20531,
no later then 45 days after the end of the quarter.
Program reports, A.K.A. progress reports, are semi-annual and due as
follows: The reports should cover the periods of January | tlrough June 30;
and July I through December 31. The report is due 30 days afterthe end of
the report period, July and January 30th.
Audit reports, A.K.A. Single Audit Reports. A special condition is included
with your award which details reporting requirements for the audit reports.

Box 19 on page 1 of the award document requireS the signature of the
authorizing offical which is the CEO of the unit of local govemment cited in
box 18 (e.g., mayor, county manager, city manager), not the implementing
agency (..g., police chief).
The award is a legally binding document and cannot be altered. Do not
use correction fluid or cross out any of the information on these documents.
If the authorizing offical is not the same as the person listed in box 18,
please send justification to the LLEBG office in the form of a letter.
o New FY 1997 grantees must complete the banking information on the last
page of the special conditions. Grantees that have already enrolled in the

Payment Methods
There are two methods available for grantees to request their funds: (l) LOCES; and (2) pApRS.
Regardless of the method grantees use to request their funds, all funds will be disbursedihrougtr
the US Treasury electronically and directly dlposited within 48 hours into the grantee,s bank
account.
LO CES is the Letter of Credit Electronic Certification System. The LOCES is a modem
connection service that allows recipients of federal funds to electronically.request payment from
the Office of Justice Programs and receive those funds through a direct a"porit to their bank
account- To utilize this systenq a grantee must have a personal computer with a dedicated
modem- The grantee is required to complete a softwarl inventory which results in customized
software which allows the grantee to utiiize this oJp system. - -'- ' " '
PAPRS is tne Phone Activated paperless Request System. pApRS replaces the paper Form
H-3 (Request for Reimbursement) requests by enabling grantees to use their touch tone telephone
to request funds' The system provides on-line information to grantees about the status of their
requests, and will automatically schedule approved payment requests for US Treasury
disbursernent

CAREFULLY READ THIS DOCUMENT BEFORE PROCEEDING
Enclosed in your Award Package is your LLEBG Follow-Up Intbrmation Form and this set of
instructions. It is extremely important that you read this document carefully prior to
completing the form. This Follow-Up Information Form is our tool to gather infLrmation about
your public hearing, advisory board and any change in purpose area allocations. This form may
be completed at any time during the LLEBG process. However, a grantee is not permitted to
obligate any program funds until this form has been submitted, reviewed, and a written Grant
Adjustment Notice (GAN) has been issued releasing the special conditions associated with the
requirement to have conducted a public hearing and advisory board review. A grantee is
permitted to obligate funds only after having received a GAN issued by BJA. Any
outstanding issues will have to be resolved prior to the obligation of funds.
To facilitate your submission BJA has provided the following suggestions and option lists in the
instructions. We are also available to answer any questions by calling the LLEBG program

GENERAL INFORMATION
Please use the Follow-Up Information Form provided in your LLEBG Program Award package.
This form may be completed and submitted with the signed award documents or at any time
during the process. LLEBG grantees are reminded that obligation of program funds is not
permitted until this form has been submitted, reviewed and a written Grant Adjustment Notice
(GAN) issued releasing the special conditions. The Bureau of Justice Assistance (BJA) has
designed the LLEBG forms to be compatible with our automated grants management system.
The follow-up form has been designed to maximize the ability to scan the document into the
management system.
The enclosed form should be mailed back to BJA upon completion. Please type the
information in CAPITAL LETTERS, using either pica lOpt. or elite l2pt. ltis critical that
you use the original form. as it has been created in a scannable format. DO NOT fold, bend, date
stamp, or provide extraneous comments on the form. You may use correction fluid as needed,
and you may want to make a photocopy of the original for your records. PLEASE ENSURE
THAT THE FORM IS SIGNED BY YOUR JURISDICTION'S CHIEF EXECUTIVE
OFFICER (Mayor, City Manager, County Administrator, etc.).
There are three sections to this form: Advisory Board, Public Hearing and purpose Areas.
Advisory Board
Each jurisdiction must establish or designate an advisory board to review the application and
designate it to make nonbinding recommendations for the proposed use of funds received under
this Program. This board must include, but is not limited to, a representative from:
(l) the local police or sherifps department;(2) the local prosecutor's office;(3) the local court system;(4) the localpublic school system; and(5) a local nonprofit, educational, religious or community group active in
crime prevention or drug use prevention or treatment.
Public Hearing
In addition, each jurisdiction must hold at least one public hearing regarding the proposed use of
LLEBG Program funds. At the hearing, persons shall be given an opportunity toprovide written
and oral views to the unit of local government authority responsible for implem"nting program
activities. The jurisdiction shall hold the hearing at a time and place that ailows and encourages
public attendance and participation.

Purpose Areas Changes
The last section allows the jurisdiction to provide updated information on the proposed allocation
of funds to each purpose area. If changes have been made to the original allocations indicated, on
the LLEBG Application Form, please provide the updated information in this section.

Award Process
The Bureau of Justice Assistance (BJA) has recently completed processing over 3000 awards to
States and units of local govemment eligible for Fiscal Year 1997 funding through the Local
Law Enforcement Block Grants (LLEBG) Program. In order that we might be able to provide
you with a full measure of service and ensure that you receive your grant funds in a timely
fashion, we have enclosed a number of materials that describe program and administrative
requirements.
Within 45 days of receipt, the Chief Executive Officer of your jurisdiction must counter-sign
both the enclosed award documents in box number 19, and the last page of the special conditions
and return a copy to the LLEBG Control Desk, 810 Seventh Street, NW, Washington, DC 20531.
Execution of these documents denotes the official grantee's acceptance of the award, and the
grantee's agreement to comply with the attached special conditions.
Banking information has also been included as part of the special conditions. For those grantees
that have already completed the Automated Clearing House (ACH) Enrollment Forms, do not
complete the banking information, unless it has changed (most FY 1996 LLEBG grantees have
already submitted this information). New FY 1997 LLEBG grantees must complete the banking
information to be enrolled in the Phone Activated Paperless Request System (PAPRS). All
grantees will draw down funds through PAPRS, which enables grantees to use their touch
tone telephone to request funds. For more information about PAPRS call the Accounting
Division helpline at (202) 307-6232.

LLEBG Control Desk once your jurisdiction has complied with Special Conditions 14
and 15, Public Hearing and Advisory Board, respectively. It is only upon compliance

manual in subsequent mailings.

Those jurisdictions that have been certified as disparate jurisdictions by their State Attorney
General are required to submit a joint spending plan, which has been included. There is no
deadline for submission of a joint spending plan. However, until such time that ajoint spending
plan is received by BJA and the corresponding GAN is generated by BJA to clear the appropriate
special condition, no funds may be obligated or expended.
Subsequent Mailings
Within 45 days you will receive a variety of additional materials from us designed to assist you
in implementing your LlEBG-supported programs. Among these will be LLEBG progress
reporting materials, annual written assessment requriements and an addendum to the guidance
manual.

I arn pleased to announce the availability of funding under the Local L.aw Enforcement Block
Grants (LLEBG) Program. established within the Bureau of Ju.stice Assistance (BJA) under the
Fiscal Yenr 1997 Omnibr,rs Appropriations Act (Pub. L. 104-208). Your jr.rrisdiction is eligible to
apply to BJ,,\ for a direct award of $ 32,662 under this program. Fr-rnding may be used for seven
puryose areas. which address a rvicle variety of activities from increasing personnel ancl
equipment resources for larv enforcement to developing and supporting programs to enhance
effective criminal justice processes. The program will provide your jurisdiction with
opportunities to redlrce crime and improve public sat'ety through the implementation of diverse
strategies ranging from acldressing violent juvenile crime to establishing crime prevention
programs that foster cooperation between community residents and law enforcement personnel.
Applications for the LLEBG program must be submitted to BJA no later than July I l, 1997. All
complete applications will be approved by September 30, 1997. Enclosed is a Local Law
Enforcenrent Block Grants Program Application Kit. which identifies the program purposes and
gives detailed instructions for submitting an application to BJA. The kit contains all required
forms, certifications, and assurances to secure an award.
To facilitate the application process, we encourage yoLl to submit your application in electronic
format via computer modem using our 800 number or the formatted computer disk provided rvith
the application kit. Your jurisdiction has been given a unique identification (ID) number and a
password. You rvill need both to apply via computer modem. Only the ID number is needed to
apply via formatted Cisk.
Applications also may be submitted by facsimile or by mailing in the hard copy application.
However, to expedite the application process, we ask that applications be submitted using only
one of these four methods.
Upon notification of an award under this program, and prior to obligation of any funds, each
local jurisdiction is required by statute to establish an advisory board to review the application
and make nonbinding recommendations on the use of Block Grants funds. The jurisdiction is
also required to conduct at least one public hearing on the use of Block Grants funds prior to
fund obligation. Federal funds provided under a grant from this program may not exceed 90
percent of the total costs of the project. The matching share (at least l0 percent) must be cash.
The matching share must be obligated and expended during the Federal project period.
Please be aware that there is a provision in the statute that addresses the potential for funding
disparities between counties and cities within those counties. Per this provision, the State
Attorney General may certify that such a funding disparity exists and in certain cases that the
disparity is likely to threaten the efficient administration of justice. The last date that such a
certification may be submitted to BJA coincides with the application due date, July 11,1997. If
such a disparity is certified relative to your jurisdiction, you are required to submit a joint funding
plan with the other jurisdictions affected by the disparity. Please refer to "Distribution of
Awards" in the Application Kit for additional information.
