IN THE AMOUNT OF $192,415 FOR SANITARY SEWER REHABILITATION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby approves Change Order No. 1 to the engineering contract with RJN Group,Inc. in the amount of$192,415 for sanitary sewer rehabilitation. A copy of the change order is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 16th day of September , 1997. B 4-04 Traci Paul, City Clerk •4: • 4. y %fi) L Amendment No. 1 EXHIBIT A WHEREAS, on the third day of December 1996 the City of Fayetteville, Arkansas and RJN Group, Inc . made and entered into a contract for Engineering Services related to sewer improvements in the White River and Illinois River Watersheds and WHEREAS, the Wastewater Collection System Master Plan recently completed for the City of Fayetteville identified several sewer segments in Basin 9 of the Illinois River Watershed requiring capacity improvements to prevent sanitary sewer overflows . The City of Fayetteville desires to proceed with these improvements in conjunction with currently scheduled improvements in Basin 9, the engineering services for the original agreement may be modified to include these improvement . WHEREAS, the City of Fayetteville and RJN Group, Inc . desire to amend said Contract, so as to include therein the necessary scope of work; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS : That the City of Fayetteville, a municipal corporation situated in Washington County, Arkansas, hereinafter called "City" and RJN Group, Inc . , hereinafter called "Engineer" , hereby make and enter into the following agreement : The December 3, 1996 contract between the City of Fayetteville and RJN Group, Inc . is hereby amended to include additional services required to provide final engineering design, bidding services, and resident engineering services for the Basin 8 and Basin 9 sewers listed in Table 1, attached hereto and made part of this Amendment No. 1 . A separate set of construction documents will be provided. The contract entered into on December 3, 1996 is hereby amended by increasing the cost not- to-exceed ceiling in Section V, Fees and Payment to $627, 648 . A revised schedule, Exhibit B, and Exhibit C is also attached hereto and made part of this agreement . Also included is final engineering design and resident engineering sercices for manhole and sewer line rehabilitation on the University of Arkansas campus . A total of 200 manholes are included. Sewer lines scheduled for rehabilitation are given in Table 2 and Table 3 . All other provisions, covenants, recitals, terms and conditions of the Contract, which are not expressly amended herein, shall remain in full force and effect . With mutual agreement, the City and the ENGINEER may modify the project schedule during the course of the project and if such modifications affect the ENGINEER' s compensation, it shall be modified accordingly, subject to City Council approval . For Special Services, the authorization by the City shall be in writing and shall include the definition of the services to be provided, the schedule for commencing and completing the services and the basis for compensation therefore, all as agreed upon by the City and ENGINEER in writing.
