BE IT RESOLVED BY TIIE CITY COTJNCIL OF TIIE CITY OF FAYETTEVILLE, ARKANSAS: Section I. That the City Council hereby approves an agreement with Washington County for animal shelter services; and authorizes the Mayor and City Clerk to execute said agreement. A copy of the agreement is attached hereto marked Exhibit "A" and made a part hereof. The initial contract period will be tbr rwelve (12) months. January l, 1997 to December 31, I997. This contacr may renew automatically for three (3) additional one (l) year terflIs subject to budget approval by Washington County funding this agleement and budget approval by Fayeneville firnding the Fayetteville Animal Shelter. Fayeaeville will accept Corurty animals on a space available basis delivered to the Shelter at 1640 Armstrong Avenue, Fayetteville, Arkansas, by designated animal control officers, law enforcement offi.cers, health officers, or citizens of the County duing normal operating hotus which are as follows: Monday throueh Friday Animd Control Officers, Law Enforcement Ofncers, or County Health Oflicers 8:00 a.IIr. to 4:00 P.m. Sunday Animal Conuol Officer. Law Enforcement Oflicers, or County tlealth Officers 8:00 a.m. to 2:00 p'm' Additionally, Fayeneville will provide a holding arca equipped with cages to house animals brought in after hours by County Animal Control Officers, County Law Enforcement Officers, or County Health Officers. Cor:nty animal(s) shall meen any cat or dog brought to the Shelter by an Animal Control Officer, any Law Enforcement Officer, or any County Healttr Officer who is employed by county gou.*-"nt and/or by any citizen whose address is located within the corporate boundaries of Washington County and outside the corporate boundaries of any incorporated city. I. GUARAT{TEE OF AVAILABLE SPACE The City will tahe County animals on a space-available basis. rT. SHELTERING SERVICES These services to be provided under this Agreement include, but are not limited to, thc following: Sheltering of County animals Anirnal Adoption services Food Exercise Medication, as necessary Animals will be sheltered up to five (5) days, at which time the decision will be made to Put them up for adoption or euthanasia (no extra charge) except for animals that either have severe injr:ries such that it would be inhumane to shelter them the five (5) day term, or animals that have contagious or communicable diseases that would pose a threat to the health and welfare of the remaining animals or staff. The one-time $4E.59 charge would still apply in this situation- Thc fee for the Sheltering services provided shall be $48.59 per animal. This is a one (l) tirne charge; not per diem. This, and othcr fees. may be renegotiated annually. Itr. ANIMAL QUARANTII{E AND IMPOUNDIT{ENT SERVICES These services will be provided to the County for laurful public health and./or public safety purposes as determined by the appropriate Cor:nty otficial on a space available basis. Fayetteville shall have exclusive right of determination for space available purposes. Animal Quarantine and Impoundment servicesinclude: animal boarding; animal euthanasia services when authorized, in writing, by the appropriate County Official; animal body disposal services when authorized, in uriting. by the appropriate County Oflicial. l. 2. 45. 4. 5. a aRPR-11-r99? 1?:35 I^JRSH CO JUDGE 541 444 1BB9 P.As April I l. 1997/kb A}IIMAL SHELTERING AGREEMENT PAGE 3 The fecs for the Animal Quarantine and Impoundment Services are established by Fayetteville City Ordinance or by approved regulations and are amended from time to time. The fees listed below are extracted from the appropriate ordinance or regulation: $ 10.00 per day These fees are separate and not in addition to Sheltering service fees Each month, an invoice listing the services provided during the previous month will be submined to the County. The County agrees to pay Fayetteville within thirty (30) days of the date of the invoice. With the invoice, Fayeneville will enclose a duplicate copy of the intake form for cach animal sheltered, or provide a listing of all animals quarantined or impounded. The parties agree that thc annual services to be provided under this Agreement are limited to the 3snnal appropriations approyed by the Washington County Quorum Court. Any animal in the custody of the shelter for which the County is financially liable shall not be released to its owner until said owner has paid to the Washington County Sheriffs Office $55.00 plus $6.00 (if a rabies vaccination is needed). 2.
