RESOLUTION NO. 2 0-9 7 A RESOLUTION APPROVING A LEASE MODIFICATION TO CURRENT AIRLINE AGREEMENTS WHICH WILL ALLOW A ONE YEAR EXTENSION OF EACH CONTRACT WITH FIVE ONE YEAR OPTIONS AND GRANT TO EACH AIRLINE A 5% DISCOUNT, INCREASED BY 5% ANNUALLY THROUGH THE FIVE YEAR EXTENSION PERIOD, TO EXCLUSIVE SPACE RENTAL. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby approves a lease modification to current airline agreements which will allow a one year extension of each contract with five one year options and grant to each airline a 5% discount, increased by 5% annually through the five year extension period, to exclusive space rental. WHEREAS, Lessor and Atlantic Southeast Airlines, Inc., entered into a Lease Agreement dated May 1. 1985, which lease has been modified by subsequent agreements; and, WHEREAS, the parties desire to further modify the aforesaid Lease Agreement NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS: 1. Number 4. of said lease is hereby modified to read: TERM: Subject to earlier termination, as hereinafter provided, the term of this agreement shall be as follows: The term shall commence on January 1, 1997 and shall end December 31, 1997. The agreement may be extended for five additional one year terms under the terms of the existing agreement with the exception of exclusive space rental. 2. Number 5. of said lease is hereby modified to read: RENTALS AND CHARGES: Lessee agrees to pay Lessor for the use of the premises, facilities, rights, services, and privileges granted hereunto, rentals and charges according to the following schedule, which rentals and charges shall be payable within 20 days from receipt of invoice. It is the desire of the Lessor to maintain air carrier service by offering incentives to retain the current level of air carrier services. Should, however, any one or more of the air carriers operating at the Airport on January 1, 1997, terminate their agreement(s), all contracts shall immediately become subject to monetary re-negotiation of the stated terms at the discretion of the Lessor. 3. Number 5A of said lease is hereby modified to read: A. For the exclusive use of 835.5 square feet of office space in the terminal building such space being more particularly identified as the addition of ticket counter space, existing operations center, storage/office space and freight handling/store room, the sum of$14.62 per square foot for 1990 upon relocation of said counter and $15.86 per square foot for the calendar year 1991. 1. A five percent (5%) discount to exclusive space rental shall be granted to the Lessee, said discount will be increased by an additional five percent (5%) annually on January 1st of each year through the five year extension period. This discount shall not exceed twenty five percent (25%) through the extension period. Should any one of the air carriers providing service on January 1, 1997, terminate their agreement(s), all air carrier contracts are subject to re-negotiation in accordance with Paragraph 5. - . _ 4. This option extends your contract for one year with an additional five percent(5%)discount to each airline currently operating at Drake Field. The five percent (5%) reduction will take effect annually through the five year extension period and applies to the exclusive space rental.
