A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AN AMENDMENT NO. 3 TO THE
ENGINEERING AGREEMENT WITH DEVELOPMENT
CONSULTANTS, L.L.C. FOR THE DESIGN OF THE MUD
CREEK BRIDGE REPLACEMENT, IN THE AMOUNT $10,000.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That the City Council hereby authorizes the Mayor and City Clerk to
execute Amendment No. 3 to the engineering agreement with Development Consultants, L.L.C.,
for the design of the Mud Creek Bridge replacement, in the amount of $10,000. A copy of the
agreement is attached hereto marked Exhibit "A" and made a part hereof.

AMENDMENT TO
AGREEMENT FOR ENGINEERING SERVICES
MUDD CREEK BRIDGE
FAYETTEVILLE, ARKANSAS
THE AMENDMENT to the AGREEMENT FOR ENGINEERING SERVICES, is made
and entered into by and between the City of Fayetteville, Arkansas, hereinafter called
the "OWNER", and Development Consultants, L.L.C., hereinafter called the
"ENGINEER" a corporation existing under the laws of the State of Arkansas, with
principal offices at 1970 East Joyce Boulevard, Suite 1, Fayetteville, Arkansas 72703,
WITNESSETH
WHEREAS, the OWNER and the ENGINEER entered into an Agreement for
Engineering Services for design services (Title I Services) at the Mudd Creek Bridge on
Gregg Street on November 4, 1994, and
WHEREAS, it is the desire of the parties to amend said contract by including
additional services to the scope of work to be performed by the ENGINEER, and by the
modification of the contract to reflect the additional expense required to perform said
additional items.
NOW, THEREFORE, for an in consideration of the terms, conditions, and
covenants hereinafter set forth, the parties hereto do mutually agree as follows:
Modify SECTION IV -- SERVICES TO BE FURNISHED BY THE ENGINEER to
include the following additional item as a part of this project:
i. Redesign of proposed bridge structure from precast to a composite steel
bridge with poured deck.
II. Modify SECTION IX -- FEES AND PAYMENTS with the following:
1. Replace existing Fee shown with the new amount of Eleven Thousand
Two Hundred Sixty Eight Dollars and Seventy Eight Cents ($11,268.78).
and
2. Replace existing Upper Limit Contract shown with the new amount of
Eighty Six Thousand Four Hundred and One Dollars and Twenty Four
cents ($86,401.24), plus reimbursable expenses. Reimbursable expenses
shall have an upper limit of $5,000.00.
III. The effective date of this Amendment is the date it is fully executed by the
parties hereto.
IN WITNESS WHEREOF, the parties have caused this contract to be executed in
multiple copies by the duly authorized representatives upon the dates set forth
immediately below.
