HomeMy WebLinkAbout2-97 RESOLUTION SCANN RESOLUTION NO. 2-9 7 A RESOLUTION AWARDING BID NO. 96-50, IN THE AMOUNT OF $31,222 TO CHRIS KING ELECTRIC FOR THE AIRFIELD LIGHTING CONTROL PROJECT; AND APPROVAL OF A BUDGET ADJUSTMENT. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby awards Bid No. 96-50, in the amount of $31,222 to Chris King Electric; and authorizes the Mayor and City Clerk to execute said contract for the airfield lighting control project. A copy of the contract and bid tabulation are attached hereto marked Exhibit A and Exhibit B and made a part hereof. Section 2. The City Council hereby approves a budget adjustment in the amount of $31,222 increasing Fixed Assets, Acct. No. 5550 3960 5801 00 by decreasing Use of Fund Balance, Acct. No. 5550 0955 4999 99. APPROVED: ,..f r By: .,A ' * i s ' Fred Hanna, Mayor ATTEST: By: Jae,/ • 1(19-2,0 Traci Paul, City Clerk • BID 96-56 EXHIBIT A CONTRACT FOR INSTALLATION OF AN AIRFIELD LIGHTING CONTROL SYSTEM AT THE CITY OF FAYETTEVILLE MUNICIPAL AIRPORT This agreement made the//day of ,fie--e- , 1996, by and between Chris King Electric hereinafter called "Contractor" and the City of Fayetteville, hereinafter called the "City" shall be utilized to provide the following services: The Contractor hereby agrees to provide all necessary equipment, materials and incidental items, and all labor required to accomplish every detail of the Airfield Lighting Control Project at the Fayetteville Municipal Airport in accordance with the bid documents and specifications (bid 95-50). For this work, at total amount "not to exceed" $31,222.00 was bid. This project is to be considered a "turn key"job and shall include all items as provisions set forth in the bid specifications and attachments attached hereto and made a part hereof. The project time frame shall coincide with the number of days stated in the bid documents (65 _calendar days) which were submitted to the Purchasing Officer. If the bid exceeds $10,000, the Terms and Standard Conditions of the City of Fayetteville expressed in item 19. A/C shall be considered a binding part of this agreement and shall be provided by the Contractor. Liquidated damages shall be assessed at $100 per day beginning on the first day following the maximum delivery or completion time entered on the bid form. No suit, action or proceeding shall be brought on this bond outside the State of Arkansas. No suit, action or proceeding shall be brought on this bond except by Owner, unless it is brought in accordance with A.C.A. Section 22-9-403 (b) and A.C.A. Section 18-44-503 (b) (Supp. 1987) as amended. No suit, action or proceeding shall be brought by the Owner after two years from the date on which the final payment under the Contract falls due. Any alterations which may be made in the terms of the Contract, or in the work to be done under it, or the giving by the Owner of any extension of time for the performance of the Contract, or any other forbearance on the part of either the Owner or the Principal to the other shall not in any way release the Principal and the Surety or Sureties, or either or any of them, their heirs, personal representatives, successors or assigns from their liability hereunder, notice to the Surety or Sureties of any such alteration, extension or forbearance being hereby waived.
