NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the requirements of formal competitive bidding and authorizes the purchase of one excavator attachment from ACME Trenchless Inc. in the amount of $52,493.43, plus any applicable sales taxes, freight charges and delivery fees. Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget amendment, a copy of which is attached to this Resolution. RECOMMENDATION: A resolution to waive competitive bidding and approve the purchase of one excavator attachment with accessories from Acme Trenchless Inc. in the amount of $52,493.43 plus any additional taxes, freight charges and delivery fees and the approval of a budget amendment. BACKGROUND: The Water and Sewer Department is in need of an additional pipe pulling machine to increase service capacity. Currently, the two units that are in service are split between large subdivision replacement projects. The third one would be used for water service line leak repairs. There is an available third excavator that will be used for the operation of this attachment. DISCUSSION: The addition of this attachment will allow the Water and Sewer Department to have a cost-effective option to continue to repair and improve the City's infrastructure and rapidly reduce water loss. Back in 2025, both the Water and Sewer Department and Fleet Operations received a demo of this attachment specifically made to be adapted to the Bobcat excavators and were able to use it in the field for live water line repairs. It was able to successfully remove and replace multiple lines with the training and assistance of Acme Trenchless field reps. Fast -forward to the beginning of FY2026, and we have currently purchased (2) pipe pullers of which this would be the third purchased. This was originally brought to Purchasing to bid out as well. However, as the bidding process unfolded, it was apparent with only (2) known manufacturers of this product and interested parties, Purchasing chose to approve a Sole Source / waive competitive bidding for the Acme Pipe Puller from Acme Trenchless with the justification that they provide the only solution for removing pipes with a 2" diameter. For some additional background, according to the Water and Sewer department the city has approximately 800-1000 2-inch service lines and the Acme Trenchless product as presented here would be the only pipe puller capable of repairing these water lines. Lastly, Acme was the only product capable of pulling 120' of 2- inch line. The other product would only be capable of 80' pulls of 1-inch line. BUDGET/STAFF IMPACT: Mailing address: 113 W.
