AN ORDINANCE TO APPROVE VAC-25-31 FOR PROPERTY LOCATED AT 907 SOUTH HOLLYWOOD
AVENUE IN WARD 1 TO VACATE 0.10 ACRES OF GENERAL UTILITY EASEMENT
WHEREAS, the City Council has the authority under Ark. Code Ann. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of general utility easement is not
required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of general utility
easement as described in Exhibit B attached to the Planning Department’s memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department’s memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the following conditions:
1.Any damage to or relocation of existing facilities will be at the property owner/developer’s expense.
2.Overhead service may need to be relocated prior to construction, as requested by SWEPCO.

SUBJECT: VAC-2025-0031: Vacation (907 S. HOLLYWOOD AVE/RIGGINS VENTURES, 559):
Submitted by SITEWISE for property located at 907 S. HOLLYWOOD AVE. in WARD 1.
The property is zoned CS, COMMUNITY SERVICES and contains approximately 0.27
acres. The request is to vacate 0.10 acres of a general utility easement.
RECOMMENDATION:
Staff recommends approval of VAC-2025-0031 as shown in the attached Exhibits 'A' and 'B', and with the
following conditions of approval:
1.Any damage or relocation of existing facilities will be at the property owner/developer’s expense; and
2.Overhead service may need to be relocated prior to construction, as requested by SWEPCO.
BACKGROUND:
The subject property is in central Fayetteville on the west side of S. Hollywood Avenue, 500 feet south of W. Martin
Luther King Boulevard, and across the street from Fire Station #6. The property received its current zoning
designation of CS, Community Services on December 1, 2020 (RZN-2020-0019). A demolition permit was approved
to remove all structures on the property (DEMO-2025-0104), which was completed on December 10, 2025. A
previous vacation for right-of-way on this property was approved by City Council (Ord. 2596).
Request: The applicant proposes to vacate an existing, 30-foot wide utility easement that extends from east to west
along the north line of the property, totaling approximately 4,377 square feet.
DISCUSSION:
The applicant submitted the required approvals with no objections. With submittal of the required vacation
forms and utility consent, staff recommends approval.

RE: 907 S Hollywood – Utility Easement Vacation
This easement vacation is associated with the property at 907 S Hollywood Street,
Washington County parcel #765-12150-000.
The intent of this vacation is to free up the parcel to further infill development potential. The
existing 30’ wide easement is approximately 4,377 square feet and covers of the 37%
11,761 square foot parcel. The easement is confirmed to be vacant of any utility and we
have received approval from all utility providers to vacate the easement.

We, the undersigned, being all the owners of the real estate abutting the easement
hereinafter sought to be abandoned and vacated, lying in Lot 1 of Block 6 of Westwood
Addition, City of Fayetteville, Arkansas, a municipal corporation, petition to vacate an
easement which is described as follows:
A 30-FOOT WIDE UTILITY EASEMENT BEING ALL OF THE S1/2 OF THE VACATED COMMERCE
STREET LYING ADJACENT TO AND CONTIGUOUS WITH THE NORTH LINE OF LOT 1 OF

WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the
City of Fayetteville, Arkansas, abandon and vacate the above described real estate, and
that title to said real estate sought to be abandoned be vested in the abutting property
owners as provided by law, and as to that particular land the owners be free from the
easements of the public for the use of said right-of-way.

AN ORDINANCE TO APPROVE
VAC-25-31 FOR PROPERTY LO-
CATED AT 907 SOUTH HOLLY -
WOOD AVENUE IN WARD 1 TO
VACATE 0.10 ACRES OF GEN-
ERAL UTILITY EASEMENT
WHEREAS, the City Council
has the authority under Ark.
Code Ann. § 14-54-104 to va-
cate public grounds or portions
thereof which are not required
for corporate purposes; and
WHEREAS, the City Council
has determined that the follow-
ing described portion of general
utility easement is not required
for corporate purposes.
NOW, THEREFORE, BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Coun-
cil of the City of Fayetteville,
Arkansas hereby vacates the
portion of general utility ease-
ment as described in Exhibit B
attached to the Planning De-
partment's memo.
Section 2: A copy of this Ordi-
nance duly certified by the City
Clerk along with the map at-
tached as Exhibit A to the Plan-
ning Department's memo shall
be filed in the office of the
Washington County Circuit
Clerk.
Section 3: This vacation ap-
proval is subject to the following
conditions:
1. Any damage to or reloca-
tion of existing facilities will be
at the property owner/devel-
oper's expense.
2. Overhead service may
need to be relocated prior to
construction, as requested by
SWEPCO.
