AN ORDINANCE TO APPROVE VAC-25-25 FOR PROPERTY LOCATED AT 1370 AND 1378 SOUTH VAN
BUREN AVENUE IN WARD 1 TO VACATE 0.25 ACRES OF RIGHT OF WAY
WHEREAS, the City Council has the authority under Ark. Code Ann. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of right of way is not required for
corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of right of way as
described in Exhibit B attached to the Planning Department’s memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department’s memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the following conditions:
1. Any damage or relocation of existing facilities will be at the property owner/developer’s expense;
2. A 20-foot wide access and drainage easement shall be dedicated for the entire length of the vacated right of
way abutting Lot 1 to maintain an existing storm pipe. The owner of Lot 12 shall be required to execute the
document by which the easement is dedicated for any portion of the new easement that may extend into Lot
12.

SUBJECT: VAC-2025-0025: Vacation (1378 S. VAN BUREN AVE./HJL INVESTMENTS, 561):
Submitted by HJL INVESTMENTS LLC for property located at 1370 & 1378 S. VAN
BUREN AVE in WARD 1. The property is zoned RMF-24, RESIDENTIAL MULTI-
FAMILY, 24 UNITS PER ACRE and both properties each contain approximately 0.30
acres. The request is to vacate 0.25 acres of right-of-way.
RECOMMENDATION:
Staff and Planning Commission recommend approval of VAC-2025-0025 as shown in the attached Exhibits 'A'
and 'B', and with the following conditions of approval:
1. Any damage or relocation of existing facilities will be at the property owner/developer’s expense;
2. A 20-foot wide drainage easement shall be dedicated for the entire length of the vacated right of way
abutting Lot 1 to maintain an existing storm pipe. The owner of Lot 12 shall be required to execute the
document by which the easement is dedicated for any portion of the new easement that may extend
into Lot 12.
BACKGROUND:
The subject right-of-way is in south-central Fayetteville approximately 250 feet northwest of the W. 15th street
and S. Van Buren Avenue intersection. The properties adjacent to the right-of-way are zoned RMF-24,
Residential Multi-Family, 24 Units per Acre, and are developed with single-family dwellings constructed in 1956
and 1936. The subject street right-of-way was originally platted in 1946 as part of the Wilson-Dunn addition.
Request: The applicant proposes to vacate a 0.25-acre portion of right-of-way, comprising half of the overall
right-of-way extending from S. Ellis Avenue to S. Van Buren Avenue.
DISCUSSION:
Staff supports the applicant’s request to vacate this right-of-way, with conditions. Engineering staff recognizes
that fully improving this unimproved street right-of-way is likely cost-prohibitive as the College Branch stream,
which is subject to the development requirements of UDC 168.12 – Streamside Protection Zone, bisects the
right-of-way. The development of the unimproved right-of-way is not part of any near- or long-term
Transportation project, and is unlikely to be a justified improvement associated with private development given
the potentially high financial cost.

At the November 24, 2025 meeting, Planning Commissioners forwarded the request with a recommendation of
approval with a vote of 9-0-0. The Commissioners amended the drainage easement to be 20-feet wide and
removed the public access portion of the original, staff-proposed condition.

The subject property is in central Fayetteville approximately 215 feet northwest of the W. 15
th
street and S. Van Buren Avenue intersection. The property is zoned RMF-24, Residential Multi-
Family, 24 Units per Acre. Both subject properties are currently developed with two single-family
dwellings that Washington County records indicate were constructed in 1956 and 1936. The
subject street right-of-way was originally platted in 1946 as part of the Wilson-Dunn addition.

DISCUSSION:
Staff supports the applicant’s request to vacate this right-of-way with conditions. Engineering staff
recognizes that fully improving this street right-of-way would come at a major cost as the College
Branch stream bisects the right-of-way, which is subject to the development requirements of UDC
168.12 – Streamside Protection Zone. To develop this potential street link within this floodplain,
engineering staff has stated that there would be extensive development for the construction of a
bridge for a street link, something that may not be a near or long term priority for because of the
potentially high financial cost. To ensure that a connection is still retained, staff recommends a
condition requiring that a public access easement be dedicated jointly within the recommended
conditional 30-foot wide drainage easement so that a future pedestrian walkway may be
developed.
Vacation Approval: The applicant has submitted the required vacation approval forms to relevant
city departments and franchise utility companies with the following responses.
Utility Response
Cox Communications No objections, provided that any damage or relocation of existing
facilities will be at the property owner/developer’s expense.
AEP/SWEPCO No objections and no comments.
Black Hills Energy No objections and no comments.
AT&T No objections and no comments.
Ozarks Electric No objections and no comments.
City of Fayetteville Response
Water/Sewer No objections and no comments.
Solid Waste & Recycling No objections and no comments.
Transportation No objections, provided a 30-foot access and drainage easement
retained for the entire length of abutting Lot 1 to maintain the
existing storm drain pipe to the end.
Public Comment: No public comment has been received.
RECOMMENDATION: Staff recommends approval of VAC-2025-0025. Should the Planning
Commission choose to forward, staff recommends the following conditions:

AN ORDINANCE TO APPROVE
VAC-25-25 FOR PROPERTY LO-
CATED AT 1370 AND 1378
SOUTH VAN BUREN AVENUE IN
WARD 1 TO VACATE 0.25 ACRES
OF RIGHT OF WAY
WHEREAS, the City Council
has the authority under Ark.
Code Ann. § 14-54-104 to va-
cate public grounds or portions
thereof which are not required
for corporate purposes; and
WHEREAS, the City Council
has determined that the follow-
ing described portion of right of
way is not required for corpo-
rate purposes.
NOW, THEREFORE, BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Coun-
cil of the City of Fayetteville,
Arkansas hereby vacates the
portion of right of way as de-
scribed in Exhibit B attached to
the Planning Department's
memo.
Section 2: A copy of this Ordi-
nance duly certified by the City
Clerk along with the map at-
tached as Exhibit A to the Plan-
ning Department's memo shall
be filed in the office of the
Washington County Circuit
Clerk.
Section 3: This vacation ap-
proval is subject to the following
conditions:
1. Any damage or relocation
of existing facilities will be at
the property owner/developer's
expense;
2. A 20-foot wide access and
drainage easement shall be
dedicated for the entire length
of the vacated right of way
abutting Lot 1 to maintain an
existing storm pipe. The owner
of Lot 12 shall be required to
execute the document by which
the easement is dedicated for
any portion of the new ease-
ment that may extend into Lot
12.
