NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of right-of-way as described in Exhibit B attached to the Planning Department's memo. Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk. Section 3: This vacation approval is subject to the ongoing condition that any damage to or relocation of any existing facilities will be at the property owner/developer's expense. The property is zoned RSF-4, RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE and contains approximately 0.33 acres. The request is to vacate 0.02 acres of a general utility easement. RECOMMENDATION: Staff recommend approval of VAC-2025-0027 as shown in the attached Exhibits 'A' and '13% and with the following condition of approval: 1. Any damage or relocation of existing facilities will be at the property owner/developer's expense, and BACKGROUND: The subject area is in central Fayetteville at the corner of W. Megan Drive's intersection with N. Porter Road. The overall 0.33-acre subject area is a single parcel with a single-family dwelling that was developed in 1995, according to Washington County records. The property does not fall within any overlay districts, Master Plan areas or floodplain. A rezoning from RSF-4, Residential Single -Family, 4 Units per Acre to RSF-8, Residential Single -Family, 8 Units per Acre has been proposed and will be heard by City Council on November 18, 2025 after forwarding by the Planning Commission. Request: The applicant proposes to vacate a portion of an existing general utility easements totaling 0.02 of an acre: a 25-foot wide easement bisects the property north to south on the eastern portion of the property. A survey indicates that the existing house on the property encroaches in to the easement. DISCUSSION: The applicant submitted the required approvals with no objections. Background & Intent This request proposes to retain a 20-foot-wide utility easement consistent with the City's Master Street Plan (MSP) right-of-way corridor.
