RECOMMENDATION: Staff recommends approval of a contract in the amount of $114,900.20 with Flow State LLC for the restoration of Scull Creek downstream of Fulbright Expressway, pursuant to Bid 25-52, and approval of a project contingency of $18,000.00 (15.6%) and approval of a budget adjustment. BACKGROUND: On December 15, 2020, the City council approved resolution number 308-20 authorizing the acceptance of a Wetland Program Development Grant in the amount of $300,000. The city matched this grant with $100,000 from the 2019 Bond Program and the Illinois River Watershed Partnership provided $30,000 for a total project amount of $430,000. The potential stream restoration projects identified within the grant were as follows: •Scull Creek just south of Van Asche Drive: includes damage to private property from large cut banks. •Niokaska Creek downstream of Azalea Terrace: Includes an “s” turn in which a large amount of erosion is taking place and beginning to threaten private structures •Within existing park land on a tributary to Flynn Creek near N Brookbury Crossing, commonly called Rocky Branch, which also includes damage to private property •Clear Creek directly downstream of Lake Fayetteville: includes damage to both public and private property The City recently completed the restoration of Niokaska Creek and the tributary to Flynn Creek. Rocky Branch was also recently completed outside of this grant through a partnership with the Illinois River Watershed Partnership (IRWP) DISCUSSION: The last project included within this grant is the restoration of a section of Scull Creek between Fulbright Expressway and Van Asche Dr. A bid opening was held on October 16th; however, no bids were received. In order to complete this project within the grant deadline, expedited approval by the City Council is requested. The City received bids for Bid 25-52 on November 12, 2025 for the proposed project. The bid identified Flow State LLC as the lowest responsive bidder on the project with a total bid of $114,900.20 and staff is Mailing address: 113 W. Mountain Street Fayetteville, AR 72701 www.fayetteville-ar.gov recommending the award of this contract. Due to the timing of the grant and the anticipated construction contract length, it was necessary to get this on the Council agenda just after bids were opened. Page 1 of 7 AGREEMENT BETWEEN OWNER AND CONTRACTOR FOR CONSTRUCTION CONTRACT (STIPULATED PRICE) THIS AGREEMENT is by and between City of Fayetteville (“Owner”) and (“Contractor”). Owner and Contractor hereby agree as follows: ARTICLE 1 – WORK 1.01 Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is generally described as follows: RESTORATION OF APPROXIMATELY 300 FT SECTION OF NIOKASKA CREEK THAT WILL REDUCE STREAMBANK EROSION AND IMPROVE AQUATIC AND TERRESTRIAL HABITAT. ARTICLE 2 – THE PROJECT 2.01 The Project, of which the Work under the Contract Documents is a part, is generally described as follows: Work includes constructing stacked rock revetment, installing a rock vane structure, and enhancing the adjacent native riparian area. ARTICLE 3 – ENGINEER 3.01 The Project has been designed by __Watershed Conservation Resource Center_________. 3.02 The Owner has retained _Watershed Conservation Resource Center__ (“Engineer”) to act as Owner’s representative, assume all duties and responsibilities, and have the rights and authority assigned to Engineer in the Contract Documents in connection with the completion of the Work in accordance with the Contract Documents. ARTICLE 4 – CONTRACT TIMES 4.01 Time of the Essence A.All time limits for Milestones, if any, Substantial Completion, and completion and readiness for final payment as stated in the Contract Documents are of the essence of the Contract. 4.02 Contract Times: Days A.The Work will be substantially completed within 56 days after the date when the Contract Times commence to run as provided in Paragraph 4.01 of the General Conditions, and completed and ready for final payment in accordance with Paragraph 15.06 of the General Conditions within 70 days after the date when the Contract Times commence to run. 4.03 Liquidated Damages A.Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the times specified in Paragraph 4.02 above, plus any extensions thereof allowed in accordance with the Contract. Page 2 of 7 delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty): 1.Substantial Completion: Contractor shall pay Owner $__300__ for each day that expires after the time (as duly adjusted pursuant to the Contract) specified in Paragraph 3.02.A above for Substantial Completion until the Work is substantially complete. ARTICLE 5 – CONTRACT PRICE 5.01 Owner shall pay Contractor for completion of the Work in accordance with the Contract Documents the amounts that follow, subject to adjustment under the Contract: A.For all Unit Price Work, an amount equal to the sum of the extended prices (established for each separately identified item of Unit Price Work by multiplying the unit price times the actual quantity of that item) as shown in the Bid Form, a sum of: Total of all Extended Prices for Unit Price Work (subject to final adjustment based on actual quantities) $ The extended prices for Unit Price Work set forth as of the Effective Date of the Contract are based on estimated quantities. As provided in Paragraph 13.03 of the General Conditions, estimated quantities are not guaranteed, and determinations of actual quantities and classifications are to be made by Engineer. ARTICLE 6 – PAYMENT PROCEDURES 6.01 Submittal and Processing of Payments A.Contractor shall submit Applications for Payment in accordance with Article 15 of the General Conditions. Applications for Payment will be processed by Engineer as provided in the General Conditions. 6.02 Progress Payments; Retainage A.Owner shall make progress payments on account of the Contract Price on the basis of Contractor’s Applications for Payment on or about the 15th day of each month during performance of the Work as provided in Paragraph 6.02.A.1 below, provided that such Applications for Payment have been submitted in a timely manner and otherwise meet the requirements of the Contract. All such payments will be measured by the Schedule of Values established as provided in the General Conditions (and in the case of Unit Price Work based on the number of units completed) or, in the event there is no Schedule of Values, as provided elsewhere in the Contract. 1.Prior to Substantial Completion, progress payments will be made in an amount equal to the percentage indicated below but, in each case, less the aggregate of payments previously made and less such amounts as Owner may withhold, including but not limited to liquidated damages, in accordance with the Contract a.95 percent of Work completed (with the balance being retainage).; and EJCDC® C-520, Agreement Between Owner and Contractor for Construction Contract (Stipulated Price). Page 3 of 7 b.100 percent of cost of materials and equipment not incorporated in the Work (with the balance being retainage). c.Retainage shall be 5% of the earned progress payments per Arkansas Code 22-9- 604. B.Upon Substantial Completion, Owner shall pay an amount sufficient to increase total payments to Contractor to 95 percent of the Work completed, less such amounts set off by Owner pursuant to Paragraph 15.01.E of the General Conditions, and less 100 percent of Engineer’s estimate of the value of Work to be completed or corrected as shown on the punch list of items to be completed or corrected prior to final payment. 6.03 Final Payment A.Upon final completion and acceptance of the Work in accordance with Paragraph 15.06 of the General Conditions, Owner shall pay the remainder of the Contract Price as recommended by Engineer as provided in said Paragraph 15.06. ARTICLE 7 – INTEREST 7.01 All amounts not paid when due shall bear interest at the rate of 0 percent per annum. ARTICLE 8 – CONTRACTOR’S REPRESENTATIONS 8.01 In order to induce Owner to enter into this Contract, Contractor makes the following representations: A.Contractor has examined and carefully studied the Contract Documents, and any data and reference items identified in the Contract Documents. B.Contractor has visited the Site, conducted a thorough, alert visual examination of the Site and adjacent areas, and become familiar with and is satisfied as to the general, local, and Site conditions that may affect cost, progress, and performance of the Work. C.Contractor is familiar with and is satisfied as to all Laws and Regulations that may affect cost, progress, and performance of the Work. D.Contractor has considered the information known to Contractor itself; information commonly known to contractors doing business in the locality of the Site; information and observations obtained from visits to the Site; the Contract Documents; and the Site-related reports and drawings identified in the Contract Documents, with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Contractor; and (3) Contractor’s safety precautions and programs. E.Based on the information and observations referred to in the preceding paragraph, Contractor agrees that no further examinations, investigations, explorations, tests, studies, or data are necessary for the performance of the Work at the Contract Price, within the Contract Times, and in accordance with the other terms and conditions of the Contract. F.Contractor is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work as indicated in the Contract Documents. G.Contractor has given the Purchasing Division written notice of all conflicts, errors, ambiguities, or discrepancies that Contractor has discovered in the Contract Documents, and the written resolution thereof by the Purchasing Division is acceptable to Contractor. Page 4 of 7 H.The Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work. I.Contractor’s entry into this Contract constitutes an incontrovertible representation by Contractor that without exception all prices in the Agreement are premised upon performing and furnishing the Work required by the Contract Documents. ARTICLE 9 – CONTRACT DOCUMENTS 9.01 Contents A.The Contract Documents consist of the following: 1.This Agreement (Current Section, inclusive). 2.Performance bond (Section: Performance Bond, inclusive). 3.Payment bond (Section: Payment Bond, inclusive). 4.Other bonds. a.Maintenance and Warranty Bond (to be provided following Substantial Completion) (If required). 5.General Conditions (Section: General Conditions, inclusive). 6.Specifications as listed in the table of contents of the Project Manual. 7.Drawings (not attached but incorporated by reference) consisting of 10 sheets with each sheet bearing the following general title: Restoration of Niokaska Creek near Magnolia Drive 8.Addenda (numbers ___ to ___, inclusive). 9.Exhibits to this Agreement (enumerated as follows): a.Contractor’s Bid (pages ___ to ___, inclusive). 10.The following which may be delivered or issued on or after the Effective Date of the Contract and are not attached hereto: a.Notice to Proceed. b.Work Change Directives. c.Change Orders. d.Field Orders. B.The documents listed in Paragraph 9.01.A are attached to this Agreement (except as expressly noted otherwise above). C.There are no Contract Documents other than those listed above in this Article 9. D.The Contract Documents may only be amended, modified, or supplemented as provided in the General Conditions. Page 5 of 7 ARTICLE 10 – MISCELLANEOUS 10.01 Terms A.Terms used in this Agreement will have the meanings stated in the General Conditions and the Supplementary Conditions. 10.02 Assignment of Contract A.Unless expressly agreed to elsewhere in the Contract, no assignment by a party hereto of any rights under or interests in the Contract will be binding on another party hereto without the written consent of the party sought to be bound; and, specifically but without limitation, money that may become due and money that is due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. 10.03 Successors and Assigns A.Owner and Contractor each binds itself, its successors, assigns, and legal representatives to the other party hereto, its successors, assigns, and legal representatives in respect to all covenants, agreements, and obligations contained in the Contract Documents. 10.04 Severability A.Any provision or part of the Contract Documents held to be void or unenforceable under any Law or Regulation shall be deemed stricken, and all remaining provisions shall continue to be valid and binding upon Owner and Contractor, who agree that the Contract Documents shall be reformed to replace such stricken provision or part thereof with a valid and enforceable provision that comes as close as possible to expressing the intention of the stricken provision. 10.05 Contractor’s Certifications A.Contractor certifies that it has not engaged in corrupt, fraudulent, collusive, or coercive practices in competing for or in executing the Contract. For the purposes of this Paragraph 10.05: 1.“corrupt practice” means the offering, giving, receiving, or soliciting of any thing of value likely to influence the action of a public official in the bidding process or in the Contract execution; 2.“fraudulent practice” means an intentional misrepresentation of facts made (a) to influence the bidding process or the execution of the Contract to the detriment of Owner, (b) to establish Bid or Contract prices at artificial non-competitive levels, or (c) to deprive Owner of the benefits of free and open competition; 3.“collusive practice” means a scheme or arrangement between two or more Bidders, with or without the knowledge of Owner, a purpose of which is to establish Bid prices at artificial, non-competitive levels; and 4.“coercive practice” means harming or threatening to harm, directly or indirectly, persons or their property to influence their participation in the bidding process or affect the execution of the Contract. Page 6 of 7 10.06 Other Provisions A.The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.” B.This contract is subject to applicable labor laws, non-discrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Acts of 1938. The Work Hours Act of 1962, Title VI of the Civil Rights Act of 1964, and The Clean Water Act also apply. C.Build America, Buy America provisions apply to this project. D.This project is a Federal-Aid contract. This project requires wage rates to be paid according to Davis-Bacon Federal Wage Rates. The percentage goal for Disadvantaged Business Enterprise (DBE) Participation in the project is 11.0%. Relevant Experience (Large Scale): Project Name: Huntsville Dam Removal and Restoration War Eagle Creek Client: Arkansas Game and Fish Commission Location: War Eagle Creek, Huntsville, AR Completion Date: June 2025 Project Description: Completed a 4,200 linear foot stream restoration project through what was previously Lake Huntsville on the War Eagle Creek in Huntsville, AR. In addition to the main channel, 3,200 linear feet of the overflow channel were restored into wetlands. This project involved the removal of a failed water control structure, building a stable stream channel through the old lakebed, and building wetlands with the use of analog beaver dams in the overflow channel. Longitudinal rock toe protection was used to stabilize newly constructed meander bends and constructed rock riffles were installed as channel grade control. Natural Channel Design principles were used to design the pattern and profile of the newly constructed channel. The project had roughly 60,000 cu yards of earthwork required to re-shape the new channel and build a wetland complex through the old overflow channel. 5.5 acres of wetland were constructed in addition to the stream restoration. This project is a great analog of the Little Sugar Creek project. Prior to restoration the site was a lake and was not providing very little benefit to aquatic life or the community. Once the dam was removed the old lakebed had no defined channel and was heavily braided and unstable just like Little Sugar is upstream of the failed dam. The project took nearly a year to complete and was one of the largest stream restoration projects ever to be done in the state of Arkansas. Project Name: Blossom Way Stream and Floodplain Restoration Client: City of Rogers Location: Rogers, AR Completion Date: June 2023 Project Description: This City of Rogers initiated this project because of an emergency effort to stabilize the creek and protect the greenway from washing away. The project developed into restoring approximately 825 L.F. of stream channel and reconnecting nearly ½ a mile of creek to its floodplain. The team used natural channel design methodology to create an appropriately sized channel with a dense riparian buffer and instream structures that deflect erosive forces from the banks and prevent downcutting. NCD structures utilized included stacked-rock vanes/j-hooks, cross veins, and constructed riffles. The floodplain restoration was achieved by lowering the adjacent streambanks by 6+ feet to reduce flooding and relieve channel incision. Reduction in bank height greatly reduced the base flood elevation for the surrounding neighborhoods. Installation of rock toe protection/rock revetments, cross veins, and constructed riffles. Around 39,000 Cu Yards of Earthwork were moved for the channel and floodplain restoration. Project Name: West Fork of the White River (Dye Creek Project) Client: Watershed Conservation Resource Center Location: Greenland, AR Completion Date: June 2023 2023 - West Fork of the White River (Dye Creek Project) Project Description Restored over a mile of the West Fork of the White River (WFWR) which was the #1 highest sediment producing streambank on the WFWR. The restoration included re-establishing channel stability by defining a stable stream channel through an over-widened and highly unstable reach. In addition to excavating a new channel, toe-wood structures were used along the meander bends to protect the newly constructed banks and increase habitat. Various types of rock structures including J-hooks, cross veins and grade control structures were used to help hold the channel form and create more diverse in stream habitat. This project was constructed by 2 different stream restoration firms, Streamline Environmental and Flow State LLC. Flow State LLC constructed approximately half of the project including 1500 linear feet of toewood, 1000 feet of stacked rock wall, as well as several constructed riffles, j- hooks, and cross veins as well as excavating 35,000 cu yards of material. Project Name: Mckisic Creek Greenway Stream Restoration Project Client: Watershed Conservation Resource Center Location: Bentonville, AR Completion Date: June 2025 Project Description: This project restored a 550-ft section of McKisic Creek just upstream of McNelly Rd. This goal of the project was to reduce erosion and improve stream habitat as well as providing improved access and recreation for the community. A variety of Natural Channel Design stream restoration techniques were utilized to build this project and return the channel to a stable form. Riffle rock grade control structures were installed to maintain channel elevation and provide continuity upstream and downstream of the project. Eroded streambanks were stabilized by building a combination of stacked rock revetment, toewood, and brush mattresses. These features provide lateral surface protection for the streambanks while also providing a variety of aquatic habitat. The in-stream structures create large scour pools which provide an ideal place for the community to gather and swim. The work involved stacked rock revetment, boulder grade control, and channel shaping and grading as well as creating public access points with stacked native stone steps. Construction Cost (excluding materials): $346,835 Design and Permitting: Watershed Conservation Resource Center (WCRC) Project Name: White River Magnus Streambank Stabilization and Enhanced Access Client: Arkansas Game and Fish Commission Location: Fayetteville, AR Completion Date: May 2025 Project Description: The focus of this project was to improve river access and bank fishing at the Magnus access east of Fayetteville, AR while also addressing a highly unstable eroding streambank. The existing streambank was a 20-foot vertical wall approximately 200 feet in length that was highly unstable and provided no access to the river. The focus was to stabilize the streambank as well as improving bank access for recreation. To accomplish this, a combination of wood and rock structures were installed to stabilize the eroding bank, provide improved access to the water, and greatly enhanced habitat for sport fishing. Construction Cost: $203,000 Design and Permitting: Flow State LLC Project Name: Kings River Streambank Stabilization Client: Confidential Location: Kingston, AR Completion Date: November 2024 Project Description: This project was on private property along the Kings River near Kingston Arkansas. The landowner was losing several feet of property every year due to streambank erosion and the problem was getting worse every year. The streambanks were vertical and nearly 15 feet in height. The project involved a re-alignment of the stream channel and stabilization using Natural Channel Design methodology. A combination of toe-wood and constructed rock riffles were used to define the new channel alignment. Native Vegetation was harvested on site and transplanted into the newly constructed banks along with supplemental planting of bare root seedlings. The newly constructed channe,l moved the main flow nearly 300 feet away from the previously eroding streambank and created a large floodplain bench to allow the water to spread out and reduce channel sheer stress at high flows. Construction Cost: $284,280 Design and Permitting: Green Watershed Restoration and Flow State LLC Project Name: Sycamore Creek Client: Watershed Conservation Resource Center Location: Wyandotte, OK Completion Date: July 2024 Project Description: The Wyandotte Nation had concerns regarding streambank erosion on a portion of Sycamore Creek near the powwow grounds of the Wyandotte. The eroding land has special meaning to the Wyandotte people and threatened a nearby permanent water quality monitoring station. The construction involved streambank stabilization with the installation of toewood, j-hook and grade control structures and rock revetments. Construction Cost (excluding materials): $59,900 Design and Permitting: Watershed Conservation Resource Center Project Name: Town Branch Client: Watershed Conservation Resource Center Location: Bentonville, AR Completion Date: February 2024 This project involved a historic low-water crossing on Town Branch near the Slaughter Pen Mountain bike trails that created significant erosion and lateral movement of the stream course over time. The channel was beginning to encroach on adjacent utilizes and posed a significant safety risk. The goal of the project was to remove the failed slab crossing and return the stream channel to its historic course, moving it away from the adjacent infrastructure. The project involved re-defining and stabilizing the channel with the use of toe-wood structures, cross veins, and grade control structures. Construction Cost (excluding materials): $92,600 Design and Permitting: Watershed Conservation Resource Center Project Name: Brush Creek Client: Watershed Conservation Resource Center Location: Goshen, AR Completion Date: February 2023 Completed an approximately 400ft streambank stabilization project along a highly unstable section of Brush Creek near Goshen, AR. The landowner was losing several feet of land every year due to streambank erosion. The project involved moving the channel away from the eroding streambank and installing toe-wood and a floodplain bench. Several rock grade control structures were installed to provide grade control and prevent channel downcutting. Natural Channel Design techniques were used to develop the proper channel pattern and dimensions along with creating floodplains to reduce sheer stress during high flow events. Construction Cost (materials not included): $79,525 Design and Permitting: Watershed Conservation Resource Center Project Name: Sager Creek Phase II Client: Illinois River Watershed Partnership and City of Siloam Springs Location: Goshen, AR Completion Date: December 2023 Completed Phase II of the Sager Creek project with the Illinois River Watershed Partnership and the City of Siloam Springs. This phase restored a 150 foot reach of Sager Creek that was actively eroding with little bank protection. The project was book-ended both upstream and downstream by a healthy channel with mature riparian vegetation. The project included the installation of approximately 100 feet of toewood as well as the installation of log vein for grade control and aquatic habitat. Native sodmats and native plantings were installed along the newly graded streambank along with coir erosion control matting to prevent erosion and provide long- term stability. Construction Cost: $98,224 Design and Permitting: Flow State LLC Project Name: Fayetteville Ramble – Tanglewood Creek Restoration Client: City of Fayetteville Location: Fayetteville, AR Completion Date: June 2022 This project was a special integration of Natural Channel Design principles that melded into a park/landscape design project at the lower ramble in Fayetteville, AR. Prior to construction, the site was plagued with incised stream channels and riparian zones choked with invasive species. The restoration involved reviving the old stream channels by raising bed elevations with the use of step pool rock structures and using large-stacked beam rock for bank protection. The project not only addressed the erosion problems but increased the aesthetics of the stream corridors significantly. What was once a ditch was transformed into a beautiful series of rock waterfall features. The native revegetation done by WCRC created a stable and beautiful riparian zone that is full of native pollinators and flowering plants throughout the year. Construction Cost: $444,310 Design and Permitting: Watershed Conservation Resource Center (WCRC) Project Name: Brentwood West Fork White River Stream Stabilization Client: Watershed Conservation Resource Center Location: Brentwood, AR Completion Date: March 2022 This project addressed approximately 1500 feet of instability along the West Fork of the White River near Brentwood, AR. Natural Channel Design principles were used to develop a new channel alignment with the appropriate dimensions, slopes and patterns. Toewood structures were used to stabilize meander bends. A combination of brush mattresses and rock revetments were used along the newly constructed banks. Approximately 11 rock grade control structures were installed to prevent channel downcutting and ensure long-term stability. Oxbow Wetlands were created to generate fill material and create additional wetland habitat. Construction Cost (materials not included): $263,375 Design and Permitting: The Watershed Conservation Resource Center (WCRC) Project Name: Sager Creek Phase I Client: Illinois River Watershed Partnership (IRWP) and City of Siloam Springs Location: Siloam Springs, AR Completion Date: November 2022 This project was a partnership between Flow State, IRWP and the City of Siloam Springs to address erosion and stormwater issues along Sager Creek in downtown Siloam Springs. The first phase included a stream bank stabilization project near the square on Sager Creek along with a constructed bioswale, boardwalk and observation deck in Bob Henry park. The stream portion involved removing and replacing a failed rock revetment that was actively eroding and threatening the adjacent greenway. A new channel alignment was defined and more suitable rock was chosen and installed along the creek. BioBlocks were installed along the edge of the rock revetment and the newly graded bank were densely planted with native pollinator plants to prevent erosion, increase aesthetics and provide pollinator habitat along the creek. A drainage ditch that ran along the east side of Bob Henry park was frequently being overwhelmed and the cause of flooding. The ditch was removed and a large bioswale/pond was installed with a water control structure at the outlet. The bioswale was densely planted with a suite of native plants including native grasses, forbs, trees and shrubs. The greenway was routed through the bioswale with an elevated boardwalk and a deck/viewing platform was installed along the edge of the creek. Construction Cost: $159,949 Design and Permitting: Flow State LLC Project Name: Clinton River Client: Rochester University Location: Rochester University Rochester Hills, Michigan Completion Date: November 2021 This project was an emergency restoration to prevent a dormitory from being washed into the Clinton River. The river had eroded into a 30+ foot tall sand bank which was only 20 feet from the back of a dormitory building on campus. The goal was to move the stream channel across the valley to its previous path and away from the at-risk infrastructure. The realignment included approximately 438 ft of stream channel. Natural Channel Designation techniques such as toewood and brush mattresses as well as rock and log grade control structures were utilized. The project was a success and has stabilized the site and protected the infrastructure as well as improved safety for the university. Design and Permitting: Green Watershed Restoration LL Construction Cost: $189,750 Project Name: Rock Creek Client: Watershed Conservation Resource Center Location: West Fork, AR Completion Date: July 2021 The Rock Creek Streambank Restoration Site is located at the outlet where Rock Creek drains into the West Fork White River. The project utilized a toe-wood structure in combination with native vegetation establishment to create a stable bank profile with appropriate floodplain features to promote long-term stability of the site. Project Name: Paint Rock River Client: The Nature Conservancy Location: North Alabama Completion Date: June 2021 This Paint Rock River is a high value ecological resource due to the unique habitats and species found there. Streambank erosion is the number one cause of habitat degradation on the Paint Rock. During assessment work, the Nature Conservancy identified several highly unstable sections of stream to focus restoration efforts. This project was identified and addressed one of the higher contributing stream banks. The restoration involved stabilizing approximately 300 ft of streambank with the use of longitudinal peaked toe stone with integrated root wads, bank grading and the installation of native sod mats. The project was highly successful and has prevented thousands of tons of sediment from entering the Paint Rock River. RESOLUTION NO. ______ PLACEHOLDER: RESOLUTION TO AWARD BID #25-52 AND AUTHORIZE A CONTRACT WITH FLOW STATE LLC IN THE AMOUNT OF $114,900.20 FOR THE RESTORATION OF SCULL CREEK, TO APPROVE A PROJECT CONTINGENCY IN THE AMOUNT OF $18,000.00, AND TO APPROVE A BUDGET ADJUSTMENT WHEREAS, on December 15, 2020, the City Council approved Resolution 308-20 authorizing the acceptance of a Wetland Program Development Grant in the amount of $300,000.00; and WHEREAS, the City matched the grant with $100,000.00 from the 2019 Bond Program and the Illinois River Watershed Partnership provided $30,000.00 for a total project budget of $430,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby awards Bid #25-52 and authorizes a contract with Flow State LLC in the amount of $114,900.20 for the restoration of Scull Creek, and further approves a project contingency in the amount of $18,000.00.
