A RESOLUTION TO AWARD RFQ #25-07, AND AUTHORIZE A PROFESSIONAL ARCHITECTURAL

WHEREAS, on May 21, 2024, the City Council passed Resolution 139-24 to develop an aquatic center feasibility
study that has been completed and made public; and
WHEREAS, this is Phase 1 of a multi-year phased contract that will include programming, site evaluation and
conceptual design; and
WHEREAS, Phase 2 is contingent on a successful bond initiative and will include schematic design, design
development, construction documents, bidding and negotiation, and construction administration;
WHEREAS, the benefit of starting now is to have conceptual plans that can be presented to the citizens prior to voting,
therefore if the bond passes, this will expedite the project, allowing the schematic design to begin once the project is
approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby awards RFQ #25-07, and authorizes
Mayor Rawn to sign a professional architectural contract with Crafton Tull & Associates, Inc. in the total amount of
232,524.00 for design of an aquatic facility.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of
which is attached to this Resolution.

SUBJECT: RFQ 25-07 Architectural Contract for Aquatic Facility with Crafton Tull & Associates
RECOMMENDATION:
Approval of RFQ 25-07 Architectural Contract with Crafton Tull and Associates, Inc. for design of an Aquatic
Facility and related street improvements. This is a phased contract with Phase 1 in the amount of $221,024
plus reimbursable $11,500 for a total of $232,524. Approval of a budget adjustment is requested.
BACKGROUND:
May 2024: City Council approved resolution 139-24 for an Aquatic Center Feasibility study. That study has
been completed and made public.
DISCUSSION:
This is a multi-year phased contract with Phase 1 to include programming, site evaluation and conceptual
design of the facility and street improvements. Phase 2 services will include Schematic Design, Design
Development, Construction Documents, Bidding and Negotiation, and Construction Administration. Phase 2 is
contingent on a successful bond initiative. The benefit of starting now is to have conceptual plans that can be
presented to the citizens prior to voting. We are also engaging a Construction Manager to assist with cost
projections to ensure we stay within the projected budget. If the bond passes, this will expedite the project,
allowing us to get started on schematic design once the project is approved.
BUDGET/STAFF IMPACT:
A budget adjustment to appropriate Parks Development funds in the amount of $232,524.00

THIS AGREEMENT Contract)is executed this day of 2025,by and between the
City of Fayetteville,Arkansas hereinafter called CITY OF FAYETTEVILLE or CITY)and Crafton Tull Associates,Inc.
hereinafter called Engineer/Architect or Crafton Tull).
CITY OF FAYETTEVILLE from time to time requires professional Engineering and/or Architectural services in connection
with the evaluation,design,construction drawings,bidding,and/or construction observation of capital improvement
projects.Therefore,CITY and Crafton Tull in consideration of their mutual covenants agree as follows:
Crafton Tull shall serve as the professional engineer/architect consultant to the CITY in those assignments to which this
Agreement applies and shall give consultation and advice to CITY OF FAYETTEVILLE during the performance of services
defined in the scope of work.All services shall be performed under the direction of a licensed engineer/architect
registered in the State of Arkansas and qualified in the particular field.
1.Contracted parties:This agreement shall be binding between all parties.Fees for services shall be provided as
identified in appendices.
2.Entire Agreement and Exhibits:This Agreement sets forth the entire agreement and understanding between the
parties on the subject matter of this Agreement.Parties shall not be bound by any conditions,definitions,
representations or warranties with respect to the subject matter of this Agreement other than those as expressly
provided herein.This agreement may be modified only by a duly executed written instrument signed by the CITY
and Crafton Tull.
a.Appendices included under this agreement include the following and shall govern in the following order.
Contract language in this document shall prevail over all exhibits:
i.Appendix A:Scope of Work Fees
ii.Appendix B:City’s solicitation identified as RFQ 25 07,Aquatic Facility Design
iii.Appendix C:Crafton Tull’s Response to RFQ 25 07
iv.Appendix D:Crafton Tull’s Certificates of Insurance
3.Notices:Any notice required under this Agreement shall be in writing,address to the appropriate party at the
following addresses:

4.Fees,Expenses,and Payments:
a.The Fixed Fee amount for Phase 1 of this contract shall be:
i.Base and Supplemental services through Conceptual Design:221,024.00
ii.Phase 1 Reimbursables:11,500.00
b.The Estimated Fee amount for Phase 2 of this contract and shall be adjusted after Design Develoment.

c.Crafton Tull shall track,log,and report hours and expenses directly related to this Agreement.Invoices
shall be itemized by phase.Invoice and payment requests shall not exceed the percentage of work
completed as defined by Appendix A.
d.Payment Terms:All invoices are payable upon approval and due within thirty 30)calendar days.If a
portion of an invoice or statement is disputed by CITY,the undisputed portion shall be paid.CITY OF
FAYETTEVILLE shall advise Crafton Tull in writing the basis for any disputed portion of any invoice.CITY
shall make reasonable effort to pay invoices within 30 calendar days of date the invoice is approved.
e.Monthly invoices for each calendar month shall be submitted to CITY OF FAYETTEVILLE or such parties as
CITY may designate for professional services consistent with Crafton Tull’s normal billing schedule.Once
established,the billing schedule shall be maintained throughout the duration of the Project.Invoices
shall be made in accordance with a format to be developed by Crafton Tull and approved by CITY OF
FAYETTEVILLE.Applications for payment shall be accompanied each month by the updated project
schedule as the basis for determining the value earned as the work is accomplished.Final payment for
professional services shall be made upon CITY’s approval and acceptance with the satisfactory completion
of professional services for the Project.
f.Final Payment:Upon satisfactory completion of the work performed under this Agreement,as a condition
before final payment under this Agreement,or as a termination settlement under this Agreement,
Crafton Tull shall execute and deliver to CITY OF FAYETTEVILLE a release of all claims against CITY OF
FAYETTEVILLE arising under or by virtue of this Agreement,except claims which are specifically exempted
by Crafton Tull to be set forth therein.
i.Unless otherwise provided in this Agreement or by State law or otherwise expressly agreed to by
the parties to this Agreement,final payment under this Agreement or settlement upon
termination of this Agreement shall not constitute a waiver of CITY OF FAYETTEVILLE claims
against Crafton Tull or sureties under this Agreement.
5.Jurisdiction:Legal jurisdiction to resolve any disputes shall be Arkansas with Arkansas law applying to the case.
6.Venue:Venue for all legal disputes shall be Washington County,Arkansas.
7.Changes in Scope or Price:Changes,modifications,or amendments in scope,price or fees to this contract shall
not be allowed without a prior formal contract amendment approved by the Mayor and the City Council in
advance of the change in scope,cost or fees.
8.Omissions by the Engineer/Architect:If Crafton Tull fails to include or omits an item from the Contract
Documents,which was fully anticipated to be included in the Project,thereby necessitating the need for a Change
Order,Crafton Tull will not receive a fee for work associated with the Change Order.
9.Insurance:Crafton Tull shall provide certificates of insurance addressed to the CITY OF FAYETTEVILLE,showing
coverage for the following insurance which shall be maintained throughout the term of this agreement.Any work
sublet to major subconsultants including MEP,Structural,and Civil,Crafton Tull shall require the subconsultant to
provide the insurance identified.In case any employee engaged in work on the project under this contract is not
protected under Worker's Compensation Insurance,Crafton Tull shall provide and shall cause each Subcontractor
to provide adequate insurance for the protection of such of his employees as are not otherwise protected.
a.Crafton Tull Associates,Inc.shall provide to the CITY certificates as evidence of the specified insurance
presented in Appendix D within ten 10)calendar days of the date of this agreement and upon each
renewal coverage.
i.Certificates of Insurance shall list the CITY OF FAYETTEVILLE as an additional insured,except for
Workers’Compensation and Professional Liability Insurance.Listing the CITY has a Certificate

Holder only is NOT an acceptable substitute.Certificates of Insurance must include the
endorsement(s)showing the CITY OF FAYETTEVILLE listed as an additional insured.
b.Subconsultants shall maintain reasonable insurance including but not limited to worker’s compensation,
auto as applicable,general liability,errors and omissions,etc.
10.Professional Responsibility:Crafton Tull will exercise reasonable skill,care,and diligence in the performance of
services and will carry out its responsibilities in accordance with customarily accepted professional practices used
by members of the subject profession practicing under similar circumstances at the same time and in the same
locality.CITY OF FAYETTEVILLE will promptly report to Crafton Tull any defects or suspected defects in services of
which CITY OF FAYETTEVILLE becomes aware,so Crafton Tull can take measures to minimize the consequences of
such a defect.CITY OF FAYETTEVILLE retains all remedies to recover for its damage caused by any negligence of
Crafton Tull.
11.Responsibility of the City of Fayetteville:CITY OF FAYETTEVILLE shall,within a reasonable time,so as not to
delay the services of Crafton Tull:
a.Provide full information as to the requirements for the Project.
b.Assist Crafton Tull by making available all available information pertinent to the assignment including
previous reports and any other data relative thereto.
c.Assist Crafton Tull in obtaining access to property reasonably necessary to perform the services under this
Agreement.
d.Examine all studies,reports,sketches,cost opinions,proposals,and other documents presented by
Crafton Tull and render in writing decisions pertaining thereto.
e.Review all documents and provide written comments to Crafton Tull in a timely manner.
f.The City of Fayetteville’s Bond Projects and Construction Manager is the project representative with
respect to the services to be performed under this Agreement.The Bond Projects and Construction
Manager shall have complete authority to transmit instructions,receive information,interpret and define
policies and decisions with respect to materials,equipment,elements and systems to be used in the
Project,and other matters pertinent to the services covered by this Agreement.
12.Cost Opinions and Projections:Cost opinions and projections prepared by the Crafton Tull relating to construction
costs and schedules,operation and maintenance costs,equipment characteristics and performance,cost
estimating,and operating results are based on Crafton Tull’s experience,qualifications,and judgment as a design
professional.Since Crafton Tull has no control over weather,cost and availability of labor,material and
equipment,labor productivity,construction Contractors’procedures and methods,unavoidable delays,
construction Contractors’methods of determining prices,economic conditions,competitive bidding or market
conditions,and other factors affecting such cost opinions or projections,Crafton Tull does not guarantee that
actual rates,costs,performance,schedules,and related items will not vary from cost opinions and projections
prepared by Crafton Tull.
13.Period of Service:This Agreement will become effective upon the first written notice by CITY OF FAYETTEVILLE
authorizing services hereunder.
a.The provisions of this Agreement have been agreed to in anticipation of the orderly progress of the
Project through completion of the services stated in the Agreement.Crafton Tull will proceed with
providing the authorized services immediately upon receipt of written authorization from CITY OF
FAYETTEVILLE.Said authorization shall include the scope of the work authorized and the time in which
the work is to be completed.

14.Termination:
a.This Agreement may be terminated in whole or in part in writing by either party in the event of
substantial failure by the other party to fulfill its obligations under this Agreement through no fault of the
terminating party,provided that no termination may be affected unless the other party is given:
i.Not less than ten 10)calendar days written notice delivered by certified mail,return receipt
requested)of intent to terminate,
ii.An opportunity for consultation with the terminating party prior to termination.
b. This Agreement may be terminated in whole or in part in writing by CITY OF FAYETTEVILLE for its
convenience,provided that Crafton Tull is given:
i.Not less than ten 10)calendar days written notice delivered by certified mail,return receipt
requested)of intent to terminate,
ii.An opportunity for consultation with the terminating party prior to termination.
c.If termination for default is affected by CITY OF FAYETTEVILLE,an equitable adjustment in the price
provided for in this Agreement shall be made,but
i.No amount shall be allowed for anticipated profit on unperformed services or other work,
ii.Any payment due to Crafton Tull at the time of termination may be adjusted to cover any
additional costs to CITY OF FAYETTEVILLE because of Crafton Tull’s default whether completed or
in process and for which payment from the CITY OF FAYETTEVILLE has been received by Crafton
Tull.
d.If termination for default is affected by Crafton Tull,or if termination for convenience is affected by CITY
OF FAYETTEVILLE,the equitable adjustment shall include a reasonable profit for services or other work
performed.The equitable adjustment for any termination shall provide for payment to Crafton Tull for
services rendered and expenses incurred prior to the termination,in addition to termination settlement
costs reasonably incurred by Crafton Tull relating to commitments which had become firm prior to the
termination.
e.Upon receipt of a termination action,Crafton Tull shall:
i.Promptly discontinue all affected work unless the notice directs otherwise),
ii.Deliver or otherwise make available to CITY OF FAYETTEVILLE all data,drawings,specifications,
reports,estimates,summaries and such other information and materials as may have been
accumulated by Crafton Tull in performing this Agreement,whether completed or in process.
f.Upon termination under sections above CITY OF FAYETTEVILLE may take over the work and may award
another party an agreement to complete the work under this Agreement.
g.If,after termination for failure of Crafton Tull to fulfill contractual obligations,it is determined that
Crafton Tull had not failed to fulfill contractual obligations,the termination shall be deemed to have been
for the convenience of CITY OF FAYETTEVILLE.In such event,adjustments of the agreement price shall be
made as provided in this agreement.
15.Delays
a.In the event the services of Crafton Tull are suspended or delayed by CITY OF FAYETTEVILLE or by other
events beyond reasonable control,Crafton Tull shall be entitled to additional compensation and time for
reasonable documented costs actually incurred by Crafton Tull in temporarily closing down or delaying
the Project.

b.In the event the services are suspended or delayed by Crafton Tull,CITY shall be entitled to compensation
for its reasonable costs incurred in temporarily closing down or delaying the project.The CITY does not
agree to waive its right to claim in addition to direct damages)special,indirect,or consequential
damages,whether such liability arises in breach of contract or warranty,tort including negligence),strict
or statutory liability,or any other cause of action.
16.Rights and Benefits:Crafton Tull’s services shall be performed solely for the benefit of CITY OF FAYETTEVILLE and
not for the benefit of any other persons or entities.
17.Dispute Resolution
a.Scope of Paragraph:The procedures of this Paragraph shall apply to any and all disputes between CITY
OF FAYETTEVILLE and Crafton Tull which arise from,or in any way are related to,this Agreement,
including,but not limited to the interpretation of this Agreement,the enforcement of its terms,any acts,
errors,or omissions of CITY OF FAYETTEVILLE or Crafton Tull in the performance of this Agreement,and
disputes concerning payment.
b.Exhaustion of Remedies Required:No action may be filed unless the parties first negotiate.If timely
Notice is given as described in this agreement,but an action is initiated prior to exhaustion of these
procedures,such action shall be stayed,upon application by either party to a court of proper jurisdiction,
until the procedures in this agreement have been complied with.
c.Notice of Dispute
i.For disputes arising prior to the making of final payment promptly after the occurrence of any
incident,action,or failure to act upon which a claim is based,the party seeking relief shall serve
the other party with a written Notice.
ii.For disputes arising within one year after the making of final payment,CITY OF FAYETTEVILLE
shall give Crafton Tull written Notice at the address listed in this agreement within thirty 30)
calendar days after occurrence of any incident,accident,or first observance of defect or damage.
In both instances,the Notice shall specify the nature and amount of relief sought,the reason
relief should be granted,and the appropriate portions of this Agreement that authorize the relief
requested.
iii.Negotiation:Within seven 7)calendar days of receipt of the Notice,the Project Managers for
CITY OF FAYETTEVILLE and Crafton Tull shall confer in an effort to resolve the dispute.If the
dispute cannot be resolved at that level,then,upon written request of either side,the matter
shall be referred to the President of Crafton Tull and the Mayor of CITY OF FAYETTEVILLE or his
designee.These officers shall meet at the Project Site,or such other location as is agreed upon
within 30 calendar days of the written request to resolve the dispute.
18.Sufficient Funds:The CITY represents it has sufficient funds or the means of obtaining funds to remit payment to
Crafton Tull for services rendered by Crafton Tull.
19.Publications:Recognizing the importance of professional development on the part of Crafton Tull’s employees
and the importance of Crafton Tull’s public relations,Crafton Tull’s may prepare publications,such as technical
papers,articles for periodicals,promotional materials,and press releases,in electronic or other format,
pertaining Crafton Tull’s services for the Project.Such publications will be provided to CITY OF FAYETTEVILLE in
draft form for CITY OF FAYETTEVILLE’s advance review.CITY OF FAYETTEVILLE shall review such drafts promptly
and provide CITY OF FAYETTEVILLE’s comments to Crafton Tull,CITY OF FAYETTEVILLE may require deletion of
proprietary data or confidential information from such publications,but otherwise CITY OF FAYETTEVILLE will not
unreasonably withhold approval.Approved materials may be used in a variety of situations and do not require

additional review or approval for each use.The cost of Crafton Tull’s activities pertaining to any such publication
shall be for Crafton Tull’s account.
20.Indemnification:Crafton Tull shall indemnify and hold harmless the CITY and its employees from and against all
liabilities,claims,actions,damages,losses and expenses,including without limitation reasonable attorneys’fees
and costs to the extent caused by the negligent act,error,or omission of Crafton Tull,any person employed by
Crafton Tull,or anyone for whose acts Crafton Tull is legally liable in the performance of professional services for
the City pursuant to this Contract.
21.Freedom of Information Act:CITY OF FAYETTEVILLE contracts and documents prepared while performing CITY
contractual work are subject to the Arkansas Freedom of Information Act FOIA).If a Freedom of Information Act
request is presented to the CITY OF FAYETTEVILLE,the engineer/architect will do everything possible to provide
the documents in a prompt and timely manner as prescribed in the Arkansas Freedom of Information Act A.C.A.
25 19 101 et.Seq.).Only legally authorized photo coping costs pursuant to the FOIA may be assessed for this
compliance.
22.Debarment Certification:Crafton Tull hereby provides debarment/suspension certification indicating compliance
with the below Federal Executive Order.Federal Executive Order E.O.)12549 Debarment and Suspension”
requires that all contractors receiving individual awards,using federal funds,and all sub recipients certify that the
organization and its principals are not debarred,suspended,proposed for debarment,declared ineligible,or
voluntarily excluded by any Federal department or agency from doing business with the Federal Government.
Crafton Tull hereby attests its principal is not presently debarred,suspended,proposed for debarment,declared
ineligible,or voluntarily excluded from participation in this transaction by any federal department or agency.
23.Ownership of Documents:
a.All documents provided by CITY OF FAYETTEVILLE including original drawings,CAD drawings,estimates,
field notes,and project data are and remain the property of CITY OF FAYETTEVILLE.Crafton Tull may
retain reproduced copies of drawings and copies of other documents.
b.Engineering and architectural documents,computer models,drawings,specifications and other hard copy
or electronic media prepared by Crafton Tull as part of the Work shall become the property of CITY OF
FAYETTEVILLE when Crafton Tull has been compensated for all Services rendered,provided,however,
that Crafton Tull shall have an unrestricted perpetual license right to their use.Crafton Tull shall,
however,retain its rights in its standard drawings details,specifications,databases,computer software,
and other proprietary property.Rights to intellectual property developed,utilized,or modified in the
performance of the Services shall remain the property of Crafton Tull.
c.Any files delivered in electronic medium may not work on systems and software different than those with
which they were originally produced.Crafton Tull makes no warranty as to the compatibility of these files
with any other system or software.Because of the potential degradation of electronic medium over time,
in the event of a conflict between the sealed original drawings/hard copies and the electronic files,the
sealed drawings/hard copies will govern.
24.Additional Responsibilities of Crafton Tull Associates,Inc.:
a.Review,approval,or acceptance of design drawings,specifications,reports and other services
furnished hereunder by CITY shall not in any way relieve Crafton Tull of responsibility for the
technical adequacy of the work.Review,approval or acceptance of,or payment for any of the
services by CITY shall not be construed as a waiver of any rights under this Agreement or of any
cause of action arising out of the performance of this Agreement.

b.Crafton Tull shall be and shall remain liable,in accordance with applicable law,for all damages to
CITY OF FAYETTEVILLE caused by Crafton Tull’s negligent performance,except beyond the Crafton
Tull normal standard of care,of any of the services furnished under this Agreement,and except
for errors,omissions or other deficiencies to the extent attributable to CITY OF FAYETTEVILLE or
CITY OF FAYETTEVILLE furnished data.
c.Crafton Tull’s obligations under this clause are in addition to Crafton Tull’s other express or implied
assurances under this Agreement or State law and in no way diminish any other rights that CITY
OF FAYETTEVILLE may have against Crafton Tull for faulty materials,equipment,or work.
25.Audit and Access to Records:
a.Crafton Tull shall maintain books,records,documents and other evidence directly pertinent to
performance on work under this Agreement in accordance with generally accepted accounting
principles and practices consistently applied in effect on the date of execution of this Agreement.
b.Crafton Tull shall also maintain the financial information and data used by Crafton Tull in the
preparation of support of the cost submission required for any negotiated agreement or change
order and send to CITY OF FAYETTEVILLE a copy of the cost summary submitted.CITY OF
FAYETTEVILLE,or any of their authorized representatives,shall have access to all such books,
records,documents and other evidence for the purpose of inspection,audit and copying during
normal business hours.Crafton Tull will provide proper facilities for such access and inspection.
c.Records shall be maintained and made available during performance on assisted work under this
Agreement and until three years from the date of final payment for the project.In addition,
those records which relate to any controversy arising out of such performance,or to costs or
items to which an audit exception has been taken,shall be maintained and made available until
three years after the date of resolution of such appeal,litigation,claim or exception.
d.This right of access clause with respect to financial records)applies to:
i.Negotiated prime agreements:
ii.Negotiated change orders or agreement amendments affecting the price of any formally
advertised,competitively awarded,fixed price agreement:
iii.Agreements or purchase orders under any agreement other than a formally advertised,
competitively awarded,fixed price agreement.However,this right of access does not
apply to a prime agreement,lower tier sub agreement or purchase order awarded after
effective price competition,except:
1.With respect to record pertaining directly to sub agreement performance,
excluding any financial records of Crafton Tull;
2.If there is any indication that fraud,gross abuse or corrupt practices may be
involved;
3.If the sub agreement is terminated for default or for convenience.
26.Covenant Against Contingent Fees:
a.Crafton Tull warrants that no person or selling agency has been employed or retained to solicit or
secure this Agreement upon an agreement of understanding for a commission,percentage,
brokerage or continent fee,excepting bona fide employees or bona fide established commercial

or selling agencies maintained by Crafton Tull for the purpose of securing business.For breach or
violation of this warranty,CITY OF FAYETTEVILLE shall have the right to annul this Agreement
without liability or at its discretion,to deduct from the contract price or consideration,or
otherwise recover,the full amount of such commission,percentage,brokerage,or contingent
fee.
27.Gratuities:
a.If CITY OF FAYETTEVILLE finds after a notice and hearing that Crafton Tull or any of Crafton Tull’s
agents or representatives,offered or gave gratuities in the form of entertainment,gifts or
otherwise)to any official,employee or agent of CITY OF FAYETTEVILLE,or related third party
contractor associated with this project,in an attempt to secure an agreement or favorable
treatment in awarding,amending or making any determinations related to the performance of
this Agreement,CITY OF FAYETTEVILLE may,by written notice to Crafton Tull terminate this
Agreement.CITY OF FAYETTEVILLE may also pursue other rights and remedies that the law or
this Agreement provides.However,the existence of the facts on which CITY OF FAYETTEVILLE
bases such finding shall be in issue and may be reviewed in proceedings under the Remedies
clause of this Agreement.
b.The CITY may pursue the same remedies against Crafton Tull as it could pursue in the event of a
breach of the Agreement by Crafton Tull.As a penalty,in addition to any other damages to which
it may be entitled by law,CITY OF FAYETTEVILLE may pursue exemplary damages in an amount,
as determined by CITY,which shall be not less than three nor more than ten times the costs
Crafton Tull incurs in providing any such gratuities to any such officer or employee.
28.Clarification and Understanding of all parties:Crafton Tull shall not assign its duties under the terms of this
agreement without prior written consent of the City.Subconsultants identified in Crafton Tull’s response shall
be permitted as being referenced herein.

SERVICES AND COMPENSATION
BASIC A/E SERVICES INCLUDED IN THE CONTRACT SCOPE OF WORK
The project will be delivered in two phases. Phase I will cover work leading up to the bond election and include
efforts by the design team associated with these efforts. Upon successful passage of the bond issue, Phase II
will continue the project, encompassing Schematic Design, Design Development, Construction Documents,
Bidding and Negotiation, and Construction Administration.
The associated fees for the project will be categorized into three categories: the Base Fee for design,
Supplemental Services required to complete the project, and additional services, both included and optional.
A Fee Summary is given below.
Basic Services are Lump Sum (Phased Fee) and include services for: Civil Engineering, Mechanical/Electrical/
Plumbing Engineering, Structural Engineering, Architectural Design/Documentation, and Interior Design.
Supplemental services are Lump Sum (Phased Fee) and include Aquatic Engineering design/documentation,
as well as the supplemental services noted in the table below.
The fee for basic services is based upon the total construction costs calculated at $60,000,000 ($50M before
design contingency, escalation, post-construction contingency, and CMAR fee). The fee shall be revised at the
end of Design Development (based on the CMAR’s Total Construction Costs).

SCOPE OF WORK ASSUMPTIONS
A. This fee assumes that the selected site will be Lewis Park. Should an alternate site be chosen,
the Architect reserves the right to revise this fee structure.
B. The City will provide the Geotechnical Report. Boring locations are to be coordinated with the
design team.
C. The City will provide code-required material testing services during construction.
D. The Offsite Civil Engineering Conceptual design shall be further developed in Phase II. The scope
and fee for the associated design and documentation shall be negotiated after passage of the
bond issue. After which, an additional appendix shall be issued as an amendment to the
contract.

Design Development Phase:
Based on the approved Schematic Design Documents and any adjustments authorized by the City in the
program, schedule, or construction budget, the Architect shall prepare, for approval by the City, Design
development documents consisting of drawings and other documents as indicated below:
Further developed Site Plans, Floor Plans, and Elevations detailing more complex construction
relationships to the CMAR.
Exterior elevations with materials selected for use with Large Scale Development approval with the
City of Fayetteville.
Further developed Building Sections, Wall, Sections, and Details required to document the finer

Construction Documents Phase:
Based on the approved Design Development Documents and any further adjustments in scope, quality,
schedule, or construction budget authorized by the City, the Architect shall prepare, for approval by the
City, Construction Documents consisting of Drawings and Specifications setting forth in detail the
requirements for the construction of the project.
Assist the City in preparation of necessary bidding information, bidding forms, the Conditions of the
contract, and the form of Agreement between the City and the Contractor.
Assist the City with the filing of required documents for approval of the authorities having jurisdiction over
the project.
Bidding & Negotiating Phase:
Respond to the CMAR’s request for information regarding clarification of the contract documents.
Review substitution requests by the CMAR for products specified on the project.
Prepare addendum and supplemental drawings as needed.
Construction Administration Phase:
Provide administration of the Contract for Construction as set forth in the City Architect Agreement, and
the General Conditions of the Contract for Construction.
Provide a project representative to advise and consult with the City during the administration of the
Contract for Construction.
Provide for approval of shop drawings and submittals from the contractor.
Attend bi-weekly (every two weeks) OAC (City/Architect/Contractor) jobsite meeting to monitor
construction progress and general conformance with the Contract documents, and report to the City any
deviations from the Contract Documents.
Construction Administration beyond twenty-four (24) months will be performed at an additional fee to be
negotiated.
Conduct final punch list walk and review the contractor's punch list for completion of the project.
Additional Services:
It may become necessary from time to time to incorporate changes to the contract documents to
accommodate changes in the project program and /or other requirements. These changes will be made on a
time and material basis and billed to the City per the attached billing rate schedule for additional services.

These services shall not be provided without prior written approval by the City.

City’s Responsibilities:
The City shall be responsible for providing the following information:
Current geotechnical investigation/soils report with boring locations coordinated with the design team within

project documents.
Any other special requirements not typically provided by the Architect’s scope which are necessary to

Description of the Project: Topographic Design Survey of Parcels 765-13750-001 &765-13750-003 as
shown.
The services to be provided by the Surveyor are as outlined below:
Topographic Design Survey:
A title company will be employed to provide a title search of the property to be surveyed. The title search
will include record plats (including adjoining plats), deeds (including adjoining deeds), and easement
documents. The title company fee will be a reimbursable expense to the client.
A representative from our survey department will mark the site, and we will submit a request to the local
utility 1-Call System to mark all underground utilities within the proposed project site.
Our survey crew will set at least two survey control monuments adjacent to the site that will be tied to the
city state plane coordinates and elevation datum to which all survey data for this project will be
referenced.
We will provide a topographic survey of the project survey site as shown on attached “Exhibit B1”. Sufficient
ground elevation shots will be taken for the creation of 1’-contours across the survey site, which will
include some areas beyond the boundary lines, where accessible.
We will locate all visible utility lines and those marked by the utility 1-Call System. All flow lines of drainage
inlets and pipes will be measured, and the invert elevation of sanitary sewer manholes will be recorded.
All pipe sizes will be measured and shown on the topographic survey.
Our field crew will locate trees 6” or bigger.

We will locate fences, driveways, and buildings.
We will locate enough property boundary corners for Tracts A and B of the City of Fayetteville’s University
of Arkansas Lewis Park Lot Split, attached hereto as “Exhibit B2,” so that the tracts can be referenced onto
the topographic design survey.
We will prepare an AutoCAD base survey drawing of the topographic design survey of the site, which will
be used for engineering design purposes. This base survey drawing will include the approximate property
boundary lines and any easement lines discovered by the examination of the title search for the property
or any other provided document.
Where required by state law or local regulations, we will prepare a boundary survey plat of the property
surveyed and record the plat as required by applicable statutes and regulations.
Scope of Basic Services does NOT Include the Following:
A property boundary survey, only reference and/or verification of the aforementioned Tracts A and B.
Preparation of a final subdivision plat, easement dedication plat, easement documents, tract or lot split
plats, tract or lot combination plats, or similar type plats as may be required by the governing agency for
approval of this project.
Surveys and plats of the property for financing, sales, or other purposes, such as an ALTA or as-built
survey.
Surveys of offsite utility, street or drainage improvements not within the survey site.
Surveys for environmental studies, including wetland delineation.
Surveys for flood data or studies for the Corps of Engineers, FEMA, or other special government agencies
permitting.
Surveys for the location of geotechnical soil borings or pits.
Surveying related to construction services or construction staking.

Client Shall Provide:
A copy of the current deed for the property.

Disclosure of known boundary disputes, possible encroachments, and gaps or overlaps with adjoining
properties.
Disclosure of known buried tanks or environmental concerns within the proposed improvement site area
that will be required to be shown on the survey.
Access for our survey crew personnel to enter the property to conduct the surveys.

SECTION A:General Terms Conditions
1.SUBMISSION OF A STATEMENT OF QUALIFICATION SHALL INCLUDE:
Each proposal shall contain the following at a minimum.Proposer must also address detailed requirements
as specified in the Scope of Work.
a.A written narrative describing the method or manner in which the Proposer proposes to satisfy
requirements of this RFQ.The term Proposer shall be in reference to a firm or individual responding to
this solicitation.The term proposal is used in these documents as equal to statement of qualification.
b.A description of the Proposer’s experience in providing the same or similar services as outlined in the RFQ.
This description should include the names of the person(s)who will provide the services,their
qualifications,and the years of experience in performing this type of work.Also,include the reference
information requested in this RFQ.
c.Statement should be no more than twenty five 25)pages;single sided,standard,readable,print on
standard 8.5x11 documents.Proposers shall also submit a three 3)page maximum)executive summary.
The following items will not count toward the twenty five page limitation:appendix,cover sheet,3 page
executive summary,resumes resumes shall be no more than 1 page per person),and forms provided by
the City for completion.
i.Submitting and responding to this RFQ:Proposals shall be prepared simply and economically,
providing a straightforward,concise description of its ability to meet the requirements for the
project.Fancy bindings,colored displays,and promotional material are not required.Emphasis
should be on completeness and clarity of content.All documents physically submitted should be
typewritten on standard 8 x 11”white pages and bound in one volume.Exceptions would be
schematics,exhibits,one page resumes,and City required forms.Limit proposal to twenty five
25)pages or less,excluding one page team resumes,references,and forms required by the City
for completion.All proposals shall be sealed upon delivery to the City of Fayetteville.
1.Option 1 Electronic Submittal strongly encouraged):Proposers can go to
www.fayetteville ar.gov/bids and follow the prompts to submit a proposal within the
electronic bidding platform.If a proposal is submitted electronically,a physical submission
is not necessary.All Proposers must register in order to be able to submit.There is no fee
for registration.
2.Option 2 Physical Submittal:All Proposers shall submit one 1)original copy of their
proposal as well as one 1)electronic copy on a properly labeled USB or other electronic
media device.The electronic copy submitted shall be contained into one single electronic
file and shall be identical to the hard copies provided.The use of Adobe PDF documents is
strongly recommended.Files contained on an USB or electronic media shall not be

awarded by the Fayetteville City Council.All interested parties understand proposal documents will
not be available until after a valid contract has been executed.
e. Proposers shall submit a statement of qualification based on documentation published by the
Fayetteville Purchasing Division.
f. Proposals must follow the format of the RFQ.Proposers should structure their responses to follow
the sequence of the RFQ,if provided.
g. Proposers shall have experience in work of the same or similar nature and must provide references
that will satisfy the City of Fayetteville.Proposer shall furnish a reference list of clients for whom they
have performed similar services and must provide information as requested in this document.
h. Proposer is advised that exceptions to any of the terms contained in this RFQ or the attached service
agreement must be identified in its response to the RFQ.Failure to do so may lead the City to declare
any such term non negotiable.Proposer’s desire to take exception to a non negotiable term will not
disqualify it from consideration for award.
i. Local time shall be defined as the time in Fayetteville,Arkansas on the due date of the deadline.
Documents shall be received before the deadline time as shown by the atomic clock located in the
Purchasing Division Office or electronic clock located in the City’s third party bidding software.
2. WRITTEN REQUESTS FOR INTERPRETATIONS OR CLARIFICATION:
No oral interpretations will be made to any firms as to the meaning of specifications or any other contract
documents.All questions pertaining to the terms and conditions or scope of work of this proposal must be
sent in writing via e mail to the Purchasing Department.Responses to questions may be handled as an
addendum if the response would provide clarification to the requirements of the proposal.All such addenda
shall become part of the contract documents.The City will not be responsible for any other explanation or
interpretation of the proposed RFQ made or given prior to the award of the contract.
3. RIGHTS OF CITY OF FAYETTEVILLE IN REQUEST FOR PROPOSAL PROCESS:
In addition to all other rights of the City of Fayetteville,under state law,the City specifically reserves the right
to the following:
a. The City of Fayetteville reserves the right to rank firms and negotiate with the highest ranking firm.
Negotiation with an individual Proposer does not require negotiation with others.
b. The City of Fayetteville reserves the right to select the proposal it believes will serve the best interest of
the City.
c. The City of Fayetteville reserves the right to accept or reject any or all proposals.

d.The City of Fayetteville reserves the right to cancel the entire request for proposal.
e.The City of Fayetteville reserves the right to remedy or waive technical or immaterial errors in the

information or proposal data without changing the terms of the proposal.
g.The City of Fayetteville reserves the right to make selection of the Proposer to perform the services
required on the basis of the original proposals without negotiation.
4.EVALUATION CRITERIA:
The evaluation criterion defines the factors that will be used by the selection committee to evaluate and score
responsive,responsible and qualified proposals.Proposers shall include sufficient information to allow the
selection committee to thoroughly evaluate and score proposals.Each proposal submitted shall be evaluated
and ranked by a selection committee.The contract will be awarded to the most qualified Proposer,per the
evaluation criteria listed in this RFQ.Proposers are not guaranteed to be ranked.
5.COSTS INCURRED BY PROPOSERS:
All expenses involved with the preparation and submission of proposals to the City,or any work performed in
connection therewith,shall be borne solely by the Proposer(s).No payment will be made for any responses
received,or for any other effort required of,or made by,the Proposer(s)prior to contract commencement.
6.ORAL PRESENTATION:
An oral presentation and/or interview may be requested of any firm,at the selection committee’s discretion.
7.CONFLICT OF INTEREST:
a.The Proposer represents that it presently has no interest and shall acquire no interest,either direct or
indirect,which would conflict in any manner with the performance or services required hereunder,as
provided in City of Fayetteville Code Section 34.26 titled Limited Authority of City Employee to Provide
Services to the City”.
b.The Proposer shall promptly notify Amanda Beilfuss,City Procurement Director,in writing,of all potential
conflicts of interest for any prospective business association,interest,or other circumstance which may
influence or appear to influence the Proposer’s judgment or quality of services being provided.Such
written notification shall identify the prospective business association,interest or circumstance,the
nature of which the Proposer may undertake and request an opinion to the City as to whether the
association,interest or circumstance would,in the opinion of the City,constitute a conflict of interest if
entered into by the Proposer.The City agrees to communicate with the Proposer its opinion via e mail or
first class mail within thirty days of receipt of notification.
8.WITHDRAWAL OF PROPOSAL:
A proposal may be withdrawn prior to the time set for the proposal submittal based on a written request
from an authorized representative of the firm;however,a proposal shall not be withdrawn after the time set
for the proposal.

9.LATE PROPOSAL OR MODIFICATIONS:
a.Proposal and modifications received after the time set for the proposal submittal shall not be considered.
Modifications in writing received prior to the deadline will be accepted.The City will not be responsible
for misdirected bids.Proposers refer to their submission status in the online bidding portal or call the
Purchasing Division at 479)575 8220 to ensure receipt of their submittal documents prior to opening
time and date listed.
b.The time set for the deadline shall be local time for Fayetteville,AR on the date listed.All proposals shall
be received in the Purchasing Division BEFORE the deadline stated.
10.CONSTITUTIONAL,STATE,AND FEDERAL COMPLIANCE REQUIREMENTS:
The laws of the State of Arkansas apply to any purchase made under this request for proposal.Proposers
shall comply with all constitutional,state,and federal directives,orders and laws as applicable to this proposal
and subsequent contract(s)including but not limited to Equal Employment Opportunity EEO),Disadvantaged
Business Enterprises DBE),OSHA as applicable to this contract.
11.COLLUSION:
The Proposer,by affixing his or her signature to this proposal,agrees to the following:Proposer certifies that
their proposal is made without previous understanding,agreement,or connection with any person,firm or
corporation making a proposal for the same item(s)and/or services and is in all respects fair,without outside
control,collusion,fraud,or otherwise illegal action.”
12.RIGHT TO AUDIT,FOIA,AND JURISDICITON:
a.The City of Fayetteville reserves the privilege of auditing a Contractor’s records as such records related to
purchases between the City and said Contractor.
b.Freedom of Information Act:City contracts and documents prepared while performing City contractual
work are subject to the Arkansas Freedom of Information Act.If a Freedom of Information Act request is
presented to the City of Fayetteville,the contractor)will do everything possible to provide the documents
in a prompt and timely manner as prescribed in the Arkansas Freedom of Information Act A.C.A.25 19
101 et.seq.).Only legally authorized photocopying costs pursuant to the FOIA may be assessed for this
compliance.
c.Legal jurisdiction to resolve any disputes shall be Arkansas with Arkansas law applying to the case.
13.CITY INDEMNIFICATION:
The successful Proposer(s)agrees to indemnify the City and hold it harmless from and against all claims,
liability,loss,damage or expense,including but not limited to counsel fees,arising from or by reason of any
actual or claimed trademark,patent or copyright infringement or litigation based thereon,with respect to the
services or any part thereof covered by this order,and such obligation shall survive acceptance of the services
and payment thereof by the City.
14.VARIANCE FROM STANDARD TERMS CONDITIONS:
All standard terms and conditions stated in this request for proposal apply to this contract except as
specifically stated in the subsequent sections of this document,which take precedence,and should be fully
understood by Proposers prior to submitting a proposal on this requirement.

15.ADA REQUIREMENT FOR PUBLIC NOTICES TRANSLATION:

16.CERTIFICATE OF INSURANCE:
The successful bidder shall provide a Certificate of Insurance in accordance with the following guidelines,prior
to commencement of any work:1,000,000 Commercial Liability,Statutory Worker’s Compensation,and
General Automotive,if applicable.SUCH CERTIFICATE SHALL LIST THE CITY OF FAYETTEVILLE AS AN
ADDITIONAL INSURED.LISTING THE CITY OF FAYETTEVILLE AS A CERTIFICATE HOLDER ONLY IS NOT AN
ACCEPTABLE SUBSTITUTE.CERTIFICATE OF INSURANCE MUST INCLUDE THE ENDORSEMENT SHOWING THE
CITY OF FAYETTEVILLE LISTED AS AN ADDITIONAL INSURED.Insurance shall remain valid,when applicable,
throughout project/contract completion.
17.PAYMENTS AND INVOICING:
The Proposer must specify in their proposal the exact company name and address which must be the same
as invoices submitted for payment as a result of award of this RFQ.Further,the successful Proposer is
responsible for immediately notifying the Purchasing Division of any company name change,which would
cause invoicing to change from the name used at the time of the original RFQ.Payment will be made within
thirty days of invoice received.The City of Fayetteville is very credit worthy and will not pay any interest or
penalty for untimely payments.Payments can be processed through Proposer’s acceptance of Visa at no
additional costs to the City for expedited payment processing.The City will not agree to allow any increase
in hourly rates by the contract without PRIOR Fayetteville City Council approval.
18.CANCELLATION:
a.The City reserves the right to cancel this contract without cause by giving thirty 30)days prior notice to
the Contractor in writing of the intention to cancel or with cause if at any time the Contractor fails to fulfill
or abide by any of the terms or conditions specified.
b.Failure of the contractor to comply with any of the provisions of the contract shall be considered a
material breach of contract and shall be cause for immediate termination of the contract at the discretion
of the City of Fayetteville.
c.In addition to all other legal remedies available to the City of Fayetteville,the City reserves the right to
cancel and obtain from another source,any items and/or services which have not been delivered within
the period of time from the date of order as determined by the City of Fayetteville.
d.In the event sufficient budgeted funds are not available for a new fiscal period,the City shall notify the
Contractor of such occurrence and contract shall terminate of the last day of the current fiscal period
without penalty or expense to the City.
19.ASSIGNMENT,SUBCONTRACTING,CORPORATE ACQUISITIONS AND/OR MERGERS:
a.The Contractor shall perform this contract.No assignment of subcontracting shall be allowed without
prior written consent of the City.If a Proposer intends to subcontract a portion of this work,the Proposer
shall disclose such intent in the proposal submitted as a result of this RFQ.

b.In the event of a corporate acquisition and/or merger,the Contractor shall provide written notice to the
City within thirty 30)calendar days of Contractor’s notice of such action or upon the occurrence of said

20.NON EXCLUSIVE CONTRACT:
Award of this RFQ shall impose no obligation on the City to utilize the Contractor for all work of this type,
which may develop during the contract period.This is not an exclusive contract.The City specifically reserves
the right to concurrently contract with other law firms for similar work if it deems such an action to be in the
City’s best interest.In the case of multiple phase contracts,this provision shall apply separately to each item.
21.LOBBYING:
Lobbying of selection committee members,City of Fayetteville employees,or elected officials regarding
request for proposals,request for qualifications,bids or contracts,during the pendency of bid protest,by the
bidder/proposer/protestor or any member of the bidder’s/proposer’s/protestor’s staff,and agent of the
bidder/proposer/protestor,or any person employed by any legal entity affiliated with or representing an
organization that is responding to the request for proposal,request for qualification,bid or contract,or has a
pending bid protest is strictly prohibited either upon advertisement or on a date established by the City of
Fayetteville and shall be prohibited until either an award is final or the protest is finally resolved by the City
of Fayetteville;provided,however,nothing herein shall prohibit a prospective/bidder/proposer from
contacting the Purchasing Division to address situations such as clarification and/or questions related to the
procurement process.For purposes of this provision lobbying activities shall include but not be limited to,
influencing or attempting to influence action or non action in connection with any request for proposal,
request for qualification,bid or contract through direct or indirect oral or written communication or an
attempt to obtain goodwill of persons and/or entities specified in this provision.Such actions may cause any
request for proposal,request for qualification,bid or contract to be rejected.
22.ADDITIONAL REQUIREMENTS:
The City reserves the right to request additional services relating to this RFQ from the Proposer.When
approved by the City as an amendment to the contract and authorized in writing prior to work,the Contractor
shall provide such additional requirements as may become necessary.
23. SERVICES AGREEMENT:
A written agreement,in substantially the form attached,incorporating the RFQ and the successful proposal
will be prepared by the City,signed by the successful Proposer and presented to the City of Fayetteville for
approval and signature of the Mayor.
24.INTEGRITY OF REQUEST FOR QUALIFICATION RFQ)DOCUMENTS:
Proposers shall use the original RFQ form(s)provided by the Purchasing Division and enter information only
in the spaces where a response is requested.Proposers may use an attachment as an addendum to the RFQ
form(s)if sufficient space is not available on the original form for the Proposer to enter a complete response.
Any modifications or alterations to the original RFQ documents by the Proposer,whether intentional or
otherwise,will constitute grounds for rejection of such RFQ response.Any such modifications or alterations

25.OTHER GENERAL CONDITIONS:
a.Proposers must provide the City with their proposals signed by an employee having legal authority to
submit proposals on behalf of the Proposer.The entire cost of preparing and providing responses shall
be borne by the Proposer.
b.The City reserves the right to request any additional information it deems necessary from any or all
Proposers after the submission deadline.
c.This solicitation is not to be construed as an offer,a contract,or a commitment of any kind;nor does it
commit the City to pay for any costs incurred by Proposer in preparation.It shall be clearly understood
that any costs incurred by the Proposer in responding to this request for proposal is at the Proposer's own
risk and expense as a cost of doing business.The City of Fayetteville shall not be liable for reimbursement
to the Proposer for any expense so incurred,regardless of whether or not the proposal is accepted.
d.If products,components,or services other than those described in this bid document are proposed,the
Proposer must include complete descriptive literature for each.All requests for additional information
must be received within five working days following the request.

i.Proposers irrevocably consent that any legal action or proceeding against it under,arising out of or in any
manner relating to this Contract shall be controlled by Arkansas law.Proposer hereby expressly and
irrevocably waives any claim or defense in any said action or proceeding based on any alleged lack of
jurisdiction or improper venue or any similar basis.
j.The successful Proposer shall not assign the whole or any part of this Contract or any monies due or to
become due hereunder without written consent of City of Fayetteville.In case the successful Proposer
assigns all or any part of any monies due or to become due under this Contract,the Instrument of
assignment shall contain a clause substantially to the effect that it is agreed that the right of the assignee in

k.The successful Proposer's attention is directed to the fact that all applicable Federal and State laws,
municipal ordinances,and the rules and regulations of all authorities having jurisdiction over the services
shall apply to the contract throughout,and they will be deemed to be included in the contract as though
written out in full herein.The successful Proposer shall keep himself/herself fully informed of all laws,
ordinances and regulations of the Federal,State,and municipal governments or authorities in any manner
affecting those engaged or employed in providing these services or in any way affecting the conduct of the
services and of all orders and decrees of bodies or tribunals having any jurisdiction or authority over same.
If any discrepancy or inconsistency should be discovered in these Contract Documents or in the
specifications herein referred to,in relation to any such law,ordinance,regulation,order or decree,s/he

SECTION B:Scope of Services and General Information
1.PROJECT VISION:
The City of Fayetteville envisions the development of a new aquatic center that will serve the needs of the
city now and in the future.The city is committed to providing accessible aquatic recreation and programs
and looks forward to providing a quality facility.
2.PROJECT DESCRIPTION:
a.The City of Fayetteville is soliciting Statements of Qualifications SOQs)from qualified architectural and
engineering A/E)firms to provide professional design services for a new Aquatic Facility.The selected A/E
team shall include aquatic facility specialists and provide full design services from Schematic Design
through Construction Documents,Construction Administration,and including participation in the
Construction Manager at Risk CMAR)delivery process.
b.The facility may include both indoor and outdoor components.Indoor components may include a leisure
pool with play elements and warm up lap lanes,and indoor competition pool with associated spectating
areas and indoor rentable party rooms.Outdoor components may include outdoor leisure pools with play
elements,a lazy river,a wave simulator,shade structures and rentable areas and a splash pad.Other
potential features may include wellness or therapy pools,community spaces or other recreational
amenities dependent on the results from the feasibility study,anticipated to be completed summer
2025).This project may be built in phases and design should consider long term expansion and
operational flexibility.
i.It is undetermined at this time,but the project may also include an indoor recreation center
component.
3.BACKGROUND:
a.The City currently operates one municipal pool and two splash pads.In 2023,a new Park and Recreation
System Master Plan was adopted.One of the top priorities was completing an aquatic feasibility study to
determine what the aquatic needs are for the City.The study began in 2024 and is anticipated to be
complete summer of 2025.The study will provide a concept based on public input and will serve as the
basis of design.
b.The Fayetteville School District is in need of a competition pool to host their swim team.The City and the
School District are exploring partnership opportunities to include the competition pool in this project.
c.Goals of the project include:
i.Energy efficient design
i.Design that minimizes number of staff needed
ii.Design that is efficient for operations
iii.Design that is flexible and offers an engaging mixture of elements capitalizing on community
input obtained during the feasibility study
iv.Design that is conscious of long term design life

vi.Inclusion of sustainable practices where possible
d.Cost recovery goals for the project have not been set yet and will be determined at a later date.

f.The City will engage a Construction Manager to work with the selected A/E team and will provide input
and cost estimates at each design phase.
4.SCOPE OF WORK:
a.The selected A/E firm shall provide,but not be limited to,the following services:
i.Programming confirmation and refinement if applicable)
ii.Schematic Site and Facility Design SD)
iii.Design Development DD)
iv.Entitlement process through Planning
v.Construction Documents CD)with reviews at 30%,60%and 90%
vi.Cost estimation at each phase in collaboration with CMAR
vii.Code and regulatory review and compliance
viii.Participation in value engineering and constructability reviews
ix. Coordination with the CMAR and owner team
b.The facility may include,but is not limited to:
i.Competition pool
ii.Indoor and outdoor recreational pools
iii.Shade/picnic structure and therapy pools
iv.Outdoor splashpad
v.Indoor locker rooms,support facilities,and spectator areas,mechanical rooms,office space,
party/day camp rooms,fitness spaces,and concessions
vi.Site improvements including parking,utilities,and landscaping
5.DELIVERABLES:
The selected firm will specifically be required to:
a.Prepare three schematic site plans,facility designs and estimates based on the feasibility study results.
b.Prepare design development drawings,detailed specifications and cost estimate including a review at
50%.Drawings to include:
i.Site plans,paving layouts,traffic circulation,lighting,signage and utilities
ii.Floor plans,Structural,Civil,Architectural,Storm Water Pollution Prevention Plan SWPPP),
MEP,Data,Security,Access Control,Fire Protection and landscaping
iii.Exterior elevations,rendering and color palette
iv.Building sections and details

v.Interior elevations,casework and millwork elevations
vi. Drainage Study and calculations,as required by City
vii.Report addressing all City’s Design Criteria and Code requirements
c.Coordinate project entitlement through City of Fayetteville Planning process including representing the
project at planning meetings through planning approval.
d.Prepare full set of bid documents including stamped construction plans and specifications from the final
agreed upon design.Drawings will be reviewed at 30%,60%and 90%.
e.The selected firm shall coordinate with selected CMAR for responding to questions that arise during the
bidding process and shall be prepared to respond with necessary addendums during the bidding process.
The actual bid process will be managed by the selected CMAR and they shall serve as the point of contact
and issuer for all bid documentation.
f.Coordinate with the selected CMAR to provide construction administration services,including site
observations,review of submittals,responses to RFI’s and assistance with final inspection and closeout.
6.STATEMENT OF QUALIFICATION SUBMITTAL:
Statements of qualification shall NOT include any pricing information.Price will be negotiated with the firm
recommended most qualified by the selection committee and shall NOT be included in any firm’s response
or statement of qualification.In responding to this request for statement of qualifications,firms should
include the following information in addition to other requested information and pertinent company
information related to the selection criteria:
a.Statements should be prepared simply and economically,providing a straightforward,concise description
its ability to meet the requirements for the project.Fancy bindings,colored displays,and promotional
material are not required.Emphasis should be on completeness and clarity of content.All documents
should be typewritten on standard 8 x 11”white pages and bound in one volume.Exceptions would
be schematics,exhibits,or other information necessary to facilitate the City of Fayetteville’s ability to
accurately evaluate the proposal.Limit proposal to twenty five 25)pages or less,excluding one page
team resumes and City required forms and requested items.
b.Resumes of all key persons from the firm who are expected to be involved in the scope of work as outlined
above.Resumes should be limited to one 1)page.
i.Experience with different municipal debt structure types and amounts of debt;
ii.Knowledge of federal and state tax and disclosure laws and regulations as they pertain to
municipal debt;
iii.Experience in drafting legal documents relating to municipal debt issuance;
iv.Position title,company tenure,experience,other relative information
c.A client reference list for which similar work has been performed within the past five 5)years.

e. Include any other information that might be helpful to assist the City in understanding the firm’s unique
qualifications to perform bond counsel services for the City of Fayetteville.
f. Firm/Partnership:If a partnership or other firms are providing services,provide relevant information for
each of those firms and the role of each firm,clearly establishing how the partnership is structured and
the roles of each partner.The qualifications of the partners can be included,but it should be clear which
firm staff is associated with.
i. Experience:Proposer shall provide a detailed description of similar city and/or county projects or
contracts that currently use the proposed system,completed and/or presently provided during
the past five 5)years.Provide complete contact information,name,address,phone and emails
for all references.
ii. Company Principals:Provide a brief biographic overview of the Company’s key principals.
iii. Capabilities:Proposer shall provide a description of limitations relative to facilities,staff
personnel,on going projects/contracts,etc.Specifically,provide statement of qualification
what priority will be placed on this project.
iv. Company Organization:
1. Primary Business:Proposers shall describe company’s primary business interest and/or
operations including organization and affiliations.Include the magnitude of your operation
as it relates to this project.
2. Company History:Provide pertinent company historical information that will demonstrate
your capability to successfully accomplish this project.
7. CONTRACT FORMATION:
If the negotiation produces mutual agreement,the draft contract as a part of this package will be constructed
and forwarded to the Fayetteville City Council for approval.If negotiations with the highest ranking Proposer
fail,negotiations shall be initiated with the next highest ranking Proposer until an agreement is reached.The
City reserves the right to reject all offers and end the process without executing a contract.
8. DEMONSTRATION ORAL PRESENTATION:
a. Following the evaluation of the proposals,the Selection Committee may request that the top ranking
firms make an oral presentation or be interviewed.If presentations are necessary,they will take place
in Fayetteville,Arkansas.Notices will be sent by the Purchasing Division.
9. SELECTION CRITERIA:The evaluation criterion below defines the factors which will be used by the selection
committee to evaluate and score responsive,responsible and qualified proposals.The evaluation factors are
as follows:

10 Points Firm’s proximity to and familiarity with the area in which the project is located.
NOTE:Fees shall NOT be included with any statement of qualification.Price shall not be a considered a
factor used to select a vendor.Price and fees will not be considered until the negotiating process and will not

candidate for architectural and engineering services for the City of Fayetteville’s Aquatic Center. Enclosed,

With over 60 years of industry experience, Crafton Tull has successfully designed multipurpose recreational
and aquatic projects for a wide range of clients. Our long-standing partnership with Counsilman-Hunsaker
has yielded outstanding aquatic facilities, including the Pine Bluff Aquatic Center, the Rogers Aquatics
Center, the Edmond Aquatics Center, the Conway Community and Aquatics Center, and the Jonesboro
Sportsplex. Hastings+Chivetta further enhances our team’s capabilities, bringing a wealth of knowledge in
programming and facility design, having designed more than 150 aquatic and recreation centers nationwide.
Beyond our architectural and aquatic expertise, Crafton Tull offers in-house support divisions – civil

Aquatic Facility. Our combined experience will
ensure a design that reflects the character of
Fayetteville while fulfilling the City’s aspirations for
the Aquatic Center.

A native of Northwest Arkansas, Mark earned his bachelor’s degree
from the Fay Jones School of Architecture and Design at the University
of Arkansas in 1994. He began his career with Crafton Tull in 1994 and
has provided his architectural talents as an Architect/ Principal on many
projects. Mark serves on the Board of Directors for Crafton Tull, bringing
his passion for architecture, sustainability, and technology to the entire
firm. He has a passion for visiting new places and encountering their varied
art and architecture but is equally comfortable camping with friends and
relatives.
Mark believes in strong partnerships with regional and national firms and
has worked on numerous sustainable/LEED® projects, facilitating LEED®
for existing buildings certification for the office towers of American Center,
Nashville, TN, and LEED® Silver Certification for the Center for Health
Professions for the Northwest Arkansas Community College. He has
ensured the success of award-winning projects such as The Scott Family
Amazeum and Rogers High School.

Wes holds a master’s degree in architecture from the University of Texas at
Austin. After becoming a registered architect in 1995, Wes came to work at
Crafton Tull and is thankful to be able to pursue his passion for Architecture
in a wonderful place like Fayetteville. He has filled the role of design
architect and project manager on a wide range of project types, including
education, healthcare, and commercial office buildings.
Wes enjoys taking a project from an initial idea to owner occupancy,

Matthew earned both Bachelor of Architecture and Bachelor of Science in
Architectural Studies degrees from the University of Arkansas’ Fay Jones
School of Architecture and Design. He has been a resident of Fayetteville
for over thirty years and comes to Crafton Tull after working for local
architecture firms and, most recently, for the City of Fayetteville as Director
of Building Safety and then Facilities Manager. As an architect, he has
served many roles on a wide variety of projects, from custom residential
designs to university housing and other large institutional projects.
Matthew enjoys seeing projects transition from the beginning stages on
paper to the final building plans, through the construction phases, and then
into occupancy. Understanding that all parties have essentially the same
goal for a project has helped him cultivate lasting relationships with clients,
consultants, and contractors throughout his experience.

Billy Griffitts draws on his experience as a competitive swimmer and professional
training as a licensed architect to provide an informed perspective on his projects. His

Billy was a competitive swimmer for the better part of two decades: first as an age-
group swimmer and high school athlete in the Plano, TX, then as a collegiate swimmer
at Washington University in St Louis. When not in the pool or in classes, Billy also worked
as a lifeguard in Texas and Missouri. After college, Billy began working full time at

Crafton Tull was honored to be selected by the Jonesboro Advertising and
Promotions Commission and the Public Facilities Board to design the new
Ridge Athletics Center. Now under construction, this multi-use sports facility
will provide the City of Jonesboro with a cutting-edge regional competition
venue for aquatics, basketball, volleyball, and pickleball.
Now entering the construction administration phase of the project, our team
has provided professional services supporting athletes throughout the
region. The process has included numerous public input meetings, during
which we posed challenging questions and received invaluable insights
from the citizens of Jonesboro and key facility personnel.
The Center is designed with a strong emphasis on flexibility and adaptability.
Featuring versatile hard courts, both long and short course swimming
options, exterior water features, and an event center.
Amenities provided at the request of the City input sessions: •
Courts for basketball, volleyball, and pickleball •
Expanded dining facilities •
A 50-meter competition pool with dual movable bulkheads and
expansive spectator seating •

The design for the Conway Community and Aquatics Center renovates
an existing 112,000 square-foot Axiom warehouse and IT support
building into a community center featuring indoor volleyball and
pickleball courts, indoor competition and leisure swimming pools, and
an extensive outdoor water park.
Designed in collaboration with Hastings+Chivetta and Counsilman
Hunsaker, the facility is nearing completion for an open house on July
17th. The facility will have the following features:•
8-Lane indoor competition pool with dedicated spectator seating•
Indoor leisure/ play pool•
Exterior Tower slides•
Expansive Lazy River with lounges and Cabanas•
Outdoor leisure pool with zero entry, play structures, and crossing

pavilions, a play area, and four rentable cabanas. Exterior concessions
will be provided from a full-service concession area.

Crafton Tull was initially hired to conduct a pool study for the City of
Fort Smith, assessing the current condition of the facility and providing
recommendations for improvements. Ultimately, the existing facility
was found to be outdated and in a state of such disrepair that it was not
suitable for simple remodeling.
Built in the 1940s. This historically significant structure for the city didn’t
meet accessibility requirements, and the existing layout did not lend itself
to adaptive reuse. A new facility was then pursued to provide an updated
venue for state high school championships. The new facility includes:

We provided civil engineering services for the existing site and updated
a portion of the parking lot to meet ADA requirements. Architecturally,
we restructured the pool facility layout and designed a new permanent
structure over their existing diving pool.
Although the existing pool house was demolished, as the construction
was not accessible, code compliant, or up to date, we provided new
facilities referencing design cues from the past. The new design will be a
modern, accessible, cost-effective interpretation of the old facility.

The Pine Bluff Aquatic Center encourages a fun, healthy lifestyle
for visitors of all ages. The facility boasts an eight-lane competition
swimming pool, leisure pool, sun deck, party rooms, locker rooms, and
staff offices.
When not being used for training or competitive events, the main pool
can be used for water aerobics, swimming lessons, and other special
activities. The design of the building features large overhangs and
natural daylighting. Phase two of the project will include amenities such
as basketball courts, batting cages, and various other activity rooms.

Crafton Tull was selected by the City of Rogers to prepare a master
plan, engineering documents, and architectural designs for a park and
aquatics center to serve the city as a special recreation destination. The
theme of the park is “Nature in the Ozarks,” with the 18.5-acre Aquatic
Center as the “Ozark Swimming Hole.” This theme is also carried
throughout the park and aquatic center in the architectural elements,
paving design, water features, play elements, and signage.
The Aquatics Center is located on the west end of the park and
includes recreational elements, including a lazy river, tower slides, spray
pools, and a tot pool nestled amongst drifts of native landscape. A
locker room and concession serve the park users, while a competition
pool provides a location for team events, therapy classes, and other
deep-water activities. The east end of the park is dedicated to open
play fields and ponds surrounded by wetland vegetation. Trails connect
the park to the city-wide trail system.
This project was recognized with a 2016 Dream Design Award by
Aquatics International.

Crafton Tull was hired to assess existing facilities at the Wilson
Park swimming pool and provide design services addressing ADA
compliance, security, and patron circulation. The City requested a
playful design for the remodel of the concessions area and restrooms
in keeping with the eclectic aesthetics of the park.
The existing building had two entrances, making it difficult to manage
the flow of customers. The new design centralizes the entrance and
incorporates a curved ramp with a large fishtail as a wayfinding device.
The scalloped metal panels with colored diamond cutouts give it a retro
feel, and a sliding barn door secures the building when not in use.

swimming and diving venues. We
work closely with our clients to develop
facilities that will attract top-quality meets
and championships, provide a state-of-
the-art training environment for student
athletes, and serve the day-to-day needs
of recreation users.
Fast Water
There are dozens of factors that create
fast water, and it takes a collaborative,
interdisciplinary design team to make
the most of the options available. Pool
depth and width, turbulence controls,
lighting, humidity, temperature, and views
from the deck are all contributors to fast
water. Our team is experienced at leading
multi-disciplinary teams that meet our
clients and swimmers expectations for
competition pools.
Deep Water
The classic deep water swimming pool
has 9’ deep water, including wide lanes
and specially-tailored deep water gutter
systems. The use of a movable bottom
provides greater flexibility for classes,
intramural, and recreation users but also
benefits varsity athletics during training
exercises.
Indoor Environment
We coordinate closely with engineers and
aquatic consultants, especially during the
early stages of design. Indoor aquatic
centers must be carefully planned for the
long-term comfort of users and ease of
maintenance for owners. Humidity, water
damage, rust and chemicals in the air
must be accounted for. Flat water and
water in motion produce different HVAC
system demands. These are among the
many technical factors that our team
addresses through our rigorous quality
control process that begins during design

We teamed with Bermello Ajamil & Partners to design the
Aquatic Center within the Doral Central Park development,
with a focus on serving a highly diverse, multilingual
community. Over 70% of local residents speak a language
other than English, prompting the design team to use a mix
of in-person workshops and, later, remote engagement tools
such as Zoom sessions, online surveys, and social media to
gather broad community input.
The Aquatic Center is strategically located west of the central
plaza and is designed to support both competition and
recreational use simultaneously. Its layout and programming
reflect the community’s diverse needs, offering flexible aquatic
spaces that accommodate swim meets, lap swimming, and
family-friendly recreation. The design ensures accessibility and
ease of use, with a dedicated drop-off zone and thoughtful
integration into the larger park master plan.

Bloomington-Normal YMCA
Bloomington, IL
After more than nine years of planning and building, the Bloomington-
Normal YMCA celebrated the grand opening of its newest facility in July
2022. The goal of the design was to build a welcoming, uplifting and
inspiring place focusing on universal design concepts, by expanding the
Americans with Disabilities Act to accommodate people with mobility
issues. The final design resulted from a combination of market research,
community needs assessment, and related learnings stemming from the
YMCA’s strategic planning process.
The new facility offers an indoor pool family and therapy pool, expanded
gym with fitness-tracking cardio and wellness equipment, a basketball
court with an indoor track on the upper level, three group fitness studios
that houses spin, Zumba, yoga or free weight classes, and an outdoor
rooftop terrace where people can hang out or host workouts.
The aquatic center has two sections: a competitive pool on one side and
an ADA-accessible warm-water therapy pool on the other. The therapy
pool also has a zero-depth entry, splash pad and a river current section to
help with individual rehabilitation.

construction now. Our team will be starting the design development phase of
