A RESOLUTION TO APPROVE THE PURCHASE OF A GENERATOR AND AUTOMATIC TRANSFER
SWITCH FROM NIXON POWER SERVICES, PURSUANT TO A SOURCEWELL COOPERATIVE
PURCHASING CONTRACT, IN THE AMOUNT OF $59,718.17, PLUS ANY ADDITIONAL TARIFF
CHARGES UP TO 10% OF THE ORIGINAL PURCHASE PRICE FOR THE FAYETTEVILLE SENIOR
CENTER’S MEALS-ON-WHEELS AND SENIOR NUTRITION PROGRAMS
WHEREAS, the Senior Center at Walker Park serves as an emergency shelter as needed and has a natural gas-fired
generator to maintain uninterrupted operations during power outages; and
WHEREAS, the automatic transfer switch has failed and needs to be replaced; and
WHEREAS, due to the age of the generator, a new transfer switch will necessitate the generator also be replaced as a
package unit.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes the purchase of a generator and
automatic transfer switch from Nixon Power Services, pursuant to a Sourcewell Cooperative purchasing contract, in the
amount of $59,718.17, plus any additional tariff charges up to 10% of the original purchase price for the Walker Senior
Center.

RECOMMENDATION:
CITY COUNCIL APPROVAL AND MAYOR’S SIGNATURE TO APPROVE THE PURCHASE OF A
GENERATOR AND AUTOMATIC TRANSFER SWITCH FOR THE WALKER SENIOR CENTER FROM
NIXON POWER SERVICES FOR THE PURCHASE PRICE OF $59,718.17 PLUS ANY ADDITIONAL TARIFF
CHARGES UP TO 10% OF THE ORIGINAL PURCHASE PRICE THROUGH SOURCEWELL COOPERATIVE
PURCHASING CONTRACT.
BACKGROUND:
The Senior Center at Walker Park serves senior citizens, provides for the Meals on Wheels program, and
serves as an emergency shelter as needed. The Senior Center has a natural gas-fired generator to maintain
uninterrupted operations during power outages.
DISCUSSION:
The automatic transfer switch has failed and needs to be replaced. Due to the age of the generator, a new
transfer switch will necessitate the generator also be replaced as a package unit.
Nixon Power Service has provided a quote and purchase agreement through the Sourcewell cooperative
purchasing program (contract # 092222-KOH) for $59,718.17. A tariff fee will also be applied at the time of
purchase based on current tariffs in place. The tariffs are volatile and hard to project. At the time of quote,
tariffs were estimated at $1,665 but could change before the purchase is authorized and confirmed. An
allowance of 10% of the purchase price is requested to adjust as needed for tariff changes.
BUDGET/STAFF IMPACT:
The cost of the generator and transfer switch is $59,718.17. There will be a tariff fee applied at the time of
purchase. Initial estimates of the tariff fee is $1,665 but this is subject to change. Sufficient funds are available
in the Building Improvements project.

As part of the current administration’s trade policy initiatives, new tariffs have been introduced that
likely will affect industrial goods produced by manufacturers in the emergency generator industry,
including Rehlko. We want to keep you informed about how these recent tariff developments may
impact your outstanding orders.
WHAT THIS MEANS FOR YOU
▪The costs of generator packages may be subject to fluctuations based on evolving tariff
tax surcharges imposed within the industry and may affect overall customer costs.
▪Tariff tax surcharges are calculated at time of shipment. We can estimate based on knowledge
today, but these amounts may change up to the point of shipment.
▪Goods delivering on March 1, 2025 or later will be subject to an additional charge. Your additional
costs will only be equal to additional amounts incurred by Nixon. Nixon will pass through these
charges and additional costs resulting from tariff taxes without applying any administrative
mark-up.
A FLUID SITUATION
These tariffs are the result of recent policy decisions and may continue to evolve as further guidance is
provided by the administration. While details are still unfolding, we anticipate ongoing adjustments that
could impact future pricing.

Third party testing such as NETA Testing and Infrared Scanning, is not included in this proposal. If required,
these services are to be provided by others.
Off--Loading, Permits, Concrete Pad, Installation, Exhaust Installation, Extended Wiring, Fuel, Extended Exhaust,
Anchor Bolts, Cooling Piping, and Insulation are NOT included unless specifically listed in the above bill of materials.
Current Lead Time: Approx. 20 weeks for the generator and 15 weeks for the ATS ARO. Lead times are based on firm
order levels and current line capacities. Lead times are subject to change during "High Volume" period.
Distributor Startup & Freight
A FACTORY TRAINED TECHNICIAN shall perform startup inspection and necessary installation checks and testing
per the written specifications once the equipment is furnished and installation is completed. The above pricing is based
on same day start-up and training (unless otherwise stated in specification). Startup inspection and testing is included,
and will be completed during normal business hours Monday thru Friday 8:00 am to 5:00 pm. We can perform start up
after hours and weekends at additional cost.
Proposal includes freight via FOB Factory to first destination only. FOB Factory with freight allowed to your jobsite (or
office) if accessible by a semi. All deliveries are drop-shipped. Offloading and placement of equipment is excluded. All
deliveries are Monday through Friday 8:00 a.m. to 5:00 p.m. Deliveries outside the normal business hours will be
invoiced as necessary.
