AN ORDINANCE TO ENACT ARTICLE XXXIV FOOD COMMISSION INTO THE FAYETTEVILLE CODE
WHEREAS, municipalities throughout the nation must deal with concerns regarding food deserts, food insecurity, the
need for urban agriculture, the creations of common gardens, and the education of the public about healthy food
awareness in an attempt to fight food -related diseases; and
WHEREAS, the City Council believes that the creation of the Food Commission as an advisory body to the Mayor and
City Council could bring focus on such issues and help determine needs, create programs, gain community input, and
implement programs that raise public awareness and increase the growth, purchase, and intake of healthy foods.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby enacts Article XXXIV Food
Commission § 33.460-33.464 of the Fayetteville Code as follows:
"Article XXXIV Food Commission
§ 33.460 Membership. The Members of the Food Commission shall be selected for the following positions:
1. One (1) member of the Fayetteville City Council.
2. One (1) member of the Fayetteville City Staff.
3. One (1) food retailer with stores located within the corporate limits of the City.
4. One (1) person who is actively engaged in agriculture.
5. One (1) person involved with Hunger Relief Programs in operation within the corporate limits of the City
6. Three (3) persons at -large who have experienced food insecurity as outlined in a state or federal program or are
members of the Asset Limited Income Constrained Employed (ALICE) community.
§ 33.461 Purpose. The purpose of the Food Commission is to serve as an advisory board for the Mayor and Members
of the City Council and to bring focus and make recommendations on food deserts and food insecurity, to encourage
more urban agriculture and community gardens, and to educate the public about healthy food awareness.
§ 33.462 Duties. The Food Commission shall have the following duties:

1. To assist the City in its efforts to reduce food insecurity; and to obtain community input on the resources
needed to address food issues within the City.
2. To support urban agriculture, such as community gardens and other potential sources of fresh foods.
3. To promote educational programs about diet -related diseases and food waste.
4. To increase public awareness of food programs, food deserts and food policy decisions that should be
considered by elected officials.
5. To establish methodologies and programs to monitor available data on the nutrition status of residents of the
City most impacted by the inequities in the local food system
6. To explore ways for the City to improve the availability and quality of food to its citizens.
§ 33.463 Recommendations. In fulfilling any of its purposes and duties, the Food Commission shall endeavor to
obtain information from City Departments, City Agencies, Non -Profit Organizations, existing programs, governmental
resources, and other relevant entities, to present thorough, well -researched policy recommendations to the City Council.
§ 33.464 Reports to City Council. Beginning in the December 2026, and afterwards in December on an annual basis,
unless otherwise requested the City Council, the Food Commission shall report on the work it has completed in the
previous year, its findings, identification of significant areas of concern and any policy recommendations that it has for
consideration by the Mayor and City Council."

DISCUSSION:
The City Council believes that the creation of the Food Commission as an advisory body to the Mayor and City
Council could bring focus on such issues and help determine needs, create programs, gain community input,
and implement programs that raise public awareness and increase the growth, purchase, and intake of healthy
foods.

WHEREAS, the City of Fayetteville, Arkansas ("the City"), believes that the creation of an Advisory Body to
the Mayor and Members of the Fayetteville City Council could focus on such issues and help determine
needs, create programs, gain community Input, and implement programs that raise public awareness and
increase the growth, purchase, and intake of healthy foods.
NOW, THEREFORE, IT BE ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF Fayetteville,
ARKANSAS:
Section 1. The City hereby creates a seven (7)-member Fayetteville Food Commission ("Food Coml 7
mission") to serve as an Advisory Board to the Mayor and Members of the City Council as outlined in this
ordinance.
Section 2. Membership. The members of the Food Commission shall be selected as follows:(a) One (1)
member of the Fayetteville City Council who will serve as the Chair of the Commission; and (b) One (1)
food retailer with stores located within the corporate limits of the City, and who resides within the
corporate limits of the City; and, (c) One (1) person who lives within the City and is actively engaged in
agriculture; and, (d) One (1) person involved with Hunger Relief Programs in operation within the
corporate limits of the City; and, (e) Three (3) persons at -large who have experienced food insecurity as
outlined in this ordinance.
Section 3: Purpose of the Food Commission The purpose of the Food Commission it to serve as
an Advisory Board for the Mayor and Members of the City Council, to consider the various issues outlined
in this ordinance, and also to research specific issues, or site -specific issues, as directed by the Advisory
Board.
Section 4. Duties of the Food Commission The Food Commission shall have the following duties: To assist
the City in its efforts to reduce food insecurity; and to obtain community input on the resources needed to
address food issues within the City. To support urban agriculture, such as community gardens and other
potential sources of fresh foods; To promote educational programs about diet -related diseases; and (ii)
food waste; and, to increase public awareness of food programs, food deserts and food policy decisions
that should be considered by elected officials; and, To establish methodologies and programs to monitor
available data on the nutrition status of residents of the City most impacted by the inequities in the local
food system; and, To explore ways for the City to improve the availability and quality of food to its citizens

Section 4. In fulfilling any of its duties or obligations as outlined In this ordinance, the Food Commission
shall obtain information from City Agencies, Non -Profit Organizations, existing programs, governmental
resources, and other relevant entities, to present a thorough, well -researched policy consideration to the
City Council.
Section 5. Food Commission Policy Recommendations. Beginning in the second December after the
creation of the Food Commission and the selection of its members, and afterwards in December on an
annual basis, unless otherwise requested the Board of Directors, the Commission shall report on the work
completed in the previous year, its findings, identification of significant areas of concern and any policy
recommendations that it has for consideration by the Elected Officials.
