AN ORDINANCE TO APPROVE VAC-25-19 FOR PROPERTY LOCATED AT 902 AND 908 WEST

WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions thereof
which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of street right-of-way is not required
for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of street right-of-way
as described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the following conditions:
1. Any damage to or relocation of existing facilities will be at the property owner/developer's expense.
2. A 10-foot-wide utility easement shall be dedicated centered along the existing OzarksGo underground fiber line on
the north side of West Hughes Street.

We, the undersigned, being all the owners of the real estate abutting the RIGHT-OF-WAY hereinafter
sought to be abandoned and vacated, lying in ADJACENT TO LOTS 7 & 8, BLOCK 2 OF ROSE
HILL ADDITION, City of Fayetteville, Arkansas, a municipal corporation, petition to vacate a RIGHT-
OF-WAYwhich is described as follows.
A PART OF THE EXISTING PLATTED RIGHT-OF-WAY OF WEST HUGHES STREET, ADJACENT AND
PARALLEL TO THE SOUTH LINE OF LOTS 7 AND 6 IN BLOCK 2 OF ROSE HILL ADDITION TO THE CITY
OF FAYETTEVILLE. WASHINGTON COUNTY, ARKANSAS, AS SHOWN ON THE FINAL PLAT FILED IN
BOOK 5 AT PAGE 78, SAID RIGHT-OF-WAY BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS,
TO -WIT. BEGINNING AT A POINT ON THE SOUTH LINE OF SAID BLOCK 2 WHICH IS N87°05'52W 4 16
FROM THE SOUTHEAST CORNER THEREOF AND RUNNING THENCE S03'0952W 6 91' TO THE
NORTH MASTER STREET PLAN RIGHT-OF-WAY OF WEST HUGHES STREET, THENCE ALONG SAID
RIGHT-OF-WAY N86°11'35'W 10824', THENCE LEAVING SAID RIGHT-OF-WAY NO3'o4'OTE 520' TO

That the abutting real estate affected by said abandonment of the alley are LOTS 7 & 8, BLOCK 2 OF
ROSE HILL ADDITION. City of Fayetteville used by the public for a period of many years, and that
the public interest and welfare would not be adversely affected by the abandonment of the portion of the
above described RIGHT-OF-WAY.
The petitioners pray that the City of Fayetteville, Arkansas. abandon and vacate the above described real
estate, subject, however, to the existing utility easements and sewer easements as required, and that the
above described real estate be used for their respective benefit and purpose as now approved by law
The petitioners further pray that the above described real estate be vested in the abutting property owners
as provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City of
Fayetteville, Arkansas, abandon and vacate the above described real estate, subject to said utility and
sewer casements, and that title to said real estate sought to be abandoned be vested in the abutting
property owners as provided by law, and a_c to that particular land the owners be free from the casements
of the public for the use of said alley.

REVOCABLE TRUST, 444): Submitted by BATES AND ASSOCIATES for
property located at 902 & 908 W. HUGHES ST. The property is zoned
RMF-40, RESIDENTIAL MULTI-FAMILY, 40 UNITS PER ACRE and
contains approximately 0.29 acres. The request is to vacate 0.01 acres of
street right-of-way.
RECOMMENDATION:
Staff recommends forwarding VAC-2025-0019 to the City Council with a recommendation of
approval.
RECOMMENDED MOTION:
“I move to forward VAC-2025-0019 to City Council with a recommendation of approval and with
conditions as recommended by staff.”
BACKGROUND:
The subject property is comprised of two parcels (0.29 acres) located about 800 feet southeast
of the intersection of N. Garland Ave. and W. North St. directly on the northwest corner of N.
Storer Ave. and W. Hughes Ave The property is zoned RMF-40, Residential Multi-Family, 40 Units
per Acre. The parcels was previously developed with a single-family home which was demolished
in 2024. No zoning overlay districts or master planning areas apply to the parcel. Surrounding
land uses and zoning are further depicted in Table 1.

Proposal: The applicant proposes to vacate a portion of undeveloped street right-of-way totaling
0.01 acres.
DISCUSSION:
Staff supports the applicant’s request to vacate the subject right-of-way, with conditions. The
existing right-of-way is wider than what is required by the Master Street Plan. Vacating it would
align the width of the right-of-way to 26 feet from the centerline of W. Hughes Street in accordance
with the Master Street Plan standard for a Residential Link Street.

Vacation Approval: The applicant has submitted the required vacation approval forms to relevant
city departments and franchise utility companies with the following responses. The applicant also
submitted the required adjacent property approval form with no objections.

facilities will be at the applicant’s expense.
AEP/SWEPCO No objections and no comments.
Black Hills Energy No objections and no comments.
AT&T No objections, provided any possible incursion from existing
AT&T facilities incorrectly marked – located will (if need be)
relocated at the property owner’s request and expense.
Ozarks Electric No objections and no comments.
Ozarks Go A 10’ U.E. shall be dedicated centered along the OzarksGo fiber
line.
City of Fayetteville Response

Public Comment: To date, staff has not received any public comment on this item.
RECOMMENDATION: Staff recommends forwarding VAC-2025-0019 to the City Council with a

Our client, Martin Building Group, is requesting a vacation of right-of-way of a portion of
West Hughes Street adjacent to lots 7 & 8, Block 2 of Rose Hill Addition to the City of
Fayetteville, Washington County, Arkansas. The addresses of the affected parcels are 902
& 908 West Hughes Street and the parcel numbers are 765-10325-000 & 765-10325-001,
respectively. The vacation location is adjacent to the southern property line of both parcels
and is due to an excess of land between the platted right-of-way and West Hughes Street
Master Street Plan right-of-way. The area total area of the vacation is 0.02 acres or 655.78
square feet.

The Planning Commission recommended approval of the vacation request
unanimously (the item remained on consent). I’m attaching an agenda request form
and draft ordinance with the exhibits for your review.
Since I’m going to be out of the office tomorrow I’m copying the Mayor to get her
acknowledgment, the City Clerk so they are on notice of the potential walk-on, and Kit
and Stacy so they can get the agenda request added to Civic Clerk. I’ve already set it
up as 2025-2113 and added all of the necessary info except the agenda request form.
City Clerk’s Office: For some reason, when I try to generate the memo and leg text it
says it “successfully generated an item report” but the file doesn’t show up.
