Amount Paid: $ 395.64 Page 2 CITY OF FAYETTEVILLE ARKANSAS MEETING OF SEPTEMBER 16, 2025 TO: Mayor Rawn and City Council THRU: Steven Dotson, Chief Financial Officer FROM: Kevin Springer, Budget Director SUBJECT: 2026 Millage Levy RECOMMENDATION: CITY COUNCIL MEMO 2025-1547 City staff recommends that City Council approve the millage levy ordinance which includes 0.4 mils for the Policemen's Pension and Relief Fund, 0.4 mils for the Firemen's Pension and Relief Fund, 3.7 mils for the Fayetteville Public Library, and 2.3 mils for General Fund operations. BACKGROUND: Each year the City must approve an ordinance to renew the levy of ad valorem taxes on real and personal property within the City. This request will provide for such levy on property assessed in 2025. As of August 1, 2025, the total assessed value of real and personal property located within the city limits of Fayetteville is approximately $2.8 billion. The assessed valuation comes before the Washington County Board of Equalization has made all changes to the County Assessors Abstract. DISCUSSION: City Council must approve a millage levy ordinance to continue collecting property taxes for the Policemen's and Firemen's Pension and Relief Funds. The funds are set at 0.4 mils for real property and 0.4 mils for personal property. A millage levy ordinance must also be approved for the operation of the Fayetteville Public Library. A millage levy for the library was first approved by voters on October 1, 2002 at 1.0 mil for real and personal property. On August 9, 2016, voters increased operations funding by 1.5 mils (for a total of 2.5 mils) and added 1.2 mils for bond debt service on the library expansion. The total levy is 3.7 mils, with the 1.2 mils ending when the bonds are retired. Finally, City staff is requesting that City Council approve a millage levy ordinance for General Fund operations in the amount of 2.3 mils for both real and personal property. The millage levy must be at Washington County in time to be included in their consolidated levy ordinance, which is anticipated to be approved at the November Quorum Court meeting. The deadline for receipt of the City's levy by the County is October 31 each year. The City levy will be added to the levies by Washington County, the various school districts, improvement districts and other cities within the County when the Washington County Quorum Court adopts its millage levy. The body of the ordinance which is the operative part of the ordinance and controls the effect of the ordinance is absolutely correct. It states: "Section 1: That a tax is hereby levied on the real and personal property within the City of Fayetteville, Arkansas, for the year 2025 to be collected in 2026 for the following purposes at the following rates:..." Unfortunately, the title of the ordinance which should accurately describe the ordinance, but is subservient to the operative body of the ordinance, has a typo as follows: AN ORDINANCE LEVYING A TAX ON THE REAL AND PERSONAL PROPERTY WITHIN THE CITY OF FAYETTEVILLE FOR THE YEAR OF 2026 .... This should have said for the year of 2025 just like the operative section of the ordinance. This typo or scrivener's error needs to be corrected in Civic Clerk prior to the Mayor's signature and your attesting her signature and your transmittal of the levying ordinance to the Washington County Clerk. Please consider this legal memo as my request to correct the typo or scrivener's error that was committed by the City Attorney's Office which needs to be corrected before the ordinance can be transmitted to the Washington County Clerk's Office. Please let me know when this item has been unlocked so that I can correct this typo.
