WHEREAS, the City issued RFP 25-03 for an interactive public art installation designed to enhance community
engagement and cultural experience in the Upper Ramble; and
WHEREAS, after evaluating 12 responses and interviewing three artists, the selection committee identified Partwise
LLC’s submission as the most appropriate proposal aligning with the city’s goals for public activation; and
WHEREAS, the sculpture is planned to measure 15 feet in diameter, 12 feet tall, and will be crafted from brake-
formed aluminum that will have a useful life of 25 years or more, making upkeep minimal; and
WHEREAS, the sculpture is designed as a space that can be seen from the park entrances as a beacon that visitors can
move through as well.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby awards RFP 25-03 and authorizes Mayor
Rawn to sign a contract with Partwise, LLC in the amount of $125,000.00 to commission artist David Eaton to create
his sculpture “Cambrata” for the Upper Ramble.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of
which is attached to this Resolution.

RECOMMENDATION:
Staff recommends the approval of a contract for $125,000 to commission artist David Eaton to create his
sculpture "Cambrata" for the Upper Ramble as proposed for RFP 25-03 and the approval of a budget
adjustment of $125,000.
BACKGROUND:
The City issued RFP 25-03 for an interactive public art installation designed to enhance community
engagement and cultural experience in the Upper Ramble.
DISCUSSION:
After evaluating 12 responses and interviewing with three artists, the selection committee identified Partwise
LLC's submission, titled "Cambrata," as the most appropriate proposal aligning with the city's goals for public
art activation. Artist David Eaton, propose an immersive, interactive sculptural installation planned to measure
15 feet in diameter and 12 feet tall. Crafted from brake-formed aluminum and finished with a vibrant palette of
ten colors, the sculpture draws inspiration from nature's structural forms, such as branching, folding, spiraling,
and layering. The sculpture is intentionally designed as a space that can be seen from the park entrances as a
beacon and, when approached, visitors can move through the pieces and experience the filtered light and
shadow in the curves of the piece. The brake-formed aluminum construction will be uniquely durable for the
Upper Ramble site and have a useful life of 25 years or more, as such long term maintenance and upkeep will
be minimal and the construction will allow for modular repairs if required.
BUDGET/STAFF IMPACT:
The project will be financed through the use of park development funds in GL 2250.520.9255-5315.00 and
requires the approval of a budget adjustment in the amount of $125,000 to the public art project 24009.1.

CONTRACT FOR THE COMMISSION OF PUBLIC ART
THIS AGREEMENT, dated as of ________, is made by and between the City
of Fayetteville, an Arkansas municipal corporation (the “City”), and David Eaton/ Partwise
LLC the “Artist”).
WHEREAS, the City has allocated funds for the acquisition of artwork (the “Work”) to be
installed in the Upper Ramble and
WHEREAS, a request for proposal was issued by the City and the City selected the
proposal submitted by Artist.
NOW THEREFORE, the parties mutually agree as follows:
1.Description of the Artwork. See Exhibit A
2.Location. The art garden area in the Upper Ramble, at the southwest corner of the
intersection of the fountain promenade and the Greenway diagonal pathway.
3.Changes in Design. The Artist shall create the Work in accordance with the
proposed and approved design. Recognizing that the change in scale from sketch to
full scale may require adjustments, the Artist has the right to make minor changes in
the Work that are structurally and aesthetically necessary. Any change in scope,
design, or material that significantly alters the original and approved concept and
design of the Work or affects installation, scheduling, site preparation, location or
maintenance for the Work shall require the prior review and written approval of the
City. Approval of the design shall be in writing addressed to Artist.
4.Site Preparations The City shall be responsible for engaging and compensating a
qualified contractor, separate from this Agreement, to perform site preparation and
install the sculpture footing in accordance with the Artist’s approved specifications.
The Artist shall provide detailed footing design documents, including stamped
engineered drawings, dimensions, materials, and load requirements, to the City. The
City’s contractor shall coordinate with the Artist to ensure the footing installation

meets all design tolerances and is completed prior to scheduled artwork delivery. The
Artist shall be available for consultation during footing installation to verify compliance
with specifications. The City shall ensure the footing is complete and ready for artwork
installation by the agreed upon delivery date.
5.Price. As payment for the services of the Artist and for the completed Work, the City
will pay the Artist a total of $125,000. This shall constitute full compensation from the
City to the Artist for all costs incurred in the design and creation of the Work, including,
but not limited to fees, materials, labor of the Artist and the Artist’s assistants
applicable to this project, and any costs incurred by the Artist for installation of the
Work at the Site.
6.Payment. As such, compensation is structured as a not‐to‐exceed fee, with billing to
be completed on a phase‐complete basis. Each billing shall be completed after each
phase is complete; Contract Execution, Phase 1, Phase 2, and Phase 3 of project
completion. Additional services requested that fall outside the scope of this project
shall be provided on amutually agreed schedule and price. A completed IRS Form
W-9 must be provided to the City prior to any payment being issued.
7.Installation and Time Schedule. The Artist will coordinate all Site preparation,
installation plans, and timetables with the City. The Artist shall complete installation
of the work by March 31, 2026.
8.Official Acceptance. Final payment to the Artist may not occur until the City has
accepted the Work. Such acceptance by the City may occur only after the Artist has
complied with all of Artist’s obligations hereunder. The City will examine the final
installed Work and take official ownership by sending a letter of acceptance of the
Work to the Artist.
9.Insurance Partwise shall furnish a certificate of insurance addressed to the City
of Fayetteville within ten (10) calendar days after contract finalization,
presenting insurance which shall be maintained throughout the term of the
Contract in compliance with the terms of RFP 25‐03. If applicable, Partwise
shall require any subcontractor to provide insurance. In the event any employee
engaged in work on the project under this contract is not protected under
Worker’s Compensation insurance, Partwise shall provide and shall cause
each subcontractor to provide adequate employer’s liability insurance for the
protection of such of their employees are not otherwise protected. Worker’s
Compensation coverage shall be applicable with state law.
Partwise shall carry the following coverages, at minimum:

1. Worker’s Compensation Insurance – Statutory Amount
2. Automotive Insurance covering all vehicles and trailers, if applicable
3. General Liability ‐ $1,000,000 each occurrence. Certificates of Insurance
shall list the City of Fayetteville as an additional insured. Listing the CITY
as a Certificate Holder only is NOT an acceptable substitute. Certificates of
Insurance must include the endorsement(s) showing the City of Fayetteville
listed as an additional insured.
10.Artist as Independent Contractor. The Artist agrees to perform all work and
services under this Agreement as an independent contractor and not as an agent or
employee of the City. Any and all employees of the Artist engaged in the performance
of any work or services required by the Artist under this Agreement shall be
considered employees of the Artist only. The Artist shall furnish all supervision, labor,
supplies, materials, insurance, and other incidentals needed to complete this
Agreement.
11.Public Notice. The City shall list the artwork description as supplied during the
proposal process to be displayed on the City website. The artist is also allowed to
sign the artwork for recognition.
12.Warranties. The Artist warrants that the Work is the original product of the Artist’s
own creative efforts. The Artist also warrants that the Work is unique and that the
Work or a duplicate thereof has not been accepted for sale elsewhere, unless, as
stipulated to the City at the time this Agreement is signed, the Work is known by the
City as one of a limited edition.
The Artist warrants that the execution and fabrication of the Work will be performed
in a professional manner and that the Work, as fabricated and installed, will be free
of defects in material and quality, including any defects consisting of “inherent vice”
or qualities which cause or accelerate deterioration of the Work.
The Artist warrants that reasonable maintenance of the Work will not require
procedures substantially in excess of those described in the maintenance instructions
submitted in the proposal for the Work previously approved.
13.Assignment of Work. The Work and services required of the Artist under this
Agreement are personal and shall not be assigned, sublet, or transferred. This shall
not prohibit the Artist from employing or subcontracting qualified personnel who shall
work directly under the Artist’s supervision.
14.Indemnity and Liability. The Artist does release and agree to save and hold

harmless the City, and its officers, officials, members, agents, and employees from
any and all causes of action, suits in law of equity, or demands or claims, or from any
liability of any nature arising out of the construction and creation of the Work and from
any obligations made by the Artist or the Artist’s agents and/or employees. All risks
for damages, theft, vandalism, and Acts of God to the Work are the responsibility of
the Artist during any and all operations, In case of accident to, or destruction, or
damage to the Work while the Work is being created, by or on behalf of the Artist, the
Artist shall re-fabricate the Work under the same terms and conditions as set forth in
this agreement. The Artist shall be responsible for all damage, claims, and liability
arising from, growing out of damages caused by the Artist or the Artist’s employees
or claims that may occur as a result of the Artist’s breach of warranties provided in
Section 12.
15.Compliance with Laws. The Artist shall observe and comply with all applicable
statutes, orders, ordinances and regulations of the City, the County of Washington,
the State of Arkansas, the federal government and any other governmental authority
having jurisdiction over the site or the Work.
16.Copyright. The Artist hereby transfers to the City every right available to the Artist in
common law, under the Federal Copyright Act, or other applicable state or federal
law, and all other rights in and to the work. The City shall have the right to reproduce
photographically or mechanically the Work for marketing, and publication, without
written agreement of the artist. All reproductions of the Work by the City shall contain
a credit to the Artist. The City agrees that Artist may use photographs of the Work
for purposes of advertising and promotion, or inclusion in publications about Artist or
Artist’s works. The Artist agrees to give credit in the following form: “Original owned
by City of Fayetteville, Arkansas” in any public showing of any reproductions or
photographs of the Work.
17.Alteration of the Work. The City agrees that it will not intentionally alter, modify, or
change the Work without the prior written approval of the Artist. If any changes,
alterations or modifications occur to the Work after it has been completed and
installed, including any change in the interrelationship or relative locations of parts of
the Work, the Work will no longer be represented as the Work of the Artist upon
receipt of a written request to that effect from the Artist.
Nothing in this section shall preclude any right of the City to: 1) remove the Work from

public display or 2) destroy the Work. Artist hereby expressly waives all moral rights
as defined by the Visual Artists Rights Act, 17 U.S.C. § 106A, to the Work.
18.Durability, Maintenance and Repair: The artwork commissioned under this
agreement is expected to maintain its visual integrity and quality for an anticipated
useful life of at least twenty years, during which it will be exposed to normal
environmental conditions. The City shall consult with the Artist regarding any
necessary repairs or restoration of the artwork throughout its expected life. The Artist
agrees to cooperate with the City in these efforts to perform necessary repairs and
restorations during the term of this Agreement. Beyond the twenty-year period, the
City may, at its discretion, remove or restore the work in accordance with the public
art policies regarding maintenance and deaccession at the time of that evaluation.
19.Relocation. The Work shall be placed on the Site designated in Section 2 of this
Agreement. Should the Site prove to be unacceptable or unavailable to the City after
the signing of this Agreement, an alternative site may be chosen by the City.
20.Termination. In the event this Agreement is terminated by the City for any reason,
the Artist shall be entitled to a final payment or settlement in an amount equal to the
percentage of the Work completed at the time the Agreement is terminated as
determined by mutual agreement between the City and the Artist. The Artist shall
deliver to the City the Work in whatever form it exists at the time of termination, which
shall then become the property of City for use without restriction, except that it shall
not be represented to be the completed Work of the Artist.
21.Modifications of this Agreement. No alterations, changes or modification of the
terms of this Agreement shall be valid unless made in writing and signed by all parties
hereto.
22.No Waiver. No failure to exercise and no delay in exercising, any right, power, or
remedy hereunder on the part of the City or Artist shall operate as a waiver thereof,
nor shall any single or partial exercise of any right, power, or remedy preclude any
other or further exercise thereof or the exercise of any other right, power, or remedy.
No express waiver shall affect any event or default other than the event or default
specified in such waiver, and any such waiver, to be effective, must be in writing and

shall be operative only for the time and to the extent expressly provided by the City
or Artist therein. A waiver of any covenant, term, or condition contained herein shall
not be construed as a waiver of any subsequent breach of the same covenant, term,
or condition.
23.Controlling Law and Venue. This Agreement shall be subject to, interpreted and
enforced according to the laws of the State of Arkansas. Jurisdiction and venue for
any dispute shall be the Circuit Court of Washington County, Arkansas.
24.Entire Agreement. This Agreement represents the entire agreement between City
and Artist.

Exhibit A – Scope of Work & Fees
Partwise will oversee and manage the design, development, and installation of an interactive
art feature in the Upper Ramble in Fayetteville, Arkansas. The art feature will enhance a part of
the Cultural Arts Corridor, supporting community engagement and interaction through public
art.

1.Concept Presentation and Approval
a.Present the fully developed sculptural concept "Cambrata" to the Fayetteville
Arts Council for formal approval.
b.Incorporate any feedback from the Arts Council into final design refinements.
2.Engineering and Technical Specifications
a.Develop full engineering documentation, structural calculations, and material
specifications for the proposed aluminum structure.
b.Finalize footing and foundation designs with stamped engineered approvals and
coordinate with the city selected foundation construction team.
c.Outline site preparation and installation requirements clearly.
3. Timeline and Budget
Create a refined timeline for the fabrication and installation phases based on approved
design specifications that adheres to initial budget.

1.Detailed Fabrication Documentation
a.Deliver comprehensive fabrication drawings and specifications for brake-formed
aluminum components.
b.Source and confirm availability of required materials and finishes, including

specifications.
b.Coordinate logistics for shipping and temporary storage solutions.
3.Maintenance Documentation
a.Prepare a draft of a comprehensive maintenance manual outlining materiality

a.Plan logistics for delivery and installation including artist travel, shipping, and
related logistics.
b.Confirm ship dates and arrival for the sculpture and installation logistics
including , interfacing with city staff, park maintenance team, and city selected
construction firm for footing/foundation.

1.Installation Planning and Coordination
a.Coordinate site preparations, ensuring necessary equipment and permits are
secured.
b.Oversee delivery of the fabricated sculpture components to the site.

adherence to engineering specifications and quality standards.

Interest, Philosophy, Qualifications and Statement
My work is centered on creating immersive sculptural environments that transform the way people
experience public space. These are not static objects, but living spaces—walkable forms that invite
exploration, curiosity, and reflection. Whether stepping inside, wandering through, or engaging in
spontaneous play, visitors are encouraged to interact in ways that are intuitive, open-ended, and meaningful.
I believe public art can be more than a visual landmark—it can be a catalyst for presence. In
fast-moving environments where time is compressed and attention scattered, these sculptural
works offer an opportunity to pause, to breathe, and to reconnect with something larger than the
moment. Inspired by nature’s structural logic—branching, folding, spiraling, layering—I design
forms that echo the rhythms of the natural world. These multiscalar geometries draw from both
the vast and the intimate, inviting people to experience space through motion, light, and material.
Throughout my career, I have worked at the intersection of art, architecture, and fabrication to bring
complex and expressive geometries into the public realm. As Director at THEVERYMANY with Marc
Fornes, I helped lead the office’s transition into large-scale public art, guiding the design and realization
of internationally recognized projects such as The Chrysalis, a community-funded amphitheater
adjacent to Frank Gehry’s Merriweather Post Pavilion. In that role, I oversaw design development,
structural coordination, code compliance, digital fabrication, prototyping, and on-site installation—
ensuring that the conceptual power of the work was matched by its physical clarity and constructability.
I also served as the sole Geometry Specialist in Santiago Calatrava’s New York office,
contributing to both public and private art projects, including the UAE Pavilion for Expo Dubai.
There, I worked closely on design development, fabrication logic, and structural refinement.
At NBBJ, I led geometry and computational design on the Amazon Helix, aligning the project’s
iconic form with engineering systems, fabrication workflows, and experiential performance.
This project continues my commitment to creating public artworks that are both architecturally
expressive and experientially rich. It presents an opportunity to expand this approach within a
new spatial and cultural context—one where art doesn’t simply occupy space, but activates it. The
proposed sculpture is not an object to walk around, but one to move through—creating layered
encounters with light, form, and shadow. It offers moments of discovery and reflection, encouraging
visitors to slow down and find unexpected connections with the environment and with one another.
At its core, my practice is about making the everyday extraordinary. By transforming open space into
an experience of wonder and engagement, public art has the power to shift how we relate to the
world around us. This project is a chance to bring that vision to life—creating a lasting, interactive
landmark that invites people of all ages to explore, reflect, and reconnect through art

The City of Fayetteville, Arkansas, is seeking proposals for a new public art installation in the Upper Ramble. Any

SECTION A: General Terms & Conditions
1. SUBMISSION OF A PROPOSAL SHALL INCLUDE:
Each proposal shall contain the following at a minimum. Proposer must also address detailed requirements
as specified in the Scope of Work.
a. A written narrative describing the method or manner in which the Proposer proposes to satisfy
requirements of this RFP in the most cost-effective manner. The term Proposer shall be in reference to a
firm or individual responding to this solicitation.
b. A description of the Proposer’s experience in providing the same or similar services as outlined in the RFP.
This description should include the names of the person(s) who will provide the services, their
qualifications, and the years of experience in performing this type of work. Also, include the reference
information requested in this RFP.
c. The complete fee and cost to the City for all services outlined in this RFP.
d. Statement should be no more than twenty-five (25) pages; single sided, standard, readable, print on
standard 8.5x11 documents. Proposers shall also submit a three (3) page (maximum) executive summary.
The following items will not count toward the twenty-five page limitation: appendix, cover sheet, 3-page
executive summary, resumes (resumes shall be no more than 1 page per person), and forms provided by
the City for completion.
i. Submitting and responding to this RFP: Proposals shall be prepared simply and economically,
providing a straightforward, concise description of its ability to meet the requirements for the
project. Fancy bindings, colored displays, and promotional material are not required. Emphasis
should be on completeness and clarity of content. All documents physically submitted should be
typewritten on standard 8 ½” x 11” white papers and bound in one volume. Exceptions would be
schematics, exhibits, one-page resumes, and City required forms. Limit proposal to twenty-five
(25) pages or less, excluding one-page team resumes, references, and forms required by the City
for completion. All proposals shall be sealed upon delivery to the City of Fayetteville.
1. Option 1 –Electronic Submittal (strongly encouraged): Proposers can go to
www.fayetteville-ar.gov/bids and follow the prompts to submit a proposal within the
electronic bidding platform. If a proposal is submitted electronically, a physical submission
is not necessary. All Proposers must register in order to be able to submit. There is no fee
for registration.
2. Option 2 – Physical Submittal: All Proposers shall submit one (1) original copy of their
proposal as well as one (1) electronic copy on a properly labeled USB or other electronic
media device. The electronic copy submitted shall be contained into one single electronic
file and shall be identical to the hard copies provided. The use of Adobe PDF documents is
strongly recommended. Files contained on an USB or electronic media shall not be
restricted against saving or printing. Electronic copies shall not be submitted via e-mail to

City employees by the Proposer and shall be provided to the City in a sealed manner. FedEx,
UPS, USPS, or other packages should be clearly marked with the RFP number on the outside
of the mailing package.
e. Proposals will be reviewed following the stated deadline, as shown on the cover sheet of this document.
Only the names of Proposer’s will be available after the deadline until a contract has been awarded by the
Fayetteville City Council. All interested parties understand proposal documents will not be available until
after a valid contract has been executed.
f. Proposers shall submit a proposal based on documentation published by the Fayetteville Purchasing
Division.
g. Proposals must follow the format of the RFP. Proposers should structure their responses to follow the
sequence of the RFP.
h. Proposers shall have experience in work of the same or similar nature and must provide references that
will satisfy the City of Fayetteville. Proposer shall furnish a reference list of clients for whom they have
performed similar services and must provide information as requested in this document.
i. Proposer is advised that exceptions to any of the terms contained in this RFP or the attached service
agreement must be identified in its response to the RFP. Failure to do so may lead the City to declare any
such term non-negotiable. Proposer’s desire to take exception to a non-negotiable term will not disqualify
it from consideration for award.
j. Local time shall be defined as the time in Fayetteville, Arkansas on the due date of the deadline.
Documents shall be received before the deadline time as shown by the atomic clock located in the
Purchasing Division Office or electronic clock located in the City’s third-party bidding software.
2. WRITTEN REQUESTS FOR INTERPRETATIONS OR CLARIFICATION:
No oral interpretations will be made to any firms as to the meaning of specifications or any other contract
documents. All questions pertaining to the terms and conditions or scope of work of this proposal must be
sent in writing via e-mail to the Purchasing Department. Responses to questions may be handled as an
addendum if the response would provide clarification to the requirements of the proposal. All such addenda
shall become part of the contract documents. The City will not be responsible for any other explanation or
interpretation of the proposed RFP made or given prior to the award of the contract.
3. DESCRIPTION OF SUPPLIES AND SERVICES:
Any manufacturer’s names, trade name, brand name, catalog number, etc. used in specifications are for the
purpose of describing and establishing general quality levels. Such references are NOT intended to be
restrictive. Proposals shall be considered for all brands that meet the quality of the specifications listed for
any items.
4. RIGHTS OF CITY OF FAYETTEVILLE IN REQUEST FOR PROPOSAL PROCESS:
In addition to all other rights of the City of Fayetteville, under state law, the City specifically reserves the right
to the following:

a. The City of Fayetteville reserves the right to rank firms and negotiate with the highest-ranking firm.
Negotiation with an individual Proposer does not require negotiation with others.
b. The City of Fayetteville reserves the right to select the proposal it believes will serve the best interest of
the City.
c. The City of Fayetteville reserves the right to accept or reject any or all proposals.
d. The City of Fayetteville reserves the right to cancel the entire request for proposal.
e. The City of Fayetteville reserves the right to remedy or waive technical or immaterial errors in the request
for proposal or in proposals submitted.
f. The City of Fayetteville reserves the right to request any necessary clarifications, additional information
or proposal data without changing the terms of the proposal.
g. The City of Fayetteville reserves the right to make selection of the Proposer to perform the services
required on the basis of the original proposals without negotiation.
h. The City reserves the right to ask for a best and final offer from one or more Proposers. The best and final
offer process is not guaranteed; therefore, Proposers shall submit and respond to this RFP on the most
favorable terms available.
5. EVALUATION CRITERIA:
The evaluation criterion defines the factors that will be used by the selection committee to evaluate and score
responsive, responsible and qualified proposals. Proposers shall include sufficient information to allow the
selection committee to thoroughly evaluate and score proposals. Each proposal submitted shall be evaluated
and ranked by a selection committee. The contract will be awarded to the most qualified Proposer, per the
evaluation criteria listed in this RFP. Proposers are not guaranteed to be ranked.
6. COSTS INCURRED BY PROPOSERS:
All expenses involved with the preparation and submission of proposals to the City, or any work performed in
connection therewith, shall be borne solely by the Proposer(s). No payment will be made for any responses
received, or for any other effort required of, or made by, the Proposer(s) prior to contract commencement.
7. ORAL PRESENTATION:
An oral presentation and/or interview may be requested of any firm, at the selection committee’s discretion.
8. CONFLICT OF INTEREST:
a. The Proposer represents that it presently has no interest and shall acquire no interest, either direct or
indirect, which would conflict in any manner with the performance or services required hereunder, as
provided in City of Fayetteville Code Section 34.26 titled “Limited Authority of City Employee to Provide
Services to the City”.
b. The Proposer shall promptly notify Amanda Beilfuss, City Sr. Purchasing Agent, in writing, of all potential
conflicts of interest for any prospective business association, interest, or other circumstance which may

influence or appear to influence the Proposer’s judgment or quality of services being provided. Such
written notification shall identify the prospective business association, interest or circumstance, the
nature of which the Proposer may undertake and request an opinion to the City as to whether the
association, interest or circumstance would, in the opinion of the City, constitute a conflict of interest if
entered into by the Proposer. The City agrees to communicate with the Proposer its opinion via e-mail or
first-class mail within thirty days of receipt of notification.
9. WITHDRAWAL OF PROPOSAL:
A proposal may be withdrawn prior to the time set for the proposal submittal based on a written request
from an authorized representative of the firm; however, a proposal shall not be withdrawn after the time set
for the proposal.
10. LATE PROPOSAL OR MODIFICATIONS:
a. Proposal and modifications received after the time set for the proposal submittal shall not be considered.
Modifications in writing received prior to the deadline will be accepted. The City will not be responsible
for misdirected bids. Proposers refer to their submission status in the online bidding portal or call the
Purchasing Division at (479) 575-8220 to ensure receipt of their submittal documents prior to opening
time and date listed.
b. The time set for the deadline shall be local time for Fayetteville, AR on the date listed. All proposals shall
be received in the Purchasing Division BEFORE the deadline stated. The official clock to determine local
time shall be the atomic clock located in the Purchasing Division, Room 306 of City Hall, 113 W. Mountain,
Fayetteville, AR.
11. CONSTITUTIONAL, STATE, AND FEDERAL COMPLIANCE REQUIREMENTS:
The laws of the State of Arkansas apply to any purchase made under this request for proposal. Proposers
shall comply with all constitutional, state, and federal directives, orders and laws as applicable to this proposal
and subsequent contract(s) including but not limited to Equal Employment Opportunity (EEO), Disadvantaged
Business Enterprises (DBE), & OSHA as applicable to this contract.
12. PROVISION FOR OTHER AGENCIES:
Unless otherwise stipulated by the Proposer, the Proposer agrees to make available to all Government
agencies, departments, municipalities, and counties, the proposal prices submitted in accordance with said
proposal terms and conditions therein, should any said governmental entity desire to buy under this proposal.
Eligible users shall mean all state of Arkansas agencies, the legislative and judicial branches, political
subdivisions (counties, local district school boards, community colleges, municipalities, counties, or other
public agencies or authorities), which may desire to purchase under the terms and conditions of the contract.
13. COLLUSION:
The Proposer, by affixing his or her signature to this proposal, agrees to the following: “Proposer certifies that
their proposal is made without previous understanding, agreement, or connection with any person, firm or
corporation making a proposal for the same item(s) and/or services and is in all respects fair, without outside
control, collusion, fraud, or otherwise illegal action.”

14. RIGHT TO AUDIT, FOIA, AND JURISDICITON:
a. The City of Fayetteville reserves the privilege of auditing a Contractor’s records as such records relate to
purchases between the City and said Contractor.
b. Freedom of Information Act: City contracts and documents prepared while performing City contractual
work are subject to the Arkansas Freedom of Information Act. If a Freedom of Information Act request is
presented to the City of Fayetteville, the (contractor) will do everything possible to provide the documents
in a prompt and timely manner as prescribed in the Arkansas Freedom of Information Act (A.C.A. §25-19-
101 et. seq.). Only legally authorized photocopying costs pursuant to the FOIA may be assessed for this
compliance.
c. Legal jurisdiction to resolve any disputes shall be Arkansas with Arkansas law applying to the case.
15. CITY INDEMNIFICATION:
The successful Proposer(s) agrees to indemnify the City and hold it harmless from and against all claims,
liability, loss, damage or expense, including but not limited to counsel fees, arising from or by reason of any
actual or claimed trademark, patent or copyright infringement or litigation based thereon, with respect to the
services or any part thereof covered by this order, and such obligation shall survive acceptance of the services
and payment thereof by the City.
16. VARIANCE FROM STANDARD TERMS & CONDITIONS:
All standard terms and conditions stated in this request for proposal apply to this contract except as
specifically stated in the subsequent sections of this document, which take precedence, and should be fully
understood by Proposers prior to submitting a proposal on this requirement.
17. ADA REQUIREMENT FOR PUBLIC NOTICES & TRANSLATION:
Persons with disabilities requiring reasonable accommodation to participate in this proceeding/event, should
call 479.521.1316 (telecommunications device for the deaf), no later than seven days prior to the deadline.
Persons needing translation of this document shall contact the City of Fayetteville, Purchasing Division,
immediately.
18. CERTIFICATE OF INSURANCE:
The successful bidder shall provide a Certificate of Insurance in accordance with the following guidelines, prior
to commencement of any work: $1,000,000 Commercial Liability, Statutory Worker’s Compensation, and
General Automotive, if applicable. SUCH CERTIFICATE SHALL LIST THE CITY OF FAYETTEVILLE AS AN
ADDITIONAL INSURED. LISTING THE CITY OF FAYETTEVILLE AS A CERTIFICATE HOLDER ONLY IS NOT AN
ACCEPTABLE SUBSTITUTE. CERTIFICATE OF INSURANCE MUST INCLUDE THE ENDORSEMENT SHOWING THE
CITY OF FAYETTEVILLE LISTED AS AN ADDITIONAL INSURED. Insurance shall remain valid, when applicable,
throughout project completion.
19. PAYMENTS AND INVOICING:
The Proposer must specify in their proposal the exact company name and address which must be the same
as invoices submitted for payment as a result of award of this RFP. Further, the successful Proposer is
responsible for immediately notifying the Purchasing Division of any company name change, which would
cause invoicing to change from the name used at the time of the original RFP. Payment will be made within
thirty days of invoice received. The City of Fayetteville is very credit worthy and will not pay any interest or

penalty for untimely payments. Payments can be processed through Proposer’s acceptance of Visa at no
additional costs to the City for expedited payment processing. The City will not agree to allow any increase
in hourly rates by the contract without PRIOR Fayetteville City Council approval.
20. CANCELLATION:
a. The City reserves the right to cancel this contract without cause by giving thirty (30) days prior notice to
the Contractor in writing of the intention to cancel or with cause if at any time the Contractor fails to fulfill
or abide by any of the terms or conditions specified.
b. Failure of the contractor to comply with any of the provisions of the contract shall be considered a
material breach of contract and shall be cause for immediate termination of the contract at the discretion
of the City of Fayetteville.
c. In addition to all other legal remedies available to the City of Fayetteville, the City reserves the right to
cancel and obtain from another source, any items and/or services which have not been delivered within
the period of time from the date of order as determined by the City of Fayetteville.
d. In the event sufficient budgeted funds are not available for a new fiscal period, the City shall notify the
Contractor of such occurrence and contract shall terminate of the last day of the current fiscal period
without penalty or expense to the City.
21. ASSIGNMENT, SUBCONTRACTING, CORPORATE ACQUISITIONS AND/OR MERGERS:
a. The Contractor shall perform this contract. No assignment of subcontracting shall be allowed without
prior written consent of the City. If a Proposer intends to subcontract a portion of this work, the Proposer
shall disclose such intent in the proposal submitted as a result of this RFP.
b. In the event of a corporate acquisition and/or merger, the Contractor shall provide written notice to the
City within thirty (30) calendar days of Contractor’s notice of such action or upon the occurrence of said
action, whichever occurs first.
22. NON-EXCLUSIVE CONTRACT:
Award of this RFP shall impose no obligation on the City to utilize the Contractor for all work of this type,
which may develop during the contract period. This is not an exclusive contract. The City specifically reserves
the right to concurrently contract with other companies for similar work if it deems such an action to be in
the City’s best interest. In the case of multiple-phase contracts, this provision shall apply separately to each
item.
23. LOBBYING:
Lobbying of selection committee members, City of Fayetteville employees, or elected officials regarding
request for proposals, request for qualifications, bids or contracts, during the pendency of bid protest, by the
bidder/proposer/protestor or any member of the bidder’s/proposer’s/protestor’s staff, and agent of the
bidder/proposer/protestor, or any person employed by any legal entity affiliated with or representing an
organization that is responding to the request for proposal, request for qualification, bid or contract, or has a
pending bid protest is strictly prohibited either upon advertisement or on a date established by the City of
Fayetteville and shall be prohibited until either an award is final or the protest is finally resolved by the City
of Fayetteville; provided, however, nothing herein shall prohibit a prospective/bidder/proposer from

contacting the Purchasing Division to address situations such as clarification and/or questions related to the
procurement process. For purposes of this provision lobbying activities shall include but not be limited to,
influencing or attempting to influence action or non-action in connection with any request for proposal,
request for qualification, bid or contract through direct or indirect oral or written communication or an
attempt to obtain goodwill of persons and/or entities specified in this provision. Such actions may cause any
request for proposal, request for qualification, bid or contract to be rejected.
24. ADDITIONAL REQUIREMENTS:
The City reserves the right to request additional services relating to this RFP from the Proposer. When
approved by the City as an amendment to the contract and authorized in writing prior to work, the Contractor
shall provide such additional requirements as may become necessary.
25. SERVICES AGREEMENT:
A written agreement, in substantially the form attached, incorporating the RFP and the successful proposal
will be prepared by the City, signed by the successful Proposer and presented to the City of Fayetteville for
approval and signature of the Mayor.
26. INTEGRITY OF REQUEST FOR PROPOSAL (RFP) DOCUMENTS:
Proposers shall use the original RFP form(s) provided by the Purchasing Division and enter information only
in the spaces where a response is requested. Proposers may use an attachment as an addendum to the RFP
form(s) if sufficient space is not available on the original form for the Proposer to enter a complete response.
Any modifications or alterations to the original RFP documents by the Proposer, whether intentional or
otherwise, will constitute grounds for rejection of such RFP response. Any such modifications or alterations
a Proposer wishes to propose shall be clearly stated in the Proposer’s RFP response and presented in the form
of an addendum to the original RFP documents.
27. OTHER GENERAL CONDITIONS:
a. Proposers must provide the City with their proposals signed by an employee having legal authority to
submit proposals on behalf of the Proposer. The entire cost of preparing and providing responses shall
be borne by the Proposer.
b. The City reserves the right to request any additional information it deems necessary from any or all
Proposers after the submission deadline.
c. This solicitation is not to be construed as an offer, a contract, or a commitment of any kind; nor does it
commit the City to pay for any costs incurred by Proposer in preparation. It shall be clearly understood
that any costs incurred by the Proposer in responding to this request for proposal is at the Proposer's own
risk and expense as a cost of doing business. The City of Fayetteville shall not be liable for reimbursement
to the Proposer for any expense so incurred, regardless of whether or not the proposal is accepted.
d. If products, components, or services other than those described in this bid document are proposed, the
Proposer must include complete descriptive literature for each. All requests for additional information
must be received within five working days following the request.
e. Any uncertainties shall be brought to the attention to Amanda Beilfuss immediately via telephone

Purchasing Division to provide documents providing a clear and accurate understanding of the scope of
work to be completed and/or goods to be provided. We encourage all interested parties to ask questions
to enable all Proposers to be on equal terms.
f. Any inquiries or requests for explanation in regard to the City's requirements should be made promptly
to Amanda Beilfuss, City of Fayetteville, Procurement Director via e-mail (abeilfuss@fayetteville-ar.gov)
or telephone (479.575.8220). No oral interpretation or clarifications will be given as to the meaning of
any part of this request for proposal. All questions, clarifications, and requests, together with answers, if
any, will be provided to all firms via written addendum. Names of firms submitting any questions,
clarifications, or requests will not be disclosed until after a contract is in place.
g. At the discretion of the City, one or more firms may be asked for more detailed information before final
ranking of the firms, which may also include oral interviews.
h. Any information provided herein is intended to assist the Proposer in the preparation of proposals
necessary to properly respond to this RFP. The RFP is designed to provide qualified Proposers with
sufficient basic information to submit proposals meeting minimum specifications and/or test
requirements but is not intended to limit a RFP’s content or to exclude any relevant or essential data.
i. Proposers irrevocably consent that any legal action or proceeding against it under, arising out of or in any
manner relating to this Contract shall be controlled by Arkansas law. Proposer hereby expressly and
irrevocably waives any claim or defense in any said action or proceeding based on any alleged lack of
jurisdiction or improper venue or any similar basis.
j. The successful Proposer shall not assign the whole or any part of this Contract or any monies due or to
become due hereunder without written consent of City of Fayetteville. In case the successful Proposer
assigns all or any part of any monies due or to become due under this Contract, the Instrument of
assignment shall contain a clause substantially to the effect that it is agreed that the right of the assignee in
and to any monies due or to become due to the successful Proposer shall be subject to prior liens of all
persons, firms, and corporations for services rendered or materials supplied for the performance of the
services called for in this contract.
k. The successful Proposer's attention is directed to the fact that all applicable Federal and State laws,
municipal ordinances, and the rules and regulations of all authorities having jurisdiction over the services
shall apply to the contract throughout, and they will be deemed to be included in the contract as though
written out in full herein. The successful Proposer shall keep himself/herself fully informed of all laws,
ordinances and regulations of the Federal, State, and municipal governments or authorities in any manner
affecting those engaged or employed in providing these services or in any way affecting the conduct of the
services and of all orders and decrees of bodies or tribunals having any jurisdiction or authority over same.
If any discrepancy or inconsistency should be discovered in these Contract Documents or in the
specifications herein referred to, in relation to any such law, ordinance, regulation, order or decree, s/he
shall herewith report the same in writing to the City of Fayetteville.

SECTION B: Scope of Services and General Information
1. INTRODUCTION:
The City of Fayetteville is seeking proposals for a new public art installation in the Upper Ramble, a vibrant
civic space in the heart of the city. This area connects key cultural landmarks such as the Walton Arts
Center, TheatreSquared, Fayetteville Public Library, and the University of Arkansas’ Art and Design District.
Designed to enhance the community experience, the Upper Ramble offers recreational elements, public art,
improved streetscapes, pedestrian pathways, and open-air gathering spaces, all thoughtfully integrated with
the natural landscape.
2. BACKGROUND:
The Upper Ramble features an event lawn, art gardens, a 20-foot-wide promenade for festivals and markets,
and a stunning 300-foot spring-fed water feature. The designated art space within the garden is surrounded
by native plantings, shaded seating areas, and scenic walkways, creating an ideal location for an interactive
artwork. This installation will engage the public, enhance the park’s design, and reflect Fayetteville’s
commitment to creative placemaking and community connection.
Given the proximity to the water feature and the site’s location in the garden, water is not a desired feature
for interactivity in this piece of public art.
3. SCOPE OF WORK:
a. The Upper Ramble Art Installation project calls for an innovative, interactive artwork that invites
community participation and engagement. The selected artist or team will be responsible for creating
a piece of public art which engages the public and aligns with the vision of Upper Ramble as a space
for exploration and play.
In addition to these creative responsibilities, the artist/team will work with a pre-selected local
engineering firm for technical review and the installation of a secure footing, ensuring the piece is
safely and seamlessly integrated into the park environment per the design parameters established by
the landscape architects in the attached document.
The awarded artist will be responsible for managing the creation of the artwork, from concept
development to fabrication, to assisting Contractor with installation, all within the allocated budget of
$125,000. This budget encompasses various components essential for the execution of the project,
including but not limited to:
i. Design and Fabrication: The selected artist/team will conceptualize and create a durable,
interactive playable artwork that invites community engagement.
ii. Footing collaboration: Collaborating with Fayetteville’s selected engineering and construction
firms to create and install the footing for the artwork (the footing itself will be a cost borne by
the city of Fayetteville outside of the art budget, not to exceed $30,000).

iii. Interactivity and Play: The artwork must invite physical interaction, be highly visible, and safely
designed for long-term outdoor use.
iv. Installation: The artist/team will coordinate with Fayetteville's landscape architects and
construction firm for seamless installation within the allocated project budget.
b. Key Deliverables:
i. Phase 1 – Qualifications and Selection
1. Submit proposals to the RFP for review by the selection committee.
2. The selection committee chooses three artists to complete a concept for the space.
ii. Phase 2 – Initial Design & Development:
1. Three (3) Finalists are chosen to present a concept to the selection committee. Each
finalist receives a design fee of $1,500 to develop a detailed concept proposal.
2. Concept Development: Create artwork designs for review and selection by the RFP
selection committee.
3. Budgeting: Present budget based on the designed concept.
iii. Phase 3 – Contracting, Final Designs and Technical Drawing
1. The City contracts with the specific artist for the interactive art.
2. The selected artist creates final plans for the artwork. Which is reviewed by the project
team, and the Fayetteville Arts Council.
3. Appropriate drawings and drafting are done to prepare for creation.
iv. Phase 4 – Production, Fabrication & Installation:
1. Art Fabrication: Oversee and execute the creation of the agreed upon design.
2. Art Installation & Management: Oversee the installation of the chosen art concept.
3. Programming Ideas: Develop a roadmap for ongoing programming and engagement
activities.
4. QUALIFICATIONS:
Professional artists and teams of artists (national & international) who have experience managing, designing,
and completing site-specific public art commissions with a budget over $50,000 within the past fifteen (15)
years are eligible; or those who can demonstrate equivalent skills and experience. Artists of all backgrounds
are encouraged to participate in the RFP process. We are particularly interested in artists or studios who can:
a. Demonstrate experience in managing similar public art and placemaking projects, especially experience
with interactive, site-specific, and community-focused public art.
b. Provide a strong portfolio showcasing past projects with a focus on community engagement and public
art.

c. Show an ability to design and fabricate durable, engaging interactive outdoor installations.
d. Demonstrate capacity and experience to manage the project within the allocated budget and timeline.
e. Compliance with all local, state, and federal regulations and requirements.
5. TENTATIVE PROJECT TIMELINE:
a. RFP Issuance: 03/09/2025
i. The City of Fayetteville releases the Request for Qualifications (RFQ) to solicit interest from
artists and teams with relevant experience in public and interactive art. This phase includes
broad dissemination of the RFQ and communication with potential applicants.
b. Submission Deadline: 04/03/2025
i. Artists and teams must submit their qualifications by this deadline.
c. Selection of Finalists: 04/11/2025
i. A selection committee reviews all submissions, evaluating each based on artistic quality,
relevance, experience, and alignment with project goals. Up to three finalists are chosen to
advance to the next phase, each finalist receives a design fee of $1,500 to develop a detailed
concept proposal.
d. Art Concept Development Phase: 04/25/2025
i. This phase includes initial designs, sketches, and a preliminary detailed budget estimate.
Finalists may be called on to present their proposals to the selection committee for feedback
and consideration.
e. Selection of Artist or Firm: 05/09/2025
i. The committee evaluates the detailed concept proposals and selects one artist/team to
proceed with the project. This chosen artist/team is awarded the full project commission, with
a budget of $125,000 for completion.
f. Design Finalization: TBD
i. The selected artist/team refines the design based on any additional feedback from the
committee and prepares for fabrication. The design undergoes a technical review by a pre-
selected engineering firm, which will ensure compliance with structural and safety standards
and finalize plans for that engineering firm’s footing installation.
g. Fabrication and Art Installation: TBD
i. The artist/team oversees the fabrication of the artwork, sourcing materials and coordinating
logistics for transportation to the site. The engineering/construction firm installs the footing,
after which the artist/team completes the installation, ensuring it meets all project
specifications.

4. RFP PROPOSAL FORMAT:
The initial proposal response shall contain all sections listed herein and shall respond fully to all requirements
of the RFP. In total, the initial response should be no more than twenty-five (25) pages; single sided, standard
readable, print on standard 8.5 X 11 pages.
a. Part I – Letter of Interest: Please include the following information in a 1 to 2-page letter of interest:
i. Contact Information (name, address, phone number, and website for artist group and/or all
individual artist team members)
ii. Description of interest in working on this project
iii. Description of most relevant comparable projects from the last fifteen years
iv. Description of philosophy on public art and/or creative placemaking
v. In reference to the Selection Criteria section, discuss the artist/team’s eligibility for this
opportunity
b. Part II – Artist Qualifications and Related Project Experience:
i. Submit a minimum of three (3) and up to eight (8) relevant completed artworks and/or
commissions from the last fifteen (15) years. Descriptions should include title, date, location,
media/material, budget, project name, project time frame, client name, and a detailed
description that clearly justifies why the past experience is applicable to this RFP. For each
project, indicate which proposed key individuals worked on the project and describe the
role/work they performed and their levels of involvement.
ii. Submit a resume of the artist/team who will deliver the project.
iii. Submit at least three (3) client references, including name, description of past working
relationship, and current contact information shall be listed for each key individual proposed.
Any applicable professional licenses or certifications shall be listed for each individual. All
known sub- Consultants needed to complete the project (individual or firm) must be identified.
c. Part III – Artist Statement: The Proposal shall include a brief Artist Statement to accompany the
response that speaks to why a work of this nature would be a natural fit within the artist’s body of
work.
5. FINALIST PROPOSAL FORMAT:
Three artists selected as finalists will receive a $1500 design fee to develop a full artwork proposal for the
site. The detailed concept proposal must address all sections listed below and respond fully to the
requirements of the RFP. Proposals should not exceed twenty (20) single-sided pages, on standard 8.5 x 11-
inch pages, using a standard readable font. The following components are required:
a. Part I – Concept Proposal: Provide a detailed description of the proposed artwork, including its artistic
vision, themes, and interactive elements, highlighting how it aligns with the goals of the Upper Ramble,
engages the public, and aligns with the artist’s body of work. Reflect on how the proposed design
embodies the artist’s philosophy on public art and creative placemaking. Include renderings, sketches,
or visual representations that convey the design, along with a description of the materials and
fabrication methods, emphasizing durability, safety, and suitability for long-term outdoor display.

Explain how the artwork integrates with the natural and built environment of Upper Ramble,
addressing its relationship to the space, as well as considerations for visibility, accessibility, and
interaction from multiple perspectives.
b. Part II – Budget and Feasibility: Provide a comprehensive budget breakdown within the $125,000 limit,
detailing costs for design, fabrication, materials, transportation, and installation, and identify any
potential cost-saving measures or alternate solutions. Include a proposed timeline for all project
phases, from design finalization to installation, highlighting key milestones such as fabrication,
coordination with the City, and the final installation. Additionally, address the technical feasibility of
the project by discussing its structural soundness, safety considerations, and how the proposed design
will meet local safety and engineering standards.
7. PRICE PROPOSAL:
a. All proposers are expected to adhere to a Flat Fee Price Proposal with a general breakdown of all costs
of the artwork, including general fabrication and artist fees not to exceed $125,000.
c. Selected finalists will be asked to include a detailed cost breakdown for their specific proposal including
estimated personnel, exclusions, and all labor costs, expenses, overhead, and profit. Finalists will
provide a payment schedule based on project milestones/deliverables. These deliverables will be
confirmed during contract negotiations with the chosen consultant.
6. CONTRACT FORMATION:
If the negotiation produces mutual agreement, a contract will be considered for approval by the City of
Fayetteville City Council. If negotiations with the highest-ranking Proposer fail, negotiations may be initiated
with the next highest-ranking Proposer until an agreement is reached. The City reserves the right to reject all
offers and end the process without executing a contract.
7. SELECTION CRITERIA:
The following criteria will be used by the City to evaluate and score responsive proposals. Proposers shall
include sufficient information to allow the City to thoroughly evaluate and score the proposal. Each proposal
submitted is not required to be ranked by the selection committee. The contract may be awarded to the
most qualified firm, per the evaluation criteria listed below, based on the evaluation of the selection
committee. Following the evaluation of the proposals, the Selection Committee may request that the top-
ranking firm(s) make an oral presentation or be interviewed. If presentations are necessary, they will take
place in Fayetteville, Arkansas. Notices will be sent by the Purchasing Division.
1) 25% Qualifications in Relation to Specific Project: A selection of past artwork in portfolio format
should accompany the RFP response. Information reflecting qualifications (including
experience and technical competence) of the artist, collaborators and major personnel
assigned to this specific project should be included. The integration of the artists’ past
work, portfolio and proposed concept with the context of the site will also be evaluated.
2) 25% Experience, Competence, and Capacity for Performance: the artist’s or team’s ability to
successfully complete the project based on their demonstrated history of executing similar
work. It considers experience in public art, large-scale installations, or other relevant

budgets, and coordination with stakeholders to ensure successful completion.
3) 20% Proposed Method of Doing Work: A proposed work plan (description of how the project
would be conducted as well as other facts concerning approach to scope) indicating
methods and schedules for accomplishing scope of work. Include with this the amount of
work presently underway. Finalists will be evaluated on the Artistic Vision and Concept as
part of this criteria.
4) 20% Past Performance: Past performance with similar projects, particularly with the City or
other municipalities, will be a significant consideration. This includes previous work quality,
adherence to schedules, communication, diligence, and overall project outcomes.
References and examples of similar past projects will be reviewed to gauge reliability and
consistency in delivering successful public art installations. Artist will provide a list of similar
jobs performed and person whom the City can contact for information.
5) 10% Cost/Fees: Those submitting for consideration should feel confident that they can deliver
an artwork of the scale and quality sight by the city for the $125,000 budget. Specific art
proposals for the site are not required until three finalists are selected.
