A RESOLUTION TO RENEW AND EXTEND THE CONTRACT FOR SANITARY SEWER SERVICE
BETWEEN THE CITIES OF JOHNSON AND FAYETTEVILLE, ARKANSAS
WHEREAS, fifteen years ago the cities of Johnson and Fayetteville, Arkansas agreed to a fifteen (15) year Sanitary
Sewer Service Contract; and
WHEREAS, both cities have faithfully performed all contractual requirements for the last fifteen (15) years and now
desire to renew and extend this contract under the same terms and conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby agrees to extend the 2010 fifteen year
contract for Sanitary Sewer Service Contract between the cities of Johnson, Arkansas and Fayetteville, Arkansas for an
additional fifteen (15) years under the same terms and conditions and authorizes Mayor Rawn to execute this fifteen
(15) year Sanitary Service Service contract extension.

SUBJECT: Contract Renewal for Sanitary Sewer Service between the Cities of Johnson,
Arkansas and Fayetteville, Arkansas
RECOMMENDATION:
Staff recommends the approval of a Contract Renewal for Sanitary Sewer Service between the Cities of
Johnson, Arkansas and Fayetteville, Arkansas.
BACKGROUND:
The City of Fayetteville owns and operates sewer collection systems within portions of the corporate city limits
of Johnson, Arkansas. The sewer system includes approximately 1.2 miles of public sewer main, along with
associated service connections, manholes, and related infrastructure.
The most recent agreement for sewer services was established on July 6th, 2010 and is set to expire after 15
years. City of Fayetteville Resolution 119-10 memorialized this agreement.
DISCUSSION:
Fayetteville has long accepted and treated wastewater from Johnson customers under the terms of the existing
contract, which Johnson has honored fully.
Renewing the sewer service contract for another 15-year term serves the best interests of both cities and their
residents. No adjustments have been made to the original 2010 contract language.
The renewed agreement will be effective until 2040 unless terminated per the contract terms.
