A RESOLUTION TO RENEW AND EXTEND THE CONTRACT FOR ENHANCED WATER SERVICE
BETWEEN THE CITIES OF JOHNSON AND FAYETTEVILLE, ARKANSAS
WHEREAS, fifteen years ago the cities of Johnson and Fayetteville, Arkansas agreed to a fifteen (15) year Enhanced
Water Service Contract; and
WHEREAS, both cities have faithfully performed all contractual requirements for the last fifteen (15) years and now
desire to renew and extend this contract under the same terms and conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby agrees to extend the 2010 fifteen year
contract for Enhanced Water Service Contract between the cities of Johnson, Arkansas and Fayetteville, Arkansas for
an additional fifteen (15) years under the same terms and conditions and authorizes Mayor Rawn to execute this fifteen
(15) year Enhanced Water Service contract extension.

SUBJECT: Contract Renewal for Water Service between the Cities of Johnson, Arkansas and
Fayetteville, Arkansas
RECOMMENDATION:
Staff recommends the approval of a Contract Renewal for Water Service between the Cities of Johnson,
Arkansas and Fayetteville, Arkansas.
BACKGROUND:
The City of Fayetteville owns and operates water distribution systems within portions of the corporate city limits
of Johnson, Arkansas. The water system currently includes approximately 2.2 miles of public water main, and
associated service connections, valves, hydrants, and meters.
The most recent agreement for water services was established on July 6th, 2010 and is set to expire after 15
years. City of Fayetteville Resolution 118-10 memorialized this agreement.
DISCUSSION:
Fayetteville has consistently provided water service to Johnson in accordance with the existing contract, and
Johnson has properly performed its contractual obligations.
Both cities find mutual benefit in renewing the water service contract for another 15-year term. No changes
have been made to the original 2010 contract language.
The renewed contract will remain in effect until 2040, unless terminated according to its provisions.

CONTRACT TO EXTEND THE 2010 CONTRACT FOR ENHANCED WATER
SERVICES BETWEEN THE CITIES OF JOHNSON, ARKANSAS AND
FAYETTEVILLE, ARKANSAS
Comes now, the City of Johnson and the City of Fayetteville who mutually agree that it is
in the best interests of both cities, their citizens, and businesses to extend the 2010 contract for
Enhanced Water Service between the cities of Johnson and Fayetteville for an additional fifteen
(15) year period under the identical terms and conditions of the original 2010 contract.
This fifteen (15) year renewal of the Enhanced Water Services contract shall be effective
upon both cities' City Councils' approval by Resolution of this fifteen (15) year extension and the
execution of this contract extension by both Mayors.
