HomeMy WebLinkAbout140-25 RESOLUTION113 West Mountain Street Fayetteville, AR 72701 (479) 575-8323 Resolution: 140-25 File Number: 2025-683 A RESOLUTION TO AUTHORIZE AN AGREEMENT WITH THE ARKANSAS DEPARTMENT OF PARKS, HERITAGE AND TOURISM FOR AN OUTDOOR RECREATION GRANT PROGRAM IN THE AMOUNT OF $150,000.00 AS A 50/50 MATCHING GRANT FOR IMPROVEMENTS TO WALKER COMMUNITY PARK AND TO APPROVE A BUDGET ADJUSTMENT WHEREAS, on August 6, 2024, City Council passed Resolution 199-24 that granted permission to apply for a $250,000.00 matching grant from the Arkansas Department of Parks, Heritage and Tourism Outdoor Recreation Grant Program (ORGP); and WHEREAS, in December 2024, Fayetteville received a partial award of $150,000.00; and WHEREAS, the ORGP's partial award was limited to removing and replacing Walker Park's southeastern playground, which is the second oldest playground in the Park System and is nearing the end of its life span; and WHEREAS, the new, accessible playground will benefit children, parents, and guardians of all abilities and will continue to support the heavily used area of the park for picnics and events; and WHEREAS, the playground renovation is one portion of a larger improvement project to Walker Park Phase 1 improvements based on the 2023 Walker Park Master Plan, which is partially funded by the 2019 bond. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Rawn to sign an agreement with the Arkansas Department of Parks, Heritage and Tourism for an outdoor recreation grant program in the amount of $150,000.00 as a 50150 matching grant for improvements to Walker Community Park and further authorizes Mayor Rawn to sign any additional documents necessary to receive the funds. Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of which is attached to this Resolution. PASSED and APPROVED on June 17, 2025 Approved: N(ib -�O� Attest: � ............... q4i U m- FAYETTEVILLE,A Molly Rawn, Mayor Kara Paxton, City Clerk Treasurer Page 1 MATCHING GRANT STATEMENT OF AGREEMENT STATE OF ARKANSAS DEPARTMENT OF PARKS, HERITAGE, AND TOURISM STATEMENT OF AGREEMENT Project No. A-10878-25-WA Granting Agency: Arkansas Department of Parks, Heritage, and Tourism The State of Arkansas, represented by the Director of the Outdoor Recreation Grants Program, Arkansas Department of Parks, Heritage and Tourism (hereinafter referred to as "Grantor") and the applicant named above (hereinafter referred to as "Applicant") mutually agree to perform this agreement in accordance with the terms, promises, conditions, plans, specifications, estimates, procedures, project proposals, maps, and assurances attached hereto. Grantor hereby promises, in consideration of promises by Applicant herein, to obligate to Applicant the amount of money referred to above, and tender to Applicant that portion of the obligation which is required to pay Grantor's share of costs relative to project stage, based upon percentage of assistance and contingent upon receipt of those funds per Arkansas Act 729 of 1987. Applicant hereby promises, in consideration of promises made by Grantor herein, to execute the project or project stage(s) described above in accordance with the terms of this agreement. To ensure full reimbursement, Applicant must not deviate from the scope of the project without concurrence of Grantor. Should any condition(s) in the agreement change, e.g., change in project scope, deletion or addition of item(s), or extension of project period, Applicant will submit to Grantor for approval a formal request for project amendment. Applicant agrees to follow, to the best of Applicant's knowledge and abilities, all rules, laws, and/or regulations applicable to Applicant's agreed -upon project as those rules, laws, and/or regulations are enforced by local, state, and/or federal authority under whose jurisdiction Applicant operates. Applicant also agrees to comply with the requirements of the Arkansas Department of Parks, Heritage, and Tourism, including rules, laws, and/or regulations that may pertain to lawful dispersal of public monies by Grantor. Applicant understands that willful or egregious disregard for rules, laws, and/or regulations applicable to Applicant's project and jurisdiction may result in forfeiture of reimbursement, either in part or in full, and/or disqualification from future consideration, either temporarily or perpetually, of public monies dispersed by Grantor under Grantor's funding mandate. Upon completion of project, Applicant agrees to erect a permanent sign acknowledging the funding assistance provided by the Arkansas Natural and Cultural Resources Grant and Trust Fund (ANCRGT), and to bury all new utility lines at ANCRGT-funded project sites, including ANCRGT-assisted property acquisitions. Applicant agrees to be responsible for in perpetuity maintaining. as public outdoor recreation, the project area shown on attached Project Boundary Map. Applicant hereby agrees to and accepts the responsibilities and obligations set out herein, as does Grantor. Applicant further understands, agrees, and accepts that this agreement is not effective until said agreement has been duly executed by Grantor and Applicant notified accordingly, and no development is to be initiated and/or invoiced by Applicant prior to receipt of said notification. BACKGROUND: Staff was granted permission to apply for a $250,000 award from the ORGP's matching grant in August 2024 with Resolution 199-24. Fayetteville received a partial award of $150,000 in December 2024. While Fayetteville applied for several improvements, the ORGP's partial award was limited to removing and replacing Walker Park's southeastern playground, which is the second oldest playground in the Park System and is nearing the end of its life span. The new, accessible playground will benefit children, parents, and guardians of all abilities and will continue to support the heavily used area of the park for picnics and events. The playground renovation is one portion of a larger improvement project to Walker Park Phase 1 improvements based on the 2023 Walker Park Master Plan, which is partially funded by the 2019 bond. DISCUSSION: Construction is expected to begin in Summer 2025. Parks Staff will manage construction progress and ensure all grant requirements are met. BUDGET/STAFF IMPACT: The ORGP matching grant requires a 50/50 match. Fayetteville will match the $150,000.00 grant award with $150,000.00 in funds from 2025 project funds. ATTACHMENTS: 3. That clerical or scrivener's error was not repeated in the body of the Resolution. A second scrivener's error occurred when the Resolution referred to Bryce Davis Community Park for which the City also sought an outdoor recreation grant. Unfortunately, the State did not award that grant, but only the grant for Walker Park. Thus, it was also a scrivener"s error when the Resolution referred to Bryce Davis Community Park. Therefore, all references to Bryce Davis Community Park, as well as the "Giving Tree" grant program, were scrivener's errors not affecting the grant provider, nor amount of the grant, nor how this grant will be used, nor the budget adjustment, nor any Whereas Clause. Attached is the corrected Resolution with all scrivener"s errors corrected. Unless a Council Member objects during the Agenda Session, I recommend that this agenda item's Resolution be changed administratively to correct these scrivener's errors so that this item can remain on the Consent Agenda with the correct Resolution. If any Council Member believes these corrections need to be made by a formal amendment motion during the City Council meeting, that Council member should remove this item from the Consent Agenda.
