IN THE AMOUNT OF $31,278.75 PLUS ANY ADDITIONAL FREIGHT CHARGES AND DELIVERY FEES, AND TO APPROVE A BUDGET ADJUSTMENT WHEREAS, on March 4, 2025, City Council approved Resolution 69-25 that waived competitive bidding and approved the purchase of one excavator attachment with accessories from ACME Trenchless Inc; and WHEREAS, Water Sewer has been renting one while their initial expansion is awaiting final assembly and delivery; and WHEREAS, a second custom-made attachment will allow existing water sewer mini -excavators to pull old PE lines out of the ground while pulling in new copper -coated water lines without digging up the existing roads, which will reduce labor and equipment run time costs and will allow the newly approved Water Sewer Construction crew to replace water lines at a substantially lower cost to the city; and WHEREAS, there are only two known manufacturers of this type of product and the Pipe Puller from Acme Trenchless provides the only solution for removing pipes with a 2-inch diameter; and WHEREAS, the City is receiving a lower price on this second pipe puller based upon rental fees paid to date. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the requirements of formal competitive bidding and authorizes the purchase of one excavator attachment with accessories from ACME Trenchless Inc. in the amount of $31,278.75 plus any additional freight charges and delivery fees. Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of which is attached to this Resolution. BACKGROUND: This unbudgeted expansion (WSEW_F084) for the Water Sewer Department is to be exactly like the expansion Pipe Puller approved with the FY25 budget and approved March 4, 2025 with City Council Resolution 69-25 presented with a bid waiver. Water Sewer has been renting one for a few months while their initial expansion is awaiting final assembly and delivery. ACME will be quoting a lower price on this second pipe puller based upon rental fees paid to date. DISCUSSION: This custom-made attachment will allow existing water sewer mini -excavators to pull old PE lines out of the ground while pulling in new copper -coated water lines behind without digging up the existing roads. This will reduce labor, equipment run time costs and allow the newly approved Water Sewer Construction crew to replace water lines at a substantial savings to the city. According to the Water Sewer Department, the City has approximately 800-1000 2-inch service lines and the ACME Trenchless would be the only puller capable of repairing these water lines. Lastly, the ACME was the only product capable of pulling up to 120' of 2-inch lines; the other product would only be capable of 80' pulls of 1-inch lines. BUDGET/STAFF IMPACT: A budget adjustment is attached for your approval. This item was unanimously approved by the Equipment Committee on April 8th.
