To : Fayetteville City Council Members From: The Landlord Association of Arkansas Our organization represents hundreds of landlords and thousands of rental units in Arkansas. We have property, an interest in property or members and their tenants who may be affected by your policy decisions. It has come to our attention, your efforts to regulate and control residential rental business in Fayetteville has the potential to interfere with regular economic activities and further affect affordability in your area. While some fees are fixed on the front end, many others are variable, subjective and applied, as needed, throughout the lease. Anything in writing would reflect a worst case (highest cost) scenario to be applied in every case, rather than allowing a landlord or manager any flexibility or subjective determination at the time the fees need to be applied. We understand there have been issues and instances regarding fees accepted for rental units when there are no units available. This is NOT common practice and laws regarding fraud should be brought in full force upon those who choose to commit the offense. The unintended consequence of additional regulation always has the same effect. This regulation will increase the cost and time required to rent a unit, it will eliminate the ability or willingness to deviate from the maximum "advertised" charges, and ultimately increase the cost of rental units in Fayetteville, which at its core is the source of this debate. The principle at work in this situation is that demand exceeds supply. I ask you to consider lower barriers to entry, easy permitting and a unit / dwelling friendly policy that would incentivize the supply of residential units in Fayetteville. The cost of dwellings will stabilize if the council chooses to enact sound policy rather than forceful regulation.
