CITY OF ELKINS SEWER SERVICE AGREEMENT (AMENDMENT NO. 1):
A RESOLUTION TO APPROVE AMENDMENT NO. 1 TO THE 15 YEAR CONTRACT FOR SANITARY SEWER
SERVICE BETWEEN THE CITIES OF ELKINS AND FAYETTEVILLE
WHEREAS, Fayetteville has treated wastewater for the City of Elkins for over 40 years and the sewer service contract
was extended on September 7, 2021 for another 15 years; and
WHEREAS, Elkins is now completing construction of a new, higher -capacity sewer pumping station that will be
capable of sending more flow to Fayetteville than the current collection system can handle, making upgrades necessary
at Fayetteville's Mally Wagnon sewer pumping station; and
WHEREAS, Elkins has agreed to limit pumping flowrates to similar rates as the legacy lift station until Fayetteville
can upgrade the Mally Wagnon sewer lift station.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Rawn to sign
Amendment No. 1 to the contract for sanitary sewer service with the City of Elkins. A copy of Amendment No. 1 is
attached to this Resolution and made a part hereof.

Staff recommends approval of Amendment No. 1 to the fifteen -year agreement between the City of Fayetteville
and the City of Elkins to treat Elkins' wastewater in Fayetteville's Wastewater Treatment Facility and discharge
treated effluent under Fayetteville's National Pollution Discharge Elimination System (NPDES) permit.
BACKGROUND:
Fayetteville has treated Elkins' wastewater for over 40 years. The most recent renewal of this contract was in
2021 via Resolution 220-21. Elkins is now completing construction of a new, higher -capacity sewer pumping
station that will be capable of sending more flow to Fayetteville than the current collection system can handle.
Upgrades at Fayetteville's Mally Wagnon sewer pumping station located on Norman Murphy road will be
necessary.
DISCUSSION:
Until such time that Fayetteville can upgrade Mally Wagon sewer lift station, Elkins has agreed to limit pumping
flowrates to similar rates as the legacy lift station could pump, namely 660 gallons per minute peak flowrate.
This amendment memorializes this restriction to allow Fayetteville to design and construct improvements at
Mally Wagnon lift station.
BUDGET/STAFF IMPACT:
None.

AMENDMENT TO CONTRACT FOR SANITARY SEWER SERVICE BETWEEN THE
CITIES OF ELKINS, ARKANSAS AND FAYETTEVILLE, ARKANSAS
CONTRACT AMENDMENT NO.
This Contract Amendment No. 1 ("Amendment"), effective on the date last written below, shall amend
the original contract (City of Fayetteville Resolution 220-21) between the City of Fayetteville, Arkansas,
a municipal corporation, hereinafter referred to as ("Fayetteville") and the City of Elkins, Arkansas, a
municipal corporation, hereinafter referred to as ("Elkins") dated September 7, 2021 referred to in the
following paragraphs as the "Agreement."
This Amendment adds provisions for sanitary sewer service between Fayetteville and Elkins.
The Agreement is hereby modified to add the following:
WHEREAS, Elkins is upgrading wastewater collection facilities, including a new wastewater lift station,
forcemain and gravity sewer. Elkins flows to Fayetteville shall not exceed 660 gallons per minute until
capacity upgrades are implemented at Fayetteville's downstream Lift Station 19 located at 5716 E.
Norman Murphy Road. Preliminary engineering has been completed for the upgrades to Lift Station 19
(larger pumps and associated electrical and backup power), and design is underway by Fayetteville's
engineering consultant. The Elkins Lift Station will be programmed so that no more than one pump will
run at one time and the pump speed will be set not to exceed 660 gallons per minute until downstream
capacity at Lift Station 19 is upgraded. Construction is underway at the Elkins lift station to add
temporary storage, initially at 100,000 gallons, for peak wet weather flows until downstram capacity at
Lift Station 19 is upgraded. The temporary storage was required and was approved by the Arkansas
Department of Health to allow continued growth in Elkins until Lift Station 19 is upgraded.
Terms and conditions of the Agreement not modified herein remain unchanged and in full force and effect.
