AN ORDINANCE TO APPROVE VAC-25-01 FOR PROPERTY LOCATED AT 1278 WEST VAN ASHE DRIVE
IN WARD 2 TO VACATE 0.06 ACRES OF SANITARY SEWER EASEMENT
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions thereof
which are not required for corporate purposes;and
WHEREAS, the City Council has determined that the following described portion of sanitary sewer easement is not
required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of sanitary sewer
easement as described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the ongoing condition that any damage to or relocation of existing
facilities will be at the property owner/developer's expense.

An easement vacation of part of a 20-foot-wide sanitary sewer easement dedicated per
easement plat 24-435, said easement vacation being a part of the West Half (W 1/2) of the
Southwest Quarter (SW 1/4) of the Northwest Quarter (NW 1/4) of Section 27, Township 17
North, Range 30 West, Washington County, Arkansas, and said easement vacation being more
particularly described as follows:
Commencing (POC) at the Southwest corner of the W 1/2 of the SW 1/4 of said NW 1/4,

SUBJECT: VACATION-2025-0001: (1278 W. VAN ASCHE DR./LISA ACADEMY HIGH SCHOOL,

RECOMMENDATION:
Staff recommends approval of VAC-2025-0001 as shown in the attached Exhibits 'A' and '13% and with the
following condition of approval:
1. Any damage or relocation of existing facilities will be at the property owner/developer's expense;
BACKGROUND:
The subject property is in north Fayetteville, northeast of the intersection of S. McGuire St. and W. Van Asche
Dr. The property is zoned C-2, Thoroughfare Commercial, and contains approximately 9.18 acres. It is
currently developed with a 46,000-squre foot elementary school and associated parking known as Lisa
Academy (LSD-2021-000044). A large-scale development for a 71,800-square-foot middle and high school
and associated parking was approved by the Planning Commission on August 26, 2024 (LSD-2024-0016).
Request: The applicant proposes to vacate a portion of a sanitary sewer easement along W. Van Asche Dr.
that was dedicated in 1994.
DISCUSSION:
City of Fayetteville staff recommend in favor of the requested easement vacation. The applicant submitted all
necessary franchise utility approvals without objections. Any new easements necessary for the construction of
the proposed school will be dedicated through an associated easement plat.

RE: Utility Easement Vacation Request for Lisa Academy High School
City Council,
Please accept this Utility Easement Vacation request for the Lisa Academy High School
development located at 1278 W Van Asche Dr in Fayetteville. This Utility Easement Vacation
request is to remove a portion of the existing City of Fayetteville sanitary sewer utility easement
dedicated to the City of Fayetteville. The existing utility easement is located approximately 41
feet north of the Van Asche Dr right-of-way, with the Utility Easement Vacation area in question
being approximately 2,633 sq ft. The intent of this request is to allow the utility easement to be
more correctly aligned with a proposed sewer main routing traversing the subject property to
facilitate connection of an adjacent property to the City's public infrastructure.

We, the undersigned, being all the owners of the real estate abutting the easement hereinafter
sought to be abandoned and vacated, lying in the 27-17-30 Fayetteville Outlots, City of
Fayetteville, Arkansas, a municipal corporation, petition to partially vacate a utility easement
which is as follows:
EASEMENT VACATION DESCRIPTION:
An easement vacation of part of a 20-foot-wide sanitary sewer easement dedicated per

many years, and that the public interest and welfare would not be adversely affected by the
abandonment of the portion of the above -described easement.
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above -
described real estate, subject, however, to existing easements as required, and that the above -
described real estate be used for their respective benefit and purpose as now approved by law.
The petitioners further pray that the above -described real estate be vested in the abutting property
owners as provided by law.
