IN THE AMOUNT OF $56,087.74 PLUS ANY ADDITIONAL FREIGHT CHARGES AND DELIVERY FEES WHEREAS, a custom-made attachment will allow existing water sewer mini -excavators to pull old PE lines out of the ground while pulling in new copper -coated water lines behind it without digging up the existing roads; and WHEREAS, this will reduce labor, equipment run time costs and allow the newly approved Water Sewer Construction crew to replace water lines at a substantial savings to the city; and WHEREAS, there are only two known manufacturers of this type of product and the Pipe Puller from Acme Trenchless provides the only solution for removing pipes with a 2-inch diameter; and WHEREAS, this item was unanimously approved at the Equipment Committee meeting on December 10, 2024. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the requirements of formal competitive bidding and authorizes the purchase of one excavator attachment with accessories from ACME Trenchless Inc. in the amount of $56,087.74 plus any additional freight charges and delivery fees. (PURCHASE AGREEMENT): RECOMMENDATION: COUNCIL APPROVES A RESOLUTION TO WAIVE COMPETITIVE BIDDING AND PURCHASE (1) EXCAVATOR ATTACHMENT WITH ACCESSORIES FOR $56,087.74 WITH ANY ADDITIONAL FREIGHT CHARGES AND DELIVERY FEES FROM ACME TRENCHLESS INC. OF RIPON WISCONSIN. BACKGROUND: This custom made attachment will allow existing water sewer mini -excavators to pull out old PE lines out of the ground while pulling in new copper -coated water lines behind it without digging up the existing roads. This will reduce labor, equipment run time costs and allow the newly approved Water Sewer Construction crew to replace water lines at a substantial savings to the city. The unit will be an expansion, unit 9363 (WSEW_F120). DISCUSSION: Both Fleet Operations and the Water Sewer Department received a demo of this attachment and were able to use it in the field. It successfully removed and replaced multiple lines with the training and assistance of ACME Trenchless field reps who came on site and allowed the City to use and prove the Equipments capabilities. This was originally brought to purchasing to put out a bid. However, as the bidding process unfolded, it was apparent with only (2) known manufacturers of this product and interested parties, Purchasing chose to approve a sole source/waive of competitive bidding for the Pipe Puller from Acme Trenchless with the justification that they provide the only solution for removing pipes with a 2-inch diameter. Just for some additional background, according to the Water Sewer Department the City has approximately 800-1000 2-inch service lines and the ACME Trenchless would be the only puller capable of repairing these water lines. Lastly, the ACME was the only product capable of pulling up to 120' of 2-inch line; the other product would only be capable of 80' pulls of 1-inch line. BUDGET/STAFF IMPACT: This expansion item came in under budget and was approved with the passage of the FY25 budget. This item was unanimously approved at the Equipment Committee on December 10th.
