West Transmission Waterline Updates Utilities Engineer Corey Granderson will provide updates to the Committee on this project. INFORMATION ONLY 3. Amendment to Elkins Sewer Service Contract Fayetteville has treated Elkins’ wastewater for over 40 years. The most recent renewal of this contract was in 2021 via Resolution 220-21. Elkins is now completing construction of a new, higher-capacity sewer pumping station that will be capable of sending more flow to Fayetteville than the current collection system can handle. Upgrades at Fayetteville’s Mally Wagnon sewer pumping station located on Norman Murphy road will be necessary. Until such time that Fayetteville can upgrade Mally Wagon sewer lift station, Elkins has agreed to limit pumping flowrates to similar rates as the legacy lift station could pump, namely 660 2 gallons per minute peak flowrate. This amendment memorializes this restriction to allow Fayetteville to design and construct improvements at the Mally Wagnon lift station. Staff recommends approval of Amendment No. 1 to the fifteen-year agreement between the City of Fayetteville and the City of Elkins to treat Elkins’ wastewater in Fayetteville’s Wastewater Treatment Facility and discharge treated effluent under Fayetteville’s National Pollution Discharge Elimination System (NPDES) permit. STAFF REQUESTS THIS BE FORWARDED TO THE CITY COUNCIL FOR CONSIDERATION FOR APPROVAL NEW BUSINESS: 4. Nabholz Bid Award for Phase II of the I-49 & MLK Utility Relocation Project The Arkansas Department of Transportation has requested utility relocations to prepare for roadway widening along MLK Blvd. from Leflar Way to East of I-49. The scope consists of 920 LF of 36-inch, 20 LF of 30-inch, 355 LF of 24-inch, 4,400 LF of 18-inch, 3,500 LF of 8-inch, 20 LF of 6-inch, and 25 LF of 2-inch water mains complete with appurtenances (Total 9,240 ft.), as well as 260 LF of 24-inch, 595 LF of 15-inch, 345 LF of 10-inch, 625 LF of 8-inch, and 632 LF of 4-inch sewer mains complete with appurtenances (Total 2,457 ft.). On February 25th, 2025 the City of Fayetteville accepted sealed competitive bids for the I- 49/MLK Interchange Utility Relocations Phase II project (ArDOT Project 040846). Nabholz Construction Corp. submitted the only bid of $13,967,679.50. This price is within 1% of the engineer’s opinion of probable construction costs. This project is 72.54% reimbursable ($10,132,154.71) to the City of Fayetteville by ARDOT as memorialized by Resolution 294-24. Staff recommends awarding Bid #25-29 and approving a construction contract with Nabholz Construction Corp. in the amount of $13,967,679.50 for construction of water and sewer utility relocations associated with ArDOT Project 040846. Staff recommends approval of a 3.6% project contingency in the amount of $500,000.00. STAFF REQUESTS THIS BE FORWARDED TO THE CITY COUNCIL FOR CONSIDERATION FOR APPROVAL 5. Drake Field Waterline Cost Share The City of Fayetteville operates a 12-inch diameter water main that runs under a corner of airport taxiway at Drake Field. This line had a major failure and repair in 2023 that disrupted airport function and put the communities of Greenland and West Fork at risk of extended water outages. This waterline is a single feed south of Fayetteville towards those communities and other unincorporated areas. Drake Field is planning a waterline improvement project near some of the existing hangar areas. The water/sewer department sees this as an opportunity to partner with that project to relocate a portion of this 12-inch waterline outside the object-free restriction areas and the taxiway pavement area. Bids are scheduled to be opened on March 11th, and Airport staff would shepherd the project through to the City Council at a future date. Updates on the bid opening and anticipated project cost and timeline will be delivered at the Committee meeting. 3 STAFF REQUESTS THIS BE FORWARDED TO THE CITY COUNCIL FOR CONSIDERATION FOR APPROVAL 6. Baxter 1-MG Water Tank Rehab On February 12, 2025 the City of Fayetteville accepted sealed competitive bids for this project. Utility Service Co., Inc. submitted the lowest bid. All bids are shown here: Utility Services Co., Inc. $734,900.00 Viking Painting, LLC $765,892.00 Preferred Sandblasting and Painting $779,260.00 Maguire Iron, Inc. $795,000.00 Dixie Painting & Sandblasting $833,500.00 Classic Protective Coatings, Inc. $867,900.00 This project will remove and replace the interior and exterior coatings on the 1-million-gallon Baxter Water Tank. While the coating systems are removed, upgrades to safety climbing systems will be made to align with modern standards. Tank mixing will be added to improve circulation by using an active mixer placed inside the tank. Staff recommends awarding Bid #25-23 and approving a construction contract with Utility Service Co., Inc. in the amount of $734,900.00 for painting and rehabilitation of the 1-million- gallon Baxter Ground Water Storage Tank. Connecting Sewer Outside City Limits Section 51.113(C) of the Sewer Use Ordinance states that “the city's sewerage system shall not be extended outside the city's corporate limits except on the express approval of the City Council. Contract Amendment No. 1 1 of 2 Contract for Sanitary Sewer Services Between the Cities of Elkins, AR and Fayetteville, AR AMENDMENT TO CONTRACT FOR SANITARY SEWER SERVICE BETWEEN THE CITIES OF ELKINS, ARKANSAS AND FAYETTEVILLE, ARKANSAS CONTRACT AMENDMENT NO. 1 This Contract Amendment No. 1 (“Amendment”), effective on the date last written below, shall amend the original contract (City of Fayetteville Resolution 220-21) between the City of Fayetteville, Arkansas, a municipal corporation, hereinafter referred to as (“Fayetteville”) and the City of Elkins, Arkansas, a municipal corporation, hereinafter referred to as (“Elkins”) dated September 7, 2021 referred to in the following paragraphs as the “Agreement.” This Amendment adds provisions for sanitary sewer service between Fayetteville and Elkins. The Agreement is hereby modified to add the following: WHEREAS, Elkins is upgrading wastewater collection facilities, including a new wastewater lift station, forcemain and gravity sewer. Elkins flows to Fayetteville shall not exceed 660 gallons per minute until capacity upgrades are implemented at Fayetteville’s downstream Lift Station 19 located at 5716 E. Norman Murphy Road. Preliminary engineering has been completed for the upgrades to Lift Station 19 (larger pumps and associated electrical and backup power), and design is underway by Fayetteville’s engineering consultant. The Elkins Lift Station will be programmed so that no more than one pump will run at one time and the pump speed will be set not to exceed 660 gallons per minute until downstream capacity at Lift Station 19 is upgraded. Construction is underway at the Elkins lift station to add temporary storage, initially at 100,000 gallons, for peak wet weather flows until downstram capacity at Lift Station 19 is upgraded. The temporary storage was required and was approved by the Arkansas Department of Health to allow continued growth in Elkins until Lift Station 19 is upgraded. Terms and conditions of the Agreement not modified herein remain unchanged and in full force and effect. (2) To sustain and expand the municipal sewer system the city shall assume the expense of treating the waste water together with the operation and maintenance of the collection lines and appurtenances. (3) Construction of major collection lines shall be made in accordance with sewer system improvement and expansion programs and plans adopted by the City Council to better serve existing customers and to make the sewer system available to new customers and land development. Priorities for such improvement and extension shall be established by the City Council on the basis of need and the city's financial ability. (B) Extensions to and Within Subdivisions. The cost of extending sewer lines from existing mains to subdivisions and other land developments and the cost of constructing sewerage facilities within subdivisions as prescribed in subdivision regulations and according to specifications and location prescribed by the Water and Wastewater Director shall be the financial responsibility of the developer; however, the city shall pay the excess material cost of facilities of a size larger than required to serve subdivisions when such excess size is specified and required by the Water and Wastewater Director for the general benefit of the sewerage system. All sewer facilities financed by the developer shall become the property of the city after inspection and acceptance by the Water and Wastewater Director. (C) Sewer Extensions Outside the City. Except for facilities needed to serve property within the city's limits, such as major transmission lines and pump stations to deliver sewage to disposal sites, and except through contractual arrangements with other municipal corporations, the city's sewerage system shall not be extended outside the city's corporate limits except on the express approval of the City Council.
