ENSURING HEALTH AND FIRE SAFETY FOR SHORT-TERM RENTERS (RESOLUTION):
A RESOLUTION TO REQUEST THE ARKANSAS LEGISLATURE ALLOW CITIES TO ENSURE HEALTH
AND FIRE SAFETY FOR SHORT-TERM RENTERS AND COMPATIBILITY FOR SINGLE FAMILY
RESIDENTIAL NEIGHBORHOODS
WHEREAS, as opposed to long term or monthly renters, out of town tourists or visitors do not have a
reasonable opportunity to physically walk through a short-term rental to ensure it meets health and fire safety
standards including adequate fire exits and alarms before having to pay to rent it; and
WHEREAS, such an out of town tourist or visitor should, like a hotel or motel guest, be protected from an unsafe or
unhealthy overnight accommodation, especially regarding necessary fire exits, smoke alarms, etc. by allowing initial
health and safety inspections by cities; and
WHEREAS, single family neighborhoods should remain reasonably protected from incompatible structures and hotel -
like uses that could lower neighboring homes' property values and endanger the peace, health or safety of neighboring
homeowners and long term tenants.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby requests that the Arkansas Legislature
continue to allow cities to conduct initial health and fire safety inspections of short-term rentals because their tenants do
not have a long-term renter's ability to physically walk through and inspect a house for such health and safety concerns
before paying the rent.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby requests that the Arkansas Legislature
protect the American Dream of Home Ownership by authorizing planning commissions composed of local citizens to
determine whether a proposed short-term rental within a single family neighborhood would be incompatible in that
neighborhood or would endanger the peace, health and safety of the neighbors.
