AN ORDINANCE TO AMEND § 110.03 SMALL CELL FACILITIES AND NETWORKS; § 116.02 DOOR TO
DOOR SOLICITATION; AND § 118.02 ENTRY UPON BUSINESS REGISTRY AND ISSUANCE OF BUSINESS
LICENSE TO IMPLEMENT FEE CHANGES RECOMMENDED BY THE CITY'S RECENT USER FEE STUDY
WHEREAS, Fayetteville has a long and well -established history of charging user fees for a number of City services,
including those associated with development review; and
WHEREAS, in February 2023 the City Council approved a contract with MGT for an updated user fee study whose
core objectives include evaluating and improving the current fee structure, defining the cost of City services, and
recommending fees based on the cost of service; and
WHEREAS, MGT completed the review -related services, the hourly rates of staff providing those services, and the
time providing each service in six areas that include Building Safety, Business Licensing, Engineering, Fire, Planning,
and Water & Sewer; and
WHEREAS, the most prominent finding of the study is a significant discrepancy between the cost of services provided
and the user fees charged, totaling approximately $2,679,307.00 and for those fees associated with small cell facility
reviews, door-to-door solicitor permits, and business licenses, the recovered cost of the service and associated materials
varied between 15% and 63%; and
WHEREAS, on July 2, 2024 the City Council passed Resolution 182-24 expressing its intent to implement the study's
findings; and
WHEREAS, the proposed amendments to § 110.03, Small Cell Facilities and Networks; § 116.02, Door to Door
Solicitation; and 118.02, Entry Upon Business Registry and Issuance of Business License include an increase by 1/3rd
of the recommended fee amount; and
WHEREAS, implementation of the new fees will require manual entry by staff and, therefore, staff has proposed a
staggered rollout during which time users may be charged the previous fee or the updated fee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends the fees set forth in the following
subsection of Section 110.03, Small Cell Facilities and Networks as follows:

Section 3: That the City Council of the City of Fayetteville, Arkansas hereby repeals subsection (C) of § 118.02, Entry
Upon Business Registry and Issuance of Business License and enacts a replacement § I I8.02(C) as follows:
"(C) Fees. Fees shall be imposed, as set forth below, to cover a portion of the cost of expenses incurred in
connection with the processing of applications.

the fees provided in Sections 1, 2, and 3 so that those fees shall not exceed the amounts set forth in those sections for a
period of two weeks after the effective date of this Ordinance. At the end of the two week period, those fees shall be set
at the amounts set forth in Exhibit A.

SUBJECT: Administrative Item: (Amend Chapter 110 — Telecommunication Franchise,
Billposting, and Small Cell Facilities and Networks, Chapter 116 - Door to Door
Solicitation, and Chapter 118 - Business Registry and Licenses): Submitted by CITY
STAFF. The proposed code change will amend chapters of Title XI, Business
Regulations to modify the existing fee schedule and fees.
RECOMMENDATION:
City staff recommend approval of an amendment to Chapter 110, Telecommunication Franchise, Billposting,
and Small Cell Facilities and Networks, Chapter 116 Door to Door Solicitation, and Chapter 118 Business
Registry and Licenses as described in Exhibit `A'.
BACKGROUND:
The City has a long and well -established history of charging user fees for a number of City services, including
those associated with development review. Documentation from as early as the 1980s indicates codified fees
for project classes that are still familiar today: lot splits, preliminary plats, large scale developments, and
others. In mid-1991, a formal user fee study was initiated. Following a change in the form of Fayetteville's form
of municipal government between 1991 and 1992, implementation was delayed, with only portions adopted in
the mid-1990s.
Subsequently in 2003, Council approved a contract for a second user fee study. This recommended fees that
accurately reflect the cost of services. During the same period, Council adopted a user fee policy which include
among its tenets the evaluation of user fees on a three-year cycle, an annual adjustment of fees based on the
All Urban Consumer Price Index, fees that "should be levied fairly and equitably and properly to account for the
benefit received by each user", and a standard that "Development charges (annexation, rezoning, lot split,
construction plan review, infrastructure, stormwater, etc.) shall recover 100% of the full cost of providing the
services unless reduced or waived by City Council." Despite the user fee study's proposal and the policy's
adoption, no discernable action was taken, with many fees from 2024 remaining as they existed in 2004.
In the intervening years, several new development fees were introduced or saw one-off changes as additional
services were offered or specific issues of recovery were identified, but no concerted study of development
review fees occurred.
More recently, in February 2023 the City Council approved a contract with MGT for an updated user fee study.
Core objectives of the study include evaluating and improving the current fee structure, defining the cost of City
services, and recommending fees based on the cost of service.

MGT completed a review of City development review -related services, the hourly rates of staff providing those
services, and the time providing each service in six areas. These include Building Safety, Business Licensing,
Engineering, Fire, Planning, and Water & Sewer. The most prominent finding of the study is a significant
discrepancy between the cost of services provided and the user fees charged, totaling approximately
$2,679,307. For those fees associated with small cell facility reviews, door-to-door solicitor permits, and
business licenses, the recovered cost of the service and associated materials varied between 15% and 63%.

This information along with the larger user fee study was shared with the City Council at their June 25th
Agenda Session, after which a resolution was adopted at the Council's July 2nd meeting expressing intent to
implement the study's findings (attached; Resolution 182-24).
DISCUSSION:
The proposed amendment to Chapter 110, Telecommunication Franchise, Billposting, and Small Cell
Facilities and Networks includes an increase by 1/3rdof the recommended fee amount to mitigate
potential customer shock following approximately 20 years without change
o Increases vary from $7.00-$67.00
o Wireless facilities on city -owned poles will decrease by $90.00
The proposed amendment to Chapter 116 Door to Door Solicitation includes an increase by 1/3rd of the
recommended fee amount
o Increases vary from $7.00-$33.00
• The proposed amendment to Chapter 118 Business Registry and Licenses includes an increase by
1/3rd of the recommended fee amount
o New licenses increase by $4.00-$37.00
o Renewals decrease by $5.00-$15.00
Recognizing the scope of the changes proposed in the overall user fee study, staff is recommending a
staggered implementation of fees, with those proposed herein to be effective two weeks after the effective date
of this ordinance.
BUDGET/STAFF IMPACT:
The City will be reimbursed for more of its costs in providing municipal services. 2023-2024 revenue data
suggest potential additional recovery of $100,000 to $120,000.

110.03 Small Cell Facilities and Networks
(J) Application Fees and Annual Rates.
(1) Applicants shall submit a fee in the amount of $167.00 for each small wireless facility proposed to be
installed on an existing wireless support structure or pole.
(2) Applicants shall submit a fee in the amount of $267.00 for the installation, modification, or
replacement of a pole together with the collocation of an associated small wireless facility in the right-
of-way.
(3) Providers shall pay an annual rate of $70.00 per small wireless facility for use of the public right-of-way.
(4) Providers shall pay an annual rate of $150.00 per small wireless facility that is collocated on a city -
owned pole.

116.02 Door To Door Solicitation At Private Residence
(C) Principal Permit. No peddling or solicitation shall be conducted within the city without a principal permit
being issued. The cost for the principal to obtain a solicitor/peddler's permit is $77.00, and shall be paid to
the business office before any peddling or soliciting is conducted within the city. The permit shall expire on
December 31 in the year the permit is issued. In addition to the principal's permit, the principal must also
comply with the city's business license requirement pursuant to Chapter 118: Business Registry and License
of the Fayetteville Code. To obtain a permit, a representative of the principal shall provide a written, signed
application stating:
(D) Permit for Peddlers/Solicitors. In addition to the principal permit, each peddler or solicitor acting for the
principal shall also obtain a permit from the Planning Department before peddling or soliciting within the
city. The cost to obtain a peddler/solicitor permit is $12.00. In applying for the permit, each applicant shall
provide the following to the Planning Department:

110.03 Small Cell Facilities and Networks

WHEREAS, implementation of the new fees will require manual entry by staff and, therefore.
staff has proposed a staggered rollout during which time users may be charged the previous
fee or the updated fee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTE-
VILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville. Arkansas hereby amends the fees
set forth in the following subsection of Section 110.03, Small Cell Facilities and Networks
as follows:
§110.03(J)(1): replace S100.00 with 5167.00
§110.03 (J)(2): replace 5250.00 with $267.00
§110.03 0)(3): replace 530.00 with S70.00
§110.03 0)(4): replace S240.00 with $150.00
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby amends the fees
set forth in the following subsection of § 116.02, Door to Door Solicitation as follows:
(C): replace 540.00 with S77.00
(D): replace S5.00 with S12.00
Section 3: That the City Council of the City of Fayetteville. Arkansas hereby repeals subsec-
tion (C) of § 118.02, Entry Upon Business Registry and Issuance of Business License and
enacts a replacement § 118.02(C) as follows:
"(C) Fees. Fees shall be imposed. as set forth below. to cover a portion of the
cost of expenses incurred in connection with the processing of applications.

Section 4: That the City Council of the City of Fayetteville. Arkansas authorizes staff to stagger
the implementation of the fees provided in Sections 1. 2, and 3 so that those fees shall not
exceed the amounts set forth in those sections for a period of two weeks after the effective
date of this Ordinance. At the end of the two week period, those fees shall be set at the
amounts set forth in Exhibit A.
