AN ORDINANCE TO AMEND § 172.05 (A)(2)
AN ORDINANCE TO AMEND § 172.05 (A)(2) FOR THE REQUIRED PARKING FOR
RESIDENTIAL DEVELOPMENTS TO EMPOWER THE PLANNING COMMISSION TO LOWER
THE MINIMUM PARKING REQUIREMENTS IN APPROPRIATE SITUATIONS
WHEREAS, the tenants of large apartment buildings may adversely affect a neighborhood if sufficient
off-street parking or additional new on-street parking is insufficient to protect the parking availability
needs of current neighbors; and
WHEREAS, the Planning Commission should be able to analyze the current parking availability and
sufficiency in a neighborhood near the proposed new apartment building to determine if any reductions
in the minimum parking requirements should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby repeals (2)(a)(i), (ii), and
(iii) of § 172.05 (A)(2) and enacts the following replacements (2) (a)(i) and (ii) as follows:
§ 172.05 (A)(2)(a) Reductions for Residential Use
The Planning Commission may grant a variance from the minimum number of parking spaces
required in Table 3 for residential use if the commission determines that sufficient on-street parking
spaces will remain reasonably available for the surrounding neighborhood after construction of the
apartment building even if the minimum number of required off-street parking spaces for residential use
is reduced by some or all of the possible reductions listed in (i), (ii), and (iii).
1. Transit Stops. If the proposed apartment building is within three hundred (300) yards walking
distance on city right-of-way to a transit stop which is continually served by public busses every
thirty minutes or less from 6:30 a.m. through 6:30 p.m. every Monday through Friday, the
Planning Commission may reduce the minimum number of parking spaces by as much as 15%.

1. Motorcycle and Powered Scooter Spaces, and Bicycle Racks. If the developer places a limitation
on its Large Scale Development or other development permit that a certain number of its tenants
will be continually prohibited from bringing a four wheeled road vehicle into Fayetteville, then
the Planning Commission may reduce the minimum required residential parking spaces by one
for every such tenant by constructing a motorcycle/powered scooter space for every such tenant
up to a maximum of a 10% reduction and up to another 5% reduction for such tenants by
providing two bicycle rack parking spaces for each vehicle parking spot reduction.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby re-letters § 172.05 (A)(2
(iv) to (iii) and repeals § 172.05 (A)(2)(iv)(3) Shared Spaces.
