AN ORDINANCE TO APPROVE VAC-24-26 FOR PROPERTY LOCATED AT 3145 EAST JOYCE BOULEVARD
IN WARD 3 TO VACATE 0.25 ACRES OF STREET RIGHT-OF-WAY
WHEREAS,the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions thereof
which are not required for corporate purposes;and
WHEREAS,the City Council has determined that the following described portion of street right-of-way is not required
for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville,Arkansas hereby vacates the portion of street right-of-way
as described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the following conditions:
1. Any damage to or relocation of existing facilities will be at the property owner/developer's expense.
2. An easement shall be dedicated to cover the existing buried facilities along East Joyce Boulevard as requested
by AT&T.
3. A 30-foot-wide utility easement shall be dedicated along existing overhead lines as requested by Ozarks
Electric.
4. Approval of this right-of-way vacation is contingent upon the completion of the associated extension of Joyce
Boulevard and acceptance by the City.

SUBJECT: VAC-2024-0026: Vacation (3145 E. JOYCE BLVD./WOODLAND JR HIGH, 177):
Submitted by JORGENSEN & ASSOCIATES for property located at 3145 E. JOYCE
BLVD. in WARD 3. The property is zoned P-1, INSTITUTIONAL and contains
approximately 27.92 acres. The request is to vacate a portion of street right-of-way
totaling 0.25 acres.
RECOMMENDATION:
City staff and the Planning Commission recommend approval of VAC-2024-0026 as shown in the attached
Exhibits 'A' and 'B', and with the following conditions of approval:
1. Any damage or relocation of existing facilities will be at the property owner/developer's expense,
2. An easement shall be dedicated to cover the existing buried facilities along East Joyce Boulevard as
requested by AT&T,
3. A 30-foot-wide utility easement shall be dedicated along existing overhead lines as requested by
Ozarks Electric, and
4. Approval of this right-of-way vacation is contingent upon the completion of the associated extension of
Joyce Boulevard.
BACKGROUND:
The subject property is located northeast of the intersection of Joyce Boulevard and Crossover Road. It
contains one parcel totaling 27.92 acres which is currently developed with a single-family home and associated
agricultural outbuildings that were constructed in the late 1970s. The property received its current zoning
designation of P-1, Institutional as a result of a rezoning that was approved earlier this year (RZN-2024-0024).
Additionally, Fayetteville Public Schools acquired the property this year, with plans to develop it as the future
location of Woodland Junior High School. Mud Creek, a protected stream, flows east to west along the
southern boundary of the property and lies within a Zone A floodplain with no established floodway or base
flood elevations. A large scale development for a new alignment of Joyce Boulevard, which would bisect the
property, was submitted concurrently with this request (LSD-2024-0031) and approved by the Planning
Commission on December 9, 2024.
Request: The applicant proposes to vacate portions of excess right-of-way along Joyce Boulevard totaling 0.25
acres. Vacating the right-of-way, as requested, would reduce the width of the right-of-way along the subject

property's frontage to 22.5 feet, which aligns with the Master Street Plan requirement for a Residential Link
Street with no on -street parking.
DISCUSSION:
City of Fayetteville staff recommends in favor of the requested right-of-way vacation. A new segment of Joyce
Boulevard is proposed to be constructed on the subject property, in line with the future street connection
depicted in City Plan 2040's Master Street Plan. Following the construction and opening of that new segment
of Joyce, staff finds that this platted right-of-way will no longer continue to serve a public purpose, since it
would not be required to improve the street to meet Master Street Plan standards, and supports its vacation.
At the December 9, 2024 Planning Commission meeting, this item was forwarded to City Council with a
recommendation of approval by a vote of 9-0-0. Commissioner Castin made the motion and Commissioner
Payne seconded it. Commissioner Werner made a motion to amend the motion to add a condition that would
make the approval of this item contingent upon the completion of the associated extension of Joyce Boulevard
(LSD-2024-0031). That motion was seconded by Commissioner Garlock and approved with a vote of 6-3-0.
The added condition has been included as the fourth condition of approval noted above.

Proposal: The applicant proposes to vacate portions of excess right-of-way along Joyce
Boulevard totaling 0.25 acres. Vacating the right-of-way, as requested, would reduce the width of
the right-of-way along the subject property's frontage to 22.5 feet, which aligns with the Master
Street Plan requirement for a Residential Link Street with no on -street parking.
DISCUSSION:
City of Fayetteville staff recommends in favor of the requested right-of-way vacation. A new
segment of Joyce Boulevard is proposed to be constructed on the subject property, in line with
the future street connection depicted in City Plan 2040's Master Street Plan. Following the
construction and opening of that new segment of Joyce, staff finds that this platted right-of-way

Public Comment: Staff has not received any direct comments from the public; however, the

One individual suggested that additional turn lanes should be added at the intersection with
Crossover, while another proposed blocking access to Valerie Drive from Joyce. No comments
were received that explicitly opposed the requested right-of-way vacation.
RECOMMENDATION: Staff recommends forwarding VAC-2024-0026 to City Council with the

AN ORDINANCE TO APPROVE
VAC-24-26 FOR PROPERTY LO-
CATED AT 3145 EAST JOYCE
BOULEVARD IN WARD 3 TO VA-
CATE 0.25 ACRES OF STREET
RIGHT-OF-WAY
WHEREAS, the City Council
has the authority under A.C.A. §
14-54-104 to vacate public
grounds or portions thereof
which are not required for cor-
porate purposes; and
WHEREAS, the City Council
has determined that the follow-
ing described portion of street
right-of-way is not required for
corporate purposes.
NOW, THEREFORE, BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1:That the City Coun-
cil of the City of Fayetteville,
Arkansas hereby vacates the
portion of street right-of-way as
described in Exhibit B attached
to the Planning Department's
memo.
Section 2: A copy of this Ordi-
nance duly certified by the City
Clerk along with the map at-
tached as Exhibit A to the Plan-
ning Department's memo shall
be filed in the office of the
Washington County Circuit
Clerk.
Section 3: This vacation ap-
proval is subject to the following
conditions:
1. Any damage to or reloca-
tion of existing facilities will be
at the property owner/devel-
oper's expense.
2. An easement shall be ded-
icated to cover the existing
buried facilities along East
Joyce Boulevard as requested
by AT&T.
3. A 30-foot-wide utility ease-
ment shall be dedicated along
existing overhead lines as re-
quested by Ozarks Electric.
4. Approval of this right-of-
way vacation is contingent upon
the completion of the associ-
ated extension of Joyce Boule-
vard and acceptance by the City.
