COMMENTS CONCERNING AGENDA ITEMS
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends Rule A.7.d. of the Rules of
Order and Procedure of the Fayetteville City Council by enacting a new subsection d.(3) as follows:
"(3) City Council Members Discussion and Question Procedures.
During initial staff and applicant presentations, each council member may have one turn to ask either
applicant and/or staff questions with no time limit. After public comments, council members are allowed two turns
each to ask questions or make final comments. If a motion to amend the agenda item is seconded, each council
member shall have one turn to comment on or ask questions about the proposed amendment. All city council turns for
comments or questions are limited to five (5) minutes for each council member."

ARKANSAS:

We have missed the January 7xh agenda cut-off date. You can either walk this on at the Agenda Session on
Monday or we can place it on the January 21" Agenda. The January 7ch agenda is very long as you have probably seen,
but it is your decision where to place your items.

RE: Limitation of City Council Comments and Questions on Agenda Items
Council Member Teresa Turk has suggested City Council Members'
question and comment periods be limited to three periods of three minutes each
per agenda item which would be the same as required by the City of Rogers City
Council rules. Attached is the Rogers City Council provision.
Attached is Council Member Turk's proposed Resolution and a copy of the
current rule.

presenter shall each be limited to a maximum of ten (10) minutes unless the City Council
by unanimous consent or majority vote allows additional time.
(2) Public Comments. Public comment at a City Council meeting shall be allowed on all
items of unfinished and new business and subjects of public hearings. Amendments may
receive public comments only if approved by the City Council by unanimous consent or
majority vote. Speakers present in the City Council Chambers shall be recognized before
speakers participating by electronic means. Speakers shall be limited to a maximum of
three (3) minutes to discuss the agenda item or amendment being considered by the City
Council. The City Council may allow a speaker additional time by unanimous consent or
majority vote. As part of a person's public comments allowed above, the speaker may
use electronic visual aids during their three (3) minutes presentation period concerning
the agenda item being considered by the City Council.
e. Courtesy and Respect. All members of the public, all city staff and elected officials shall
accord the utmost courtesy and respect to each other at all times. All shall refrain from
comments that are harassing or amount to a personal attack against any identifiable individual
including abusive comments and derogatory remarks about integrity or offer any other
comments that are also not limited to the discussion of the specific agenda item being considered
by the City Council. Any member of the public who violates these standards shall be ruled out
of order by the Mayor, must immediately cease speaking and shall leave the podium.
8. Smoking Prohibited.
There will be no smoking allowed in the City Council Chambers during City Council meetings.
9. Cell Phones and Pagers.
Cell phones must be turned off or put in silent mode and not used within the City Council Chambers
during City Council meetings. Pagers must be turned off or put in silent mode within the City
Council Chambers during City Council meetings. These restrictions also apply during Agenda
Sessions.
10. Virtual City Council Meetings Authorized
After proper notice has been provided to the public, City Council Members are authorized to
assemble, gather, meet, and conduct open public meetings (including speaking, voting and passing
ordinances and resolutions) through appropriate electronic means which ensure the public's right
to attend by being able to listen to the proceedings and discussions. These open public meetings
include City Council meetings and agenda sessions as well as City Council Member Committee
meetings.
City Council Members Attendance In -Person and Virtually
City Council members attendance at the City Council meeting is recorded and attendance rates are
included on the City of Fayetteville website. At the onset of Covid-19, member participation and voting
virtually, such as Zoom was permitted. Virtual attendance and voting will be limited to two meetings per
calendar year. Members are allowed to participate by virtual means for more than two meetings, but any
vote after two virtual meetings will not be counted.

or staff questions. After public comments, members are allowed two turns to ask question or make final
comments. Comments are limited to 3 minutes each.

RE: Proposed Revision of City Council Members Discussion and Question
Procedures
Pursuant to requests of Council Members during the Agenda Session, I
have drafted and attached a modified procedural rule for your consideration. I
first heard that the Council wished to delay all their comments until after public
comment. The original language actually did this as the Council Members were
allowed "one term to ask either applicant or staff questions." (emphasis added).
There is no provision to authorize City Council Member comments at this time.
Council Members also wanted a proposed amendment to the agenda item
(resolution, ordinance, or exhibit) to authorize Council Members a comment
period with the same limitation (3 minutes) as the other question or comment
periods. This comment period is in addition to the single three -minute question
period for the staff or applicant and the two question or comment periods after
public comment.
Resolutions are normally effective upon the passage by the City Council
and approval by the Mayor as shown by her signature of the passed resolution.
Therefore, there is no need to try to alter your procedure during the January 7th
meeting. All amendments will be effective for the January 21st meeting.
