AN ORDINANCE TO APPROVE VAC-24-25 FOR PROPERTY LOCATED AT 639 WEST MARTIN LUTHER
KING JR BOULEVARD IN WARD 1 TO VACATE 0.08 ACRES OF UTILITY EASEMENT
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions thereof
which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of utility easement is not required
for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of utility easement as
described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the following conditions:
1. Any damage to or relocation of existing facilities will be at the property owner/developer's expense; and
2. This vacation will take effect after the building served by the existing fire hydrant has been demolished.

acres. The request is to vacate 0.08 acres of utility easement.
RECOMMENDATION:
Staff recommends approval of this item as shown in the attached Exhibits 'A' and 'B', and with the following
conditions of approval:
1. Any damage or relocation of existing facilities will be at the property owner/developer's expense, and
2. This vacation will not take effect until after the building served by the existing fire hydrant has been
demolished.
BACKGROUND:
The subject property is located in central Fayetteville, on the south side of W. Martin Luther King Jr. Blvd.
between Hill and Lt. Col. Leroy Pond Avenues to the west and east respectively. The property is owned by the
University of Arkansas, and is developed with several existing, new, and under construction structures
associated with the University's arts district. The property is zoned 1-1, Heavy Commercial and Light Industrial,
and is not part of an overlay.
Request: The applicant has applied to vacate 0.08 of utility easement which bisect this property.
DISCUSSION:
City staff recommend in favor of the requested easement vacation, with the conditions listed above. The
applicant has submitted all necessary approvals with no objections.

To: The Fayetteville City Planning Commission
On behalf of the landowners, I am petitioning the Fayetteville City Planning Commission to accept the waterline
easement vacation of the waterline easement located at 639 W. MLK JR BLVD, parcel number 765-13012-000, in the
City of Fayetteville, Arkansas.
This property is currently the University of Arkansas School of Art Annex and will be the future home of the
University of Arkansas Windgate Galleries.
By accepting this waterline easement vacation request, the current owners would benefit, and no other landowner
would be adversely affected.
The public interest and welfare would not be adversely affected by accepting this waterline easement vacation request.

required, and that the above -described real estate be used for their respective benefit
and purpose as now approved by law.
The petitioners further pray that the above -described real estate be vested in the
abutting property owners as provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of
the City of Fayetteville, Arkansas, abandon and vacate the above described real
estate, subject to said water easements, and that title to said real estate sought to be
abandoned be vested in the abutting property owners as provided by Law, and as to
that particular land the owners be free from the easements of the public for the use of
said water.
