A RESOLUTION TO AUTHORIZE THE CITY ATTORNEY'S OFFICE TO FILE A PUBLIC NUISANCE
LAWSUIT AGAINST THE OWNERS OF PROPERTY LOCATED AT 887 SOUTH LIEUTENANT COLONEL
LEROY POND AVENUE IN THE CITY OF FAYETTEVILLE
WHEREAS, the conditions on the property owned by Richard Tiffany and Gladys Tiffany and located at 887 S. Lt.
Col Leroy Pond Ave., Fayetteville AR 72701 have become so unsafe, unsanitary and disruptive such that it constitutes
a public nuisance; and
WHEREAS, there has been extensive criminal activity on and around the property, perpetrated by those residing on
the property against others on the property and neighbors; and
WHEREAS, citizens have lodged numerous complaints regarding the crime on the property, the debris, the smell,
harassment by the residents, and the overall property conditions; and
WHEREAS, while responding to a recent fire on the property, the Fayetteville Fire Department observed
overoccupancy, trash, rotting stairs, and other unsafe conditions and determined that the property is extremely
dangerous for occupants and firefighters in the case of a subsequent fire; and
WHEREAS, other avenues of abating the nuisance on the property, including prosecuting the property owners for code
violations in Fayetteville District Court, have not resolved the issues; and
WHEREAS, the City of Fayetteville is vested with the authority to eliminate public nuisances and may do so by filing
a nuisance lawsuit with the Washington County Circuit Court; and
WHEREAS, filing a public nuisance lawsuit is necessary to protect the health and safety of neighbors to the property,
its current residents, and the public at large.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby declares the property located at 887 South
Lieutenant Colonel Leroy Pond Avenue, Fayetteville, Arkansas 72701 to be a public nuisance and authorizes the
Fayetteville City Attorney's Office to file a public nuisance lawsuit against Richard and Gladys Tiffany, owners of the
property, to abate the nuisance.

Due to a medical procedure, I will be unavailable to sign documents or attend meetings starting
November 11th, 2024. 1 plan to be back in the office as of November 25th, 2024. Senior Deputy City
Clerk Treasurer Jackson Shelton or Deputy City Clerk — Codifier Courtney Spohn will notify you
should these dates change.
The recommended recovery time for my medical procedure (Spinal Cord Stimulator Implant) ranges
from 4 to 8 weeks. The surgeon stated that I must be off work for at least one week. The surgeon also
encouraged me to utilize telework options in the weeks following the initial surgery week. He also
stated that should I need to physically come to work, I need to park as close to the building as
possible, no lifting/carrying heavy or large objects, and no sudden twisting or turning.
In my absence, I authorize Senior Deputy City Clerk Treasurer Jackson Shelton to attest your (Mayor
Lioneld Jordan) signature. Should an issue arise that Mr. Shelton is not available to sign within a 24-
hour timeframe, I authorize Deputy City Clerk — Codifier Courtney Spohn to sign in our absence.
As the official custodian of the City's seal, I authorize Mr. Shelton and Ms. Spohn to use the seal for
official purposes only.
Please direct city staff to route all Alcohol Permits to Mr. Shelton for review and electronic signature.
Please notify the Accounting Department that check requests will be reviewed and signed by Ms.
Spohn before being emailed to the Accounting Department. Ms. Spohn will also be responsible for
approving purchase requests submitted November 11th — November 15th, 2024.
Mr. Shelton and Ms. Spohn will go above and beyond to ensure that our office continues to support
all our internal and external customers while I am out of office. Over the last 3 years Ms. Spohn has
continuously demonstrated her professionalism and advanced skillset in her positions. Mr. Shelton
has been with our office for almost 2 years now and has consistently impressed me by going above
and beyond in his work duties. I am confident that Mr. Shelton and Ms. Spohn will successfully

RECOMMENDATION:
The City Attorney's Office recommends that Fayetteville declare the property at 887 South Lieutenant Colonel
Leroy Pond Avenue, Fayetteville, Arkansas 72701 to be a public nuisance and requests that the Fayetteville
City Council authorize the City Attorney's Office to file a public nuisance lawsuit against the property owners in
Washington County Circuit Court.
BACKGROUND:
On September 15, 2024, the Fayetteville Fire Department was dispatched to a fire at 887 S. Lt. Col. Leroy
Pond Ave., Fayetteville, AR 72701. This property is owned by Richard and Gladys Tiffany and has been the
subject of repeated code violations, neighbor complaints, and illegal activity. The fire originated in a shed near
the house on the property, and it took 800 gallons of water to extinguish. The Fire Department entered the
house to check for smoke and was alarmed at the condition of the premises. Firefighters noted excessive
occupancy, extensive debris, rotting steps, and ultimately found the occupancy and condition of the house
"extremely dangerous for occupants and firefighters in the case of a fire."
The City has long been aware of exterior issues with the property and its occupants, including illegal camping,
trash, extensive criminal activity, etc. The City has prosecuted the owners of the property for several code
violations in recent years, including operating an illegal campground on the property, to which the owners pled
guilty in 2023. The Fire Department has responded to the property 52 times since 2022, and the Police
Department has responded more than 276 times in the same timeframe for a variety of disturbances, property
crimes, drug offenses, trespasses, two stabbings, and a breaking and entering. The Fire Department's report
has now revealed that these dangers extend to the interior of the property as well.
DISCUSSION:
The City is vested with the authority to eliminate public nuisances and may do so by filing a nuisance lawsuit in
Circuit Court. A nuisance, by legal definition, is "conduct within a municipality that unreasonably interferes with
the use and enjoyment of lands of another, including conduct on property which disturbs the peaceful, quiet,
and undisturbed use and enjoyment of nearby property." By filing a public nuisance lawsuit against the
property owners, the City may ask the Court to prohibit occupancy of the premises, pending further
investigation. The City Attorney's Office believes this has become necessary to protect neighbors and even
occupants of the property. More information is available in the attached memorandum.

When a� code violation occurs on a property, the City will normally contact the
owner to seek voluntary compliance and correction of the problem. If an owner does not
voluntarily comply and correct the code violation - and if additional attempts at
obtaining compliance are unsuccessful - the City Prosecutor's Office will file a criminal
violation in Fayetteville District Court. This prosecution was required in 2022 and 2023
when there was illegal camping at 887 South Lieutenant Colonel Leroy Pond Avenue,
Fayetteville, Arkansas, which adjoins the United States Cemetery.
Prosecution, even in District Court, can be a lengthy process. This was no
exception, and several extensions were granted to the property owners to correct the
violation. Eventually, the owners pleaded guilty to operating an illegal campground on
the property and promised corrective action. Although the illegal camping was
purportedly stopped - or at least substantially reduced - the property continued to be an
issue for neighbors, as occupants of or visitors to the property continued to commit
crimes against them. Prosecution of the owners for ordinance violations has proven
inadequate to stop what has become a public nuisance.
These circumstances require extraordinary legal measures to protect the public.
The City Attorney's Office believes those measures are necessary now and asks that the
Fayetteville City Council declare the property at 887 S. Lt. Col. Leroy Pond Ave.,

Fayetteville, AR 72701 to be a public nuisance and authorize the City Attorney's Office to
file a public nuisance lawsuit in Washington County Circuit Court.
On September 15, 2024, the Fayetteville Fire Department was dispatched to a fire
at 887 S. Lt. Col. Leroy Pond Ave., Fayetteville, AR 72701. This property is owned by
Richard and Gladys Tiffany and has been the subject of repeated code violations,
neighbor complaints, and illegal activity. Upon arrival, the Fire Department observed
flames and smoke coming from a storage shed located about 10 feet from the house on
the property. The Fire Department evacuated the house and extinguished the flames in
the shed. It took around 800 gallons of water to fully extinguish the fire and all hot spots.
After extinguishing the flames, the Fire Department entered the house to confirm
there was no smoke. The conditions they found were alarming:
• "The main residence showed signs of beyond normal occupancy, such as
improvised blanket walls creating small 'rooms' on the front porch and
living room on the first floor."
• "Doors were missing and in place were blankets draped in doorways.
Trash was found throughout the structure."
• Firefighters "observed multiple rooms and closets that appeared to have
been occupied. 2 rooms were located with soiled bedding. The closets
appeared to have bedding as well and unknown if anyone was using as an
area for sleeping quarters."
• They "took notice of the narrow stairwell and spongy steps due to floor
being rotten."

The shed where the fire had originated contained three beds stacked on top of each
other, cabinets, personal belongings, and trash. The Fire Department also noticed
extensive trash and obstacles throughout the yard. Based on everything witnessed:
"It is L7 Officers opinion that the occupancy and general
condition of the home are extremely dangerous for
occupants and firefighters in the case of a fire."
The Fire Department's discoveries upon legally entering the house confirmed the
need for the City to pursue a public nuisance lawsuit and hopefully permanently abate
this dangerous nuisance property. The City has prosecuted the owners of the property
for various code violations in the past two years, including illegally operating a

campground on the property. See attached photos. The owners pled guilty to this charge
in Fayetteville District Court last year. However, prosecution has not stopped the
repeated criminal activity on the property or - as we now know - the decay of the house's
interior.
Since 2022, the Fayetteville Fire Department has been dispatched to the property
52 times for various reports, including four reports of assault victims (injuries reportedly
arising from being struck in the nose with brass knuckles, being hit in the forehead with
a bike rim, and being stabbed in the foot with a folding knife). A neighboring apartment
complex reported that their security guards have been attacked by those living on the
property at least twice since 2023, including an attempted stabbing. The complex also
reported multiple trespasses, property thefts, and other altercations between those living
on the property and apartment complex staff or residents, many of whom are students.
Since 2022, the Fayetteville Police Department has responded to the property 276
times for disturbances, thefts, drugs, harassment, criminal mischief, trespassing, two
stabbings, and a breaking and entering. This property and the activities occurring
thereupon have long been an issue for the City and its residents, but the safety concerns
of those in the residential structure and those in surrounding areas have made it
imperative for the City to take action.
Arkansas law vests the City with the authority to abate (or eliminate) nuisances.
See Ark. Code Ann. § 14-54-1501; § 5-74-109; § 16-105-402. A nuisance is "conduct within
a municipality that unreasonably interferes with the use and enjoyment of lands of
another, including conduct on property which disturbs the peaceful, quiet, and
undisturbed use and enjoyment of nearby property." Ark. Code Ann. § 14-54-1502.
Additionally, a "public nuisance can exist where the place of business or activities that
occur on the premises constitute a threat to public health and safety." Bashaw v. State, 364
Ark. 272, 277, 219 S.W.3d 146,149 (2005).
Upon filing the case, the City will likely seek an Inspection Warrant authorized by
Ark. Code Ann. § 5-74-109(d) so that Building Safety can legally inspect the premises
which may have become so unsafe, unhealthy, and dilapidated as to justify a
determination by the City Council that a resolution to raze and remove this structure is
warranted. This may be the only permanent solution to the continuing nuisance problem.
One remedy the Court can provide in these situations is a permanent injunction,
preventing the property owners from allowing occupancy of the property in its unsafe
condition. The Fire Department's observations have revealed that such an order is
necessary to protect the occupants of the house, and the history of criminal behavior on
the property has revealed that the order is necessary to protect the community at large.

The City Attorney's Office has coordinated with the Fire Department, the Police
Department, and the Prosecutor's Office to gather information relating to the criminal
infractions on the property, the repeated code violations, and the threats posed to the
public. It now believes it has sufficient evidence to proceed with a nuisance lawsuit.
This is an extraordinary case, in which traditional avenues of prosecution have not
alleviated the extensive code violations and criminal behavior on this property. The Fire
Department's inspection has given us the legal power and solidified the need for
immediate action to protect the community and the occupants of the house. For that
reason, the City Attorney's Office requests that the City Council resolve to declare the
property a public nuisance and authorize the City Attorney's Office to initiate a lawsuit
against the property owners, Richard Tiffany and Gladys Tiffany, to abate the public
nuisance and protect our citizens.

L7 was dispatched to a report of a shed on fire. En route, L7 could see a
heavy dark gray smoke column. On arrival, L7 found a storage shed type
building approximately 10 feet distance from the back side of a 2 story
multi family dwelling. The shed was approximately 12 feet wide by 20 feet
deep. The building was made of common wood frame and siding with a sheet
metal roof. L7 stretched a 250 foot hand line around the south side of the
residence and began extinguishing the fire from the outside, spraying
water on outside structural members and through the open doorway. There
was visible flames throughout the interior and exterior of the building
with heavy smoke above. Occupants of the residence advised it was
unoccupied and only used as a storage building. L7 continued spraying
water on all sides of the building, removing exterior siding to reach the
seat of the fire from the outside. As conditions improved, L7 made entry
and completed extinguishment and overhaul from the interior. Inside, L7
found bed frames and mattresses, approximately 3 beds stacked on top of
each other, in the center of the building. Other contents were difficult
to identify but occupants of the residence stated there were cabinets,
personal belongings, and trash waiting to be disposed of being stored
inside. Fire was extinguished. Occupants stated that they were alerted of
the fire by another resident who was seen throwing a five gallon bucket of

E9 Narrative
E9 was dispatched to 887 Lt. Col Leroy Pond Ave for a structure fire. Upon arrival E9 Captain and FF were
assigned to assist L6 with the evacuation of the structure being threatened by the fire. The fire was
located on the Charlie side of the structure in what appeared to be a shed. There was numerous
amounts of trash in the yard and obstacles throughout. Several residents were standing outside of the
structure. E9 crew made entry on the Bravo side of the structure in a stairwell. At the bottom of the
stairs on the left side of the stairwell was a door with a missing handle. E9 captain informed E9 FF to
force the door. While forcing the door the FF noticed the door to be in disrepair being held solely by a
deadbolt. Upon forcing the door E9 FF observed multiple rooms and closets that appeared to have been
occupied. 2 rooms were located with soiled bedding. The closets appeared to have bedding as well and
unknown if anyone was using as an area for sleeping quarters. E9 Captain made his way to the second
floor he took notice of the narrow stairwell and spongy steps due to floor being rotten. While on the
second floor E9 Captain found multiple bedrooms and bathrooms. Doors were missing and in place were
blankets draped in doorways. Trash was found throughout the structure. No occupants were found
inside the structure by E9 crew. E9 crew exited the structure and informed L6 Captain of all clear.

E1 Narrative
E1 responded to 887 S LT Col Leroy Pond Ave for a structure fire with L7, R1, B2, E9, and L6 at 10:36am
on 9/15/2024. Upon going in route E1 switched to ops channel 30 and noted L7 arriving on scene, taking
command and confirming there was a large shed fire in the back of the property near the primary
structure. R1 arrived on scene and established command and E1 arrived on scene shortly after. E1 noted
a hydrant across the street approximately 30ft from L7 apparatus and noted to command they would
have water supply for assignment. FF Stevens and FF Kinzler went to the hydrant and began flushing it
and getting it ready for use. Command advised that a hydrant was more than likely not needed and DO
Trowbridge and FF Steven were reassigned to RIT in the front yard of the primary structure. Several
Occupants of the structure awaited outside in the front yard. DO Hutchens of L7 radioed to notify fire
attack that they were at % tank of water. FF Kinzler of E1 then assisted DO Hutchens with shuttling water
from E1 tank to L7 to continue firefighting operations. The shed was completely burned and required
additional water to extinguish hot spots found by fire attack crews. FF Kinzler then attached to the
hydrant and refilled E1 tank water. Fire Attack then called to command noting the fire was out and that
crews could be released from the scene. All crews with the exception of L7 and R1 were released by
command. E1 crew proceeded to retrieve their equipment use and made their apparatus operational
before switching to back to Channel A and returning to service.

Ladder 6 was assigned to assist E9 with clearing and adjacent structure to the fire structure, Ladder 6 did
a walkthrough of the building and found nothing and reported "All clear" to command and was then
released from the scene as the fire was out.

Batt 1 Notes

Battalion 1 responded along with Engine 1, Ladder 7, Ladder 6, Rescue 1, and Engine 9 to a
report of a building on fire behind the given address. Upon arrival, units reported heavy smoke
and observed a small building in the rear of the home on fire. Ladder 7 arrived first, established
command, and initiated a fire attack.
When Battalion 1 arrived on scene, I assumed command. Rescue 1 made face-to-face contact
with me to relay assignments. Crews reported that water on the fire and that it had been
extinguished. Searches of the fire building confirmed that no victims were found. Along with a
search of the home zero fire extension was found.
I notified dispatch that the fire was out. Crews also advised that the building had no electricity.
Due to the presence of several people in the area upon arrival, I instructed dispatch to contact the
on -duty Fire Marshal to respond. The homeowner arrived after the fire was extinguished, and we
informed him not to enter the fire -damaged building until the Fire Marshal completed the
investigation.
Ladder 7 and Battalion 1 remained on scene until the Fire Marshal arrived, after which the scene
was turned over to their team.

Rescue One Narrative
On September 15, 2024 at 10:36, the Fayetteville Fire Department was dispatched to a structure fire
at 887 South LT Col Leroy Pond Avenue. Rescue One responded from Walmart Neighborhood Market.
Rescue One arrived on -scene with Ladder Seven and assumed Leroy Command. Once we made it to the
rear of the property we found an out building (approximately 10 feet by 20 feet) heavily involved. There
was no extension into the exposure to the east. Rescue One assisted Ladder Seven with fire attack and
search of the out building that was on fire. I had Ladder Six and Engine Nine evacuate the exposure.
Engine One was assigned water supply. Battalion One arrived on -scene and assumed Leroy Command.
Rescue One assisted Ladder Seven with salvage/overhaul operations. Command advised that Rescue
One was no longer needed. Rescue One returned to service.
