ENACT CHAPTER 120.03 (ORDINANCE):
AN ORDINANCE TO ENACT § 120.03 LIMITATIONS ON RENTAL APPLICATION AND BACKGROUND
CHECK FEES
WHEREAS, the Fayetteville City Council recognizes the need to ensure that rental application and background check
fees are fair and reasonable, and to prevent excessive charges that burden prospective tenants; and
WHEREAS, the City Council acknowledges that exorbitant fees can create unnecessary financial barriers for
individuals and families seeking housing; and
WHEREAS, on April 2, 2024, the City Council passed Resolution 117-24 which declared a housing crisis in the City
of Fayetteville; and
WHEREAS, the Council believes it is in the best interest of the community to promote equitable housing practices and
enhance access to affordable housing options; and
WHEREAS, based upon data compiled by Council Member Moore that was provided by landlords/property managers
operating in the City of Fayetteville, and which was presented to the City Council, the City Council determines that
total combined forty dollar ($40.00) limit on application and background check fees is reasonable and will allow
landlords and property managers to recover their actual costs of screening potential tenants; and
WHEREAS, the City Council encourages the use of shared application systems that save prospective residents money
and save landlords time; and
WHEREAS, it is recognized by the City Council that in order to protect the health, safety, and welfare of citizens and
residents of Fayetteville, rules should be set forth reasonably regulating the amounts that can be charged to potential
tenants for application and background check fees.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby enacts § 120.03 Limitations on Rental
Application and Background Check Fees as follows:
"§ 120.03 Limitations on Rental Application and Background Check Fees

A. Definitions:
"Rental application fee" means any fee charged by a landlord or property manager to a potential tenant for the
processing of their rental application.
"Background check fee" means any fee charged by a landlord or property manager to a potential tenant for
conducting background checks including, but not limited to, credit, criminal, and employment history checks.
A one-time fee charged by a service that allows renters to reuse background check results for multiple rental
applications over a period of at least 30 days is exempt, provided no additional rental application fee is charged
directly by the landlord or property manager.
B. Limitation for the total allowed fee for application and background check.
1. A landlord or property manager shall not charge a potential tenant a rental application fee and/or a background
check fee that exceeds forty dollars ($40.00) total for both fees.
2. If a landlord or property manager does not pay for background check for the potential tenant, the maximum
that can be charged for a rental application fee shall be twenty dollars ($20.00).
C. Refunds.
If a landlord or property manager does not perform a background check for a potential tenant after charging a
background check fee, the landlord or manager must refund the fee in full to the potential tenant.
D. Penalty.
Any landlord or property manager who fails to obey any requirement of this section shall be subject to the penalties
permitted pursuant to § 10.99 General Penalty of the Fayetteville Code."
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby determines that this Ordinance shall take
effect 90 days from passage and approval.
Section 3: That the City Council of the City of Fayetteville, Arkansas requests that the Mayor communicate and give
notice to the public and landlords of this change during the delayed effective period and create a pathway to a
successful implementation of this change

BACKGROUND:
The Fayetteville City Council recognizes the need to ensure that rental application and background check fees
are fair and reasonable, and to prevent excessive charges that burden prospective tenants. The City Council
acknowledges that exorbitant fees can create unnecessary financial barriers for individuals and families
seeking housing. On April 2, 2024, the City Council passed Resolution 117-24 which declared a housing crisis
in the City of Fayetteville. The Council believes it is in the best interest of the community to promote equitable
housing practices and enhance access to affordable housing options. Based upon data compiled by Council
Member Moore that was provided by landlords/property managers operating in the City of Fayetteville, and
which was presented to the City Council, the City Council determines that adopting a $20.00 limit on
application fees and a $50.00 limit on background check fees is reasonable and will allow landlords and
property managers to recover their actual costs of screening potential tenants. It is recognized by the City
Council that in order to protect the health, safety, and welfare of citizens and residents of Fayetteville, rules
should be set forth reasonably regulating the amounts that can be charged to potential tenants for application
and background check fees.

RE: Proposed Revision of Original Ordinance to Limit Rental Application
and Background Check Fees
Following concerns stated during the Agenda Session about trying to
require background checks to accepted by subsequent landlords as well as later
information from rental management companies, Council Member Sarah Moore
requested a revision of her proposal. I assisted her in this revision.
Council Member Moore requested that I send to the Mayor and Council
what she will likely request the Council to amend her original proposal which is
on the Agenda to the attached revised Ordinance attached to this memo. The
primary changes were to reduce the total allowed fee from $20.00 for application,
plus $50.00 for any and all background checks, to a $40.00 limit total for both
fees. The other major change would remove requirements for landlords to accept
and use previous background checks ordered by other landlords. That
requirement was legally iffy and so removed.
Please review what would actually be the code section if enacted (Section 1
of Ordinance) for Council Member Moore's final proposal. I appreciate her
proposed removal of the background check reuse provision which I believe was
the most legally suspect provision.

Application and Background
Check Fees as follows:

Rental Application and Back-
ground Check Fees
A.Definitions:
1. "Rental application fee"
means any fee charged by a
landlord or property manager to
a potential tenant for the pro-
cessing of their rental applica-
tion.
2. "Background check fee"
means any fee charged by a
landlord or property manager to
a potential tenant for conducting
background checks Including,
but not limited to,credit,crimi-
nal, and employment history
checks.A one-time fee charged
by a service that allows renters
to reuse background check re-
sults for multiple rental applica-
tions over a period of at least 30
days is exempt,provided no ad-
ditional rental application fee is
charged directly by the landlord
or property manager.
B.Limitation for the total al-
lowed fee for application and
background check.
1.A landlord or property man-
ager shall not charge a potential
tenant a rental application fee
and/or a background check fee
that exceeds forty dollars
($40.00)total for both fees.
