Stephen Carr Memorial Boulevard, City of Fayetteville, Washington County, Arkansas; and WHEREAS, the City Council has determined that a structure located on said property with the address 1909 N. Stephen Carr Memorial Boulevard is dilapidated, unsightly, unsafe, and detrimental to the public welfare; and WHEREAS, Porter & 49 Opportunity Fund LLC; C/O Alex G Miller, having been properly served by sending a Notice of Violation by Certified Mail, Return Receipt Requested to the owner's address of record, and, given thirty (30) days to correct said violations, has failed to repair, or raze and remove said dilapidated, unsightly, and unsafe structure. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That, by the authority granted pursuant to A.C.A. § 14-56-203, and in accordance with the provisions of Section 173.08 of the Fayetteville Code of Ordinances, Porter & 49 Opportunity Fund LLC; C/O Alex G Miller is hereby ordered to raze and remove forthwith the dilapidated, unsightly, and unsafe structure located at 1909 N. Stephen Carr Memorial Boulevard, Fayetteville, Arkansas. The manner of removing said structure shall be: dismantle by hand or bulldozer, and haul all debris to a landfill. Section 2: That, if Porter & 49 Opportunity Fund LLC; C/O Alex G Miller does not comply with this order, the Mayor is hereby authorized to cause the dilapidated, unsightly, and unsafe structure to be razed and removed; and a lien against the real property shall be granted and given the City, pursuant to A.C.A. §14-54-904, for the costs associated therewith. Stephen Carr Memorial Blvd. in Ward 2 RECOMMENDATION: Staff recommends approval of a resolution ordering the Raze and Removal of a dilapidated and unsafe structure located at 1909 N Stephen Carr Memorial Boulevard, and to approve a budget adjustment in the amount of $38,000.00 for the project. BACKGROUND: The subject property is located at 1909 N Stephen Carr Memorial Boulevard, located between 1-49 to the west and the Fayetteville Police Station to the southeast. Staff were notified of the property through an anonymous complaint. Staff inspected the property on 6-6-2024, with the initial inspection revealing an abandoned house. Staff started a raze and removal case for the property on 6-6-2024 and mailed the owner, Alex G Miller of Porter & 49 Opportunity Fund LLC, a notice of violation. A signed certified mail receipt card shows receipt of staff's notice to the property owner. Since receiving the notice, a representative of Porter & 49 Opportunity Fund LLC did communicate with staff. Staff informed the representative that the building needs to be demolished if no repairs are made. While no plans for repairing the structure were shared, the representative mentioned a potential sale of the property by the end of the year. DISCUSSION: This address consists of a single story 1,445 square foot single family dwelling. The structure is unsecured with indications of vagrant activity. The structure is overgrown with vegetation and the roof, soffit, fascia, and siding are deteriorating due to neglect. A staff audit of utilities indicates that the structure does not have electricity or water services. To date no demolition or building permits have been issued or applied for. BUDGET/STAFF IMPACT: If the property owner does not comply with the Raze and Removal order, Raze and Removal costs will be expensed to the current budget. A lien will be placed on the property for the incurred costs. How This Violation Can Be Voluntarily Corrected: 173.08 - Unsafe Buildings/Property Nuisance These properties are in violation of city ordinance 173.08 Unsafe Buildings and Chapter 3 of the 2021 International Property Maintenance Code. Specifically the overgrown grass, and junk and debris that are on the property. Chapter 3 prohibits overgrown grass and junk and debris to reside on property. The grass must be mowed and junk and debris removed to be in compliance. This must be done within 30 days. If this is not corrected within that time frame Code Compliance will either correct the property and forward the cost onto the property owner. or forward the matter onto the city prosecutors office. Possible Penalties: If this violation is not corrected within thirty (30) days from the service of this notice, a Public Hearing will be held for the approval of a raze & removal determination by the City Council. The costs shall be charged to the owner(s) of the property and the city shall have a lien against such property for the costs.
