AN ORDINANCE TO APPROVE VAC-24-15 FOR PROPERTY LOCATED AT 210 WEST RAVENSWOOD
LANE IN WARD 1 TO VACATE A 0.26 ACRE PORTION OF STREET RIGHT-OF-WAY
WHEREAS,the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions thereof
which are not required for corporate purposes; and
WHEREAS,the City Council has determined that the following described portion of street right-of-way is not required
for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of street right-of-way
as described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3: This vacation approval is subject to the condition that any damage to or relocation of existing facilities will
be at the property owner/developer's expense.

SUBJECT: VAC-2024-0015: Vacation (210 W. RAVENSWOOD LN/STARR, 640): Submitted by
SITEWISE CIVIL ENGINEERING PLLC for property located at 210 W. RAVENSWOOD
LN. in WARD 1. The property is zoned RSF-4, RESIDENTIAL SINGLE-FAMILY, FOUR
UNITS PER ACRE and contains approximately 2.02 acres. The request is to vacate
0.26 acres of street right-of-way.
RECOMMENDATION:
Staff and Planning Commission recommend approval of VAC-2024-0015 as shown in the attached Exhibits 'A'
and 'B', and with the following conditions of approval:
1. Any damage or relocation of existing facilities will be at the property owner/developer’s expense;
BACKGROUND:
The subject property is in south Fayetteville, approximately 0.30 mile northwest of the Fayetteville Country
Club, and approximately 0.30 mile east of S. School Avenue. The property immediately adjacent to the subject
right-of-way is zoned RSF-4 and encompasses Lots 145, 146, 147, and 148 of the County Club Estates
Subdivision in. The entire property is located within the Hillside Hilltop Overlay District.
Request: The applicant proposes to vacate 0.26 acres of right-of-way that was platted in 1970 with the Country
Club Estates, Phase 1 subdivision. The right-of-way was intended for development as a cul-de-sac that was
never built and is currently functioning as a portion of the adjacent property owner’s front yard.
DISCUSSION:
City of Fayetteville staff and the Planning Commission recommend in favor of the requested vacation, finding
no public purpose served by the subject right-of-way. Additionally, all required consent documents have been
received and evaluated by City staff with no objections or issues identified. With the right-of-way in question
serving the aforementioned four discrete lots, albeit under the same ownership, the County Assessor will make
the final determination on how the right-of-way is distributed to the adjacent property. The item was placed on
the Planning Commission consent agenda, and no public comment has been received.

documents have been received by City staff with no objections or issues identified. Staff finds that
while the right-of-way in question technically serves 4 lots that are still legal lots of record since
they do not appear to have been formally combined through a property line adjustment, the

RE: 210 W. Ravenswood Ln. – Right-of-Way Vacation
The property owner of 210 W. Ravenswood Ln. is requesting to vacate the right of way of an
undeveloped and obsolete cul-de-sac totaling 11,323 SF, or 0.26 acres, that is functioning
as the front yard of 210 W. Ravenswood Lane (Parcel # 765-04231-000). Please refer to
Exhibits 1 and 2 for images. The right-of-way in question was dedicated in 1968 via the
Country Club Addition Plat and has not been developed since that time. The intent of this
vacation request is to relieve the subject parcel of the encumbrance of a cul-de-sac that
has never been constructed and that is no longer necessary. Vacation of the ROW would
allow the property owner the ability to make enhancements to an area of the property that
currently functions as the property’s front lawn. Should the right-of-way be vacated, what
remains is an existing platted 25’ wide right-of-way along the southern boundary of the
parcel consistent with the connectivity goals of the City.
