THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section
1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to convey 14 square
feet of right-of-way to the Arkansas State Highway Commission for the I-49/Highway 62 Interchange Improvements
Project, and further authorizes Mayor Jordan to execute any documents necessary to effectuate the conveyance.

SUBJECT: Dedication of Right of Way on Highway 62 to the Arkansas State Highway
Commission for the 1-49/Highway 62 (MILK) Interchange Project (ARDOT Job No.
040846)
RECOMMENDATION:
Staff recommends the City Council approve the dedication of approximately 14 square feet of right of way to
the Arkansas State Highway Commission for use on the 1-49/Highway 62 (MLK) Interchange Improvements
Project and authorize the Mayor to sign all documents related to said dedication.
BACKGROUND:
ARDOT (administered by the Arkansas State Highway Commission) is planning improvements at the I-
49/Highway 62 Interchange and along Highway 62 (Martin Luther King, Jr. Blvd.) to create more vehicular and
pedestrian capacity. Utility relocations are being coordinated and negotiated at this time for water and sewer
infrastructure in the vicinity. An existing sewer lift station is located south of Highway 62 just west of Arvest
Bank on a small parcel of land owned by the City of Fayetteville. ARDOT has requested right of way through a
small corner of this property.
DISCUSSION:
The water/sewer division supports this request as it will allow ARDOT the room they need for their widening
efforts and will allow the sewer lift station to remain in -place, saving significant time and money to complete the
overall project. Staff sees this as a win -win and recommends donation of the small 14 square foot area to
ARDOT.
BUDGET/STAFF IMPACT:
No impact.

KNOW ALL MEN BY THESE PRESENTS:
THAT the City of Fayetteville, Arkansas, Grantor, by Lioneld Jordan, Mayor, and Kara Paxton,
City Clerk Treasurer, duly certified by authorization by the City of Fayetteville, Arkansas which was called and
held on the August 6, 2024 , for and in consideration of the mutual covenants
and benefits inuring to the party hereto, does hereby grant, bargain, sell and convey unto the Arkansas State
Highway Commission, Grantee, and unto its successors and assigns forever the following lands, save and except
such minerals therein and thereunder, as oil, gas, distillate, condensate, salt water and its component parts, and
all other hydrocarbons which do not interfere with the surface use for highway purposes, said lands being more
particularly described as follows, to -wit:

TO HAVE AND TO HOLD the same unto the said Arkansas State Highway Commission and unto its successors
and assigns forever.
AND GRANTOR DOES HEREBY COVENANT with GRANTEE that at the time of the delivery of this Deed,
the premises were free from all encumbrances made by it, and that it will warrant and defend the same against
the lawful claims and demands of all persons claiming, by, through, or under it, and against none other.
