AN ORDINANCE TO APPROVE VAC-24-09 FOR PROPERTY LOCATED AT 241 WEST SPRING STREET IN
WARD 2 TO VACATE A 0.017 ACRE PORTION OF STREET RIGHT-OF-WAY
WHEREAS,the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions thereof
which are not required for corporate purposes;and
WHEREAS,the City Council has determined that the following described portion of street right-of-way is not required
for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of street right-of-way
as described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the
Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk.
Section 3:This vacation approval is subject to the following conditions:
1. Any damage to or relocation of any existing facilities will be at the property owner/developer's expense;
2. A 15-foot utility easement shall be dedicated for existing powerlines along the property's southern boundary;
and
3. Existing water service on the west side of the property shall be removed and appropriately disconnected at the
tap at the property owner/developer's expense.

SUBJECT: VAC-2024-0009: Vacation (241 W. SPRING ST/FAYETTEVILLE PORTFOLIO LLC, 484):
Submitted by MBL PLANNING for property located 241 W. SPRING ST. in WARD 2.
The property is zoned MSC, MAIN STREET CENTER and contains approximately 1.08
acres. The request is to vacate 0.017 acres of street right-of-way.
RECOMMENDATION:
Staff and Planning Commission recommend approval of VAC-2024-0009 as shown in the attached Exhibits 'A'
and 'B', and with the following conditions of approval:
1. Any damage or relocation of existing facilities will be at the property owner/developer’s expense;
2. A 15-foot utility easement is dedicated for existing powerlines along the property’s southern boundary;
3. Existing water service on the west side of the property is removed and appropriately disconnected at the
tap at the property owner/developer’s expense.
BACKGROUND:
The subject property is in downtown Fayetteville on the southeast corner of W. Spring Street and N. Locust
Avenue. The property is zoned MSC, Main Street Center, contains approximately 1.08 acres, and was
previously developed with an approximately 10,000 sq. ft commercial structure that was destroyed in a fire in
December of 2022; an additional 3,800 sq. ft. commercial structure still stands on the property. In January
2024, a conditional use permit was approved to use the property as a temporary off-site parking lot while
redevelopment plans were evaluated by the property owner. That conditional use permit will expire in January
2025. Development-related variances associated with a proposed multi-family structure on the site were
considered and approved by the Planning Commission on Monday, June 24, 2024 (VAR-2024-0026).
Request: The applicant proposes to vacate a 5-foot-wide portion of street right-of-way adjacent to the west side
of the subject property which totals approximately 0.017 acres. The applicant intends to redevelop the site with
a multi-family housing development.
DISCUSSION:
Staff and the Planning Commission support the applicant’s request to vacate a portion of the street right-of-
way. The right-of-way is 761-square-feet along the property’s western border at a maximum width of 5 feet.
Staff finds the removal of the right-of-way is not likely to impact the existing service of the associated streets,
nor will it negatively affect the existing downtown gridded street network. Any necessary street improvements

will be fully determined at the time of the development proposal and would be required to be accommodated
within the remaining right-of-way not affected by this vacation.
At the June 24, 2024 Planning Commission meeting, Commissioners voted unanimously to forward the item to
the City Council with a recommendation of approval. Commissioners offered little comment, finding themselves
in agreement with staff's recommendations. Commissioner Werner made the motion, and Commissioner
McGetrick seconded. No public comment was offered on this item at the meeting.

RE: Petition to vacate a former street & utility easement (now considered right-of-way) located in part
of Lot 4, Block 11 of the Original Town of Fayetteville, City of Fayetteville, Arkansas
Along with our application, please consider the following description of the scope, nature, and intent of
our petition request.
1. The scope of this request includes a 5’ wide right-of-way, formerly a street and utility
easement, located along the western side of Lot 4, Block 11 of the Original Town of
Fayetteville. The filing number for this easement is Book 2014, Page 32187.
2. The location of this portion of right-of-way is preventing the highest and best use of the lot in
which the former easement/current right-of-way is located. Removal of this right-of-way will in
no way negatively impact the public, nor will it cause nuisance of any type in the public realm.
3. The intent of this request is to vacate said portion of right-of-way to allow for complete and
orderly use of Lot 4, Block 11 of the Original Town of Fayetteville.
This request to vacate the 5’ wide right-of-way located on a part of Lot 4, Block 11 of the Original
Town of Fayetteville may be seen as appropriate and in alignment with goals and values of the
Fayetteville Planning Commission and City Council.

required, and that the above-described real estate be used for their respective benefit and purpose
as now approved by law.

WHEREAS,the City Council
has the authority under A.C.A.S
14-54-104 to vacate public
grounds or portions thereof
which are not required for cor-
porate purposes;and
WHEREAS,the City Council
has determined that the follow-
ing described portion of street
right-of-way is not required for
corporate purposes.
NOW,THEREFORE,BE IT OR-
