Attached is a letter to the mayor and Council concerning the above rezoning request along with an email sent to the engineers for the city. I think everyone in advance for their review and consideration. The email IIsent to the engineers, with the link to pictures is in another email. Old Wire Road, Fayetteville We purchased the property at 2916 N Old Wire Road in February, 2021. At that time, the adjoining property (2910) N Old Wire Road was a beautiful piece of property covered in old growth timber. After , we knew that the new buyers would develop the property and the character of the land would change. Our ONLY concern with the new owners requesting a rezoning to NC was how the new build project would due to the increase of rainwater After visiting with the city at the development would have to keep this from happening and we assumed the city’s reputation for tree preservation would help . Neither of these things occurred. The buildable land was clear cut, along with some of thall of the run- water from the land was directed onto our land. The owners have now built a “pond” to catch all the water, but most water does not run into the pond, and what does go in in is subsequently pumped out on dry days when it gets near capacity going straight into our back yard. We have addressed the problem with Jorgensen Engineering, the contractor doing the work as well as the City, but no one (except the contractor who has moved dirt to no avail) we contacted has taken the time to look our problem. Initially, we thought that there would not be an availability to change land designation from rezoning request which changed from RSF-4 to NC, but later discovered that the Plat was a “Preliminary Plat” which is used for the construction of the roads, drainage and utilities and can be changed or rezoned as the builder deems necessary. Using this method, there is nothing to stop the developer with any location from later requesting that another part of the land be rezoned from NC to RSF- 18. We object to the rezoning to RSF-18 because it will allow an additional 16 houses, which will ensure that there is additional impervious structures placed on the land resulting in . However, not granting this request for rezoning will not help us with the problem we have currently with the ra-build development onto our property. We are simply asking that red clay water from the development being diverted onto a private property that they do not own is corrected.
