NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the requirements of formal competitive bidding and authorizes the purchase of an Eco-Display Classic from Eco-Counter, Inc. in the amount of $41,644.64 for displaying trail usage statistics on the Razorback Greenway section adjacent to the Upper Ramble civic plaza. BACKGROUND: As part of the Upper Ramble civic plaza, a new trail use counter is planned to be located adjacent to the Razorback Greenway near Dickson Street. This Eco Display Classic will display daily, monthly and yearly trail use. In addition, customizable digital messages can display informational messages for trail users. The display includes a backlit panel that will feature custom graphics that will complement the arts corridor. DISCUSSION: The Eco Display is being purchased directly by the city and will be installed in coordination with the new park improvements. The city has been using Eco Counter, Inc. for all trail counting needs over many years with excellent results. Since this is a purchase directly from the manufacturer, no other local distributors exist. The City already owns Eco-Counter devices and no other manufacturers have compatible parts or software. It is not practical or feasible to bid. BUDGET/STAFF IMPACT: Funding for the purchase of the Eco Display Classic has been allocated from the 2019 trail bond funds and the budget adjustment will move these funds from unallocated to the arts corridor account.
