WHEREAS, on September 6, 2023 , City Council passed Resolution No. 287-23 approving a Professional Services
Contract with TSW, Inc. to prepare construction documents for a portion of Walker Park ; and
WHEREAS, Amendment No . 1 will include additional bidding services and construction phase services.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section I: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to sign
Amendment No. I to the contract with TSW, Inc. in an amount not to exceed $101,500.00 for additional design and
construction documents for Walker Community Park .
Section 2: That the City Council of the City of Fayetteville , Arkansas hereby approves a budget adjustment, a copy of
which is attached to this Resolution .

SUBJECT: Contract Amendment #1 with TSW for Walker Park Phase One Construction
RECOMMENDATION:
Staff recommends approving contract amendment #1 not to exceed $101,500 to the contract with TSW, Inc. for
additional design services and construction documents for Walker Community Park and an associated budget
adjustment.
BACKGROUND:
Walker Park was identified as a priority project as part of the 2019 Bond. In late 2022, TSW was selected
pursuant to RFQ 22-01, Selection 10, to prepare a master plan for Walker Community Park. After significant
public engagement, the master plan was approved by the Parks, Natural Resources and Cultural Affairs
Advisory Board on September 6th, 2023. Following the master plan approval, City Council approved a contract
with TSW to prepare construction documents for a portion of Walker Park (Res 287-23 / 2023-1441).
During the same time frame, projects including Water and Sewer infrastructure improvements and Walker Park
were being considered by City Council for American Rescue Plan Act (ARPA) expenditures, and subsequently,
Walker Park was considered and earmarked as one of the eligible infrastructure projects. The water sewer
project was approved in March 26, of 2024 and we proceeded to move forward with additional work for Walker
Park Phase One.
This contract amendment will create construction documents for the additional amenities described in more
detail below.
DISCUSSION:
Walker Park was originally identified as an eligible project for ARPA for many reasons. One of the main
purposes of ARPA funding was to replenish tax losses to cities. COVID had major impacts to the Hotel Motel
Tax, reducing anticipated revenues by approximately $1M during 2021 compared to 2020.
Research shows parks played a positive and critical role in providing free and open accessible spaces for
citizenry to replenish their mental and physical health during the pandemic. As a result, Fayetteville and many
other park systems experienced increases in park use during the pandemic.
Walker Park serves a population that is more vulnerable to the negative effects of a pandemic and ARPA best
practices suggested funding in low-income areas such as Walker Park were a priority.

Current budget including $2.4M in bond funds and $500,000 in 2024 HMR Capital Improvement funds are
anticipated to repurposed the current ball fields, add three pickleball courts, four sand volleyball courts, lighted
multipurpose fields, 8-10 horseshoe courts, replace the old playground (built in1999), sitting areas, and
supporting infrastructure.
The additional $1M is anticipated to create a dynamic social use area that features spaces revolving around
yard games such as boccie, bag toss, additional horseshoe courts and ping pong. The space, located adjacent
to the Razorback Greenway and serving as a welcoming entry feature is expected to include a climbing
boulder and supporting spectating seating areas. These diverse areas offering many recreational and social
opportunities help build community connections.
Construction documents are expected to be completed later this year with construction in 2025.
BUDGET/STAFF IMPACT:
Funds are available in General Fund fund balance.

Exhibit A: Scope of Services
Construction Drawings Amendment #1, Walker Park
The construction drawings are for an additional area identified in the 2023 Master Plan and generally
outlined in Exhibit C: Work Areas. The City may have ARPA funds that could be used for this phase. The
project will consist of adding a pavilion, site furnishings, landscape, and hardscape on the west side of
Spout Spring Branch Creek and on the east side, a social node area able to support park programming
and events and featuring “yard games”, climbing boulder, seating areas, and supporting infrastructure.
These improvements will tie seamlessly into work in the original contract and will be bid with that work.
The estimated construction budget for the project is approximately $1,000,000.
The team will consist of the following:
▪ TSW (project management and landscape architecture)
▪ MCE (surveying/civil engineering)
▪ Covalent Consulting (electrical engineering)
▪ Stability Engineering (structural engineering)
Task 1: Kick-Off + Coordination
1.1 TSW Team will conduct an initial consultation session (Teams or Zoom meeting) Project goals and
timelines for the new phase will be finalized during this meeting.
1.2 TSW will manage the project, including all subconsultants, to ensure all work is completed accurately
and on time. TSW will also handle all billing of each subconsultant.
Task 2: Design Development
2.1 Based on the master plan layout and survey the team will develop the drawings. Design
Development drawings will include, but not be limited to:
▪ Revised Overall Site Plan
▪ Enlarged Plans for Key Areas
▪ Hardscape and Landscape Call Outs
▪ Spot Grading Plan
▪ Construction Details
▪ Preliminary Cost Model for Phase I
2.1.1 TSW Team QA/QC review of Design Development documents.
2.1.2 City review of Design Development documents (approximately 3 weeks).

Task 3: Construction Documentation
3.1 Based on feedback from Task 3, the TSW Team will advance Design Development drawings into
Construction Documents (100% Final Plans). Construction Documents will include, but not be limited to:
▪ Cover Sheet
▪ General Notes
▪ Existing Conditions Plan
▪ Site Demolition Plan
▪ Construction Item Plan
▪ Site Layout Plan
▪ Grading and Drainage Plan
▪ Tree Preservation Plan
▪ Erosion Control Plan
▪ Utility Plan and Profiles
▪ Construction Details
▪ Lighting Layout, Plans, and Details
▪ Electrical Plans
▪ Project Manual Format Specifications
▪ Revised Cost Model
▪ Pavilion Plans and Elevations
The drainage design and reporting will be as prescribed by city code. At the time of this proposal, it is
assumed that impervious area will be decreased from existing and only require a Green Stormwater
Practice (GSP) Worksheet. Design for stormwater detention or water quality is excluded from this
contract.
3.1.2 TSW Team QA/QC review of Draft Construction Documents.
3.1.3 City review of Draft Construction Documents (approximately 3 weeks).
Task 4: Permitting Services
4.1 The TSW Team will identify necessary permitting early in the planning process and work with local
authorities to determine those requirements.
4.1.1 The team will provide project coordination with the project team, utility service providers, and
permitting with the City of Fayetteville required to obtain permits necessary for project construction.
City Meeting Attendance: MCE shall attend the following city meetings required for project approval:
▪ Pre-application Meeting
▪ Technical Plat Review
▪ Subdivision Committee (if required)
▪ Planning Commission (if required)

Additional Meetings: Site visits and project design team meetings will be conducted and attended by
McClelland during the design and coordination phases of the project.
4.1.2 Utility Coordination: Coordination with the water and sewer departments for private utility services
and connections will be provided. Additionally, MCE will coordinate electric services with SWEPCO.
Information gathered during coordination will be shared with the project team and reflected within the
final utility plan of the construction document set.
Task 5: Bidding + Construction Administration Services
5.1 The TSW Team will provide Bid Phase Services that include, but not limited to:
▪ Attend a pre-bid meeting (if requested)
▪ Issue addenda as necessary
▪ Respond to bidders as necessary
▪ Assist the City with the evaluation of the bidders
5.2 The TSW Team will provide Construction Phase Services that include, but not limited to:
▪ Respond to request for information as needed
▪ Monthly virtual meetings and/or site visits
▪ Prepare construction observation reports as needed
▪ Post Permit and Construction Phase Drawing Revisions
Services Not Included:
▪ Record drawings
▪ Engineers’ certification of improvements
▪ Off site utility plans
▪ Off site street improvement plans such as road widening
▪ LEED permitting / certification
▪ Construction staking services
▪ Conditional-use permits or variances (including variances for work within side the streamside
protection areas)
▪ Materials testing
▪ Perspectives, renderings, and models
▪ Traffic studies
▪ Environmental site assessments
▪ Environmental impact analysis
▪ Replatting
▪ Easement Plat
▪ Alley vacation, easements abandonments and right of way dedications

The project schedule is anticipated to increase by a total of 3 to 4 months.
