A RESOLUTION TO APPROVE A MEMORANDUM OF UNDERSTANDING WITH THE DEPARTMENT OF
PUBLIC SAFETY AND ACCEPT A 2022 ARKANSAS DEPARTMENT OF PUBLIC SAFETY EQUIPMENT
GRANT AWARD IN THE AMOUNT OF $100,000.00 FOR THE POLICE DEPARTMENT, AND TO APPROVE A
BUDGET ADJUSTMENT
WHEREAS, the Arkansas General Assembly passed Act 786 of 2021, which established the Public Safety Equipment
Grant Program to facilitate implementing best police practices to improve trust between law enforcement officers and
the communities in which they serve; and
WHEREAS, the grant will be used to assist with the purchase of body worn cameras, protective equipment and
training equipment.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to sign a
Memorandum of Understanding with the Department of Public Safety and accept a grant from the 2022 DPS
Equipment Grant in the amount of $100,000.00 for the purchase of body worn camera devices and/or virtual reality
training equipment.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of
which is attached to this Resolution.

SUBJECT: Department of Public Safety Equipment Grant Award
RECOMMENDATION:
Staff recommends approval of non -matching grant award and memorandum of
understanding with the Department of Public Safety (DPS) for acceptance of the 2022 DPS
Equipment Grant award for funding of Body Worn Camera Devices and/or Virtual Reality
Training Equipment in the amount of $100,000, and a budget adjustment.
BACKGROUND:
The Arkansas General Assembly passed Act 786 of 2021 to facilitate implementing best
police practices to improve trust between law enforcement officers and the communities in
which they serve, ultimately improving public safety. This grant was limited to assist law
enforcement agencies with the purchase of body worn cameras, protective equipment, and
training equipment. The law enforcement equipment authorized by this grant has shown to
increase officer accountability and transparency, improve officer -citizen interactions, reduce
unwarranted complaints against law enforcement, aid in criminal prosecutions, facilitate officer
training, build community trust in law enforcement, and increase public safety for both officers
and the citizens they serve.
DISCUSSION:
The DPS Equipment Grant Committee has awarded the Fayetteville Police Department
$100,000 to help fund our body worn camera expansion and/or the purchase of virtual reality
equipment.
BUDGET/STAFF IMPACT:
This grant award does not require local matching funds and has no impact on staffing
levels. Approval of this budget adjustment will establish revenue and expense budgets equal to
the grant award in the amount of $100,000.

Dear Fayetteville Police Chief Reynolds,
The Department of Public Safety (DPS) Equipment Grant Committee has reviewed your application
requesting funding under the 2022 DPS Public Safety Equipment Grant Program. Based on their
recommendations, I am pleased to award you funding for the 2022 DPS Public Safety Grant Program. We
believe your funded project will make an impactful difference to increasing transparency and
accountability within the communities your agency serves. As part of the Public Safety'Equipment Grant
Program, you will receive a partial funding amount of $100,000 to conduct your grant program over the
2022 & 2023 calendar year with DPS.
Items Funded Description
Category 3 Body Camera Devices Committee awarded partial funding cap of $100,000 to be used toward
(Auto -Activation Capabilities) with submitted requests (i.e., Funding request for Project Component (1) of
Software Storage Bundle; ($135,717.03); and Funding request for Project Component (2) of
($498,991.96)).
Category 10; Virtual Reality

As part of the grant program requirements, the following must be conducted within the 2022 — 2023
calendar year:
• Sign and return the attached Memorandum of Understanding to the DPS Public Safety equipment
Grant Committee fourteen (14) days from the date of the received grant award notification; no
later than 4:30pm on Friday, December 301h, 2022.
• Utilize funding award for the appropriate items listed in your award notification letter; if all funds
are not utilized in the calendar year, unused funds must be returned to DPS at the completion of
the grant program.
• Participate and complete any surveys related to the implementation and success of the awarded
program as requested by the DPS Research and Planning Division.
• Complete and submit a financial report each month via email, due by the 1 Oth of the following
month at 4:30pm to the DPS Research and Planning Division, Special Projects Coordinator,
Jackie Baker at Jackie,hakcr c�'as�rkansas;C?4 providing an accounting of the activities and
expenditures for the previous month. A copy of all receipts must be attached. All expenditures are
subject to DPS and Legislative Audit Review. All documents must be retained for a period of
three (3) years from the receipt of award.
• Submit a final report at the end of the grant period (December 10", 2023, by 4:30pm), or after all
expenses have been incurred, providing a final accounting of the activities and expenditures for
the project.

MEMORANDUM OF UNDERSTANDING
In accordance with Act 786 of 2021 the Arkansas Department of Public Safety is
responsible for awarding funding from the Public Safety Equipment Grant Fund.
Pursuant to the foregoing authority, the Arkansas Department of Public Safety has
established the Public Safety Equipment Grant Fund Committee to award funding to
applicants who, in the Committee's judgment, best facilitate improving trust between
Arkansas law enforcement officers and the communities they serve.
The purpose of this memorandum of understanding is to outline the requirements for
applicants that receive grant funding under the DPS Public Safety Equipment Grant
Program.
Based on the above, the Arkansas Department of Public Safety ("DPS") and the
( Qtv of FavPttPville ) (the "Agency") agree as follows:
1. The Agency will maintain records and receipts for items purchased with the grant
funds and will furnish copies of all receipts to DPS by the IOth day of the month
following the expenditure.
2. Any modification or changes exceeding 10% to the Agency's approved budget must
be authorized by the DPS Committee before expenditures for the changes can be
made. Any awarded funds not expended during the period set out in the preceding
paragraph and in accordance with the budget or approved changes shall be refunded
to DPS by 4:30 p.m. December 31, 2023.
3. The awarded funds are subject to audit by DPS and/or the Department of
Legislative Audit. Misuse of these funds will result in the Agency being required to
reimburse DPS for the funds awarded. Any false, fictitious, or fraudulent statements
or claims may result in criminal, civil, or administrative penalties and may prohibit
administrations from receiving future awards.(U.S. Code, Title 18, Section 1001)
4. Agencies will be required to complete any surveys related to the implementation
and success of the program.
5. The following items will NOT be considered for funding and any funds awarded
should not be used for these items:
■ Salaries, over time, fringe benefits related to salaries
■ Any Specialty Court
■ Real Estate
■ Vessel or Aircraft
■ Vehicles
■ Firearms
■ Construction Projects
• Buy Money
6. DPS will terminate this agreement and require repayment of any grant funding in
the event of fraud, misuse, or expenditures not related to the approved project
This MOT! is in effect from December 1, 2022 through December 31, 2023 and will
remain in full force and effect for the duration of the agreement period, not to exceed one
year, unless otherwise terminated by DPS.
