PLAY SAFELY SPORTS (SERVICE AGREEMENT):
A RESOLUTION TO AUTHORIZE A CONTRACT WITH PLAY SAFELY SPORTS TO PROVIDE YOUTH
INJURY MITIGATION COURSES FOR ATHLETIC PERSONNEL AND COACHES AT A COST OF $20.00 PER
PERSON , AND TO APPROVE A BUDGET ADJUSTMENT
WHEREAS, in early 2023 , the Arkansas General Assembly passed the Coach Safely Act requiring youth mJury
mitigation and information courses for athletics personnel and coaches in any association that sponsors or conducts
sports training or high-risk youth athletic activities for children 14 years of age and younger; and
WHEREAS, the training courses provided by Play Safely Sports are approved by the Arkansas Department of Health
and are recommended by staff over other approved training courses based on the quality of training content, efficiency
of having all modules in one platform , duration of time needed for coaches to complete the courses, and the
management of coaches completing the courses.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section I : That the City Council of the City of Fayetteville , Arkansas hereby authorizes Mayor Jordan to sign an
agreement with Play Safely Sports to provide youth injury mitigation courses for athletic personnel and coaches in the
City's youth recreational programs at a cost of$20.00 per person.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of
which is attached to this Resolution.

RECOMMENDATION:
Resolution to approve an agreement with Play Safely Sports to provide youth injury mitigation and information
courses for athletic personnel and coaches in the amount of $7,000 and to approve an associated budget
adjustment.
BACKGROUND:
On April 11, 2023, the State of Arkansas 94th General Assembly passed the Coach Safely Act to require
youth injury mitigation and information courses for athletics personnel and coaches; and for other
purposes. The Act and the Rule articulate that any association that sponsors or conducts sports training
or high-risk youth athletic activities for children ages fourteen (14) and younger shall require all coaches
and athletics personnel to complete specific training. The association shall maintain a record of individual
course completion for as long as that individual serves as athletic personnel or coach for the association.
The courses are to be approved by the Arkansas Department of Health, on these subjects:
• Emergency Preparedness, planning, and rehearsal for traumatic injuries
• Concussions and head trauma
• Heat and extreme weather-related injury familiarization
• Physical conditioning and training equipment usage
• Heart defects and abnormalities leading to sudden cardiac death
DISCUSSION:
The Play Safely Sports training courses are approved by the Arkansas Department of Health and have an
associated cost of $20 per coach. Parks, Natural Resources and Cultural Affairs utilizes approximately
350 volunteer coaches and staff annually that would be required to complete the Coach Safely Act
approved training courses for a total cost of $7,000.
The Play Safely Sports training modules were selected over other training courses approved by the
Arkansas Department of Health based on the quality of training content, efficiency of having all training
modules on one platform, duration of time needed for coaches to complete the courses, and the

management of coaches completing the courses.
As part of the fee, Play Safely Sports will provide a roster of individuals who have completed training,
simplifying tracking for staff.
BUDGET/STAFF IMPACT:
The agreement with Play Safely Sports has an expense for a total cost of $7,000 for associated coach
training.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

SECTION 1. Arkansas Code Title 6, Chapter 18, Subchapter 7, is amended 24
to add an additional section to read as follows: 25
6-18-720. Coach Safely Act. 26
(a) This section shall be known and may be cited as the “Coach Safely 27
Act”. 28
(b) As used in this section: 29
(1) “Association” means an organization that administers or 30
conducts high-risk youth athletic activities on property that is owned, 31
leased, managed, or maintained by the state, an agent of the state, or a 32
political subdivision of the state; 33
(2) “Athletics personnel” means athletic directors and other 34
individuals actively involved in organizing, training, or coaching athletic 35
activities for individuals who are fourteen (14) years of age or younger; 36

(3)(A) “Coach” means any individual, whether paid, unpaid, 1
volunteer, or interim, who has been approved by an association to organize, 2
train, or supervise a youth athlete or team of youth athletes. 3
(B) “Coach” may include without limitation an individual 4
selected by a youth athlete or a team of youth athletes who has not been 5
approved by an association if the individual approved by an association is 6
unavailable; 7
(4) “High-risk youth athletic activities” means any organized 8
sport in which there is a significant possibility for a youth athlete to 9
sustain a serious physical injury, including without limitation the sports of 10
football, basketball, baseball, volleyball, soccer, ice or field hockey, 11
cheerleading, and lacrosse; and 12
(5) “Youth athlete” means an individual who is fourteen (14) 13
years of age or younger and participates in an organized sport. 14
(c) Any association that sponsors or conducts sports training or high-15
risk youth athletic activities for children who are fourteen (14) years of 16
age and younger shall require all coaches and athletics personnel to complete 17
an online or residence course approved by the Department of Health, if 18
available at no cost, which provides information and awareness of actions and 19
measures that may be used to decrease the likelihood that a youth athlete 20
will sustain a serious injury while engaged or participating in a high-risk 21
youth athletic activity. 22
(d) Any youth injury mitigation and information course described under 23
subsection (c) of this section shall provide information on the following 24
subjects without limitation: 25
(1) Emergency preparedness, planning, and rehearsal for 26
traumatic injuries; 27
(2) Concussions and head trauma; 28
(3) Heat and extreme weather-related injury 29
familiarization; 30
(4) Physical conditioning and training equipment usage; 31
and 32
(5) Heart defects and abnormalities leading to sudden 33
cardiac death. 34
(e) Any individual required to take a youth injury mitigation and 35
information course under this section shall complete the course within thirty 36

(30) days of becoming actively engaged in or serving as part of the athletics 1
personnel or coaching staff for an association. 2
(f) An association that conducts a high-risk youth athletic activity 3
or event that requires a coach or an athletics personnel member to complete a 4
youth injury mitigation and information course under this section shall 5
maintain a record of individual course completion for as long as that 6
individual serves as athletic personnel or coach for the association. 7
(g) The youth injury mitigation and information course requirement 8
under this section shall be an annual requirement to be completed no later 9
than the anniversary of the date on which the individual became actively 10
engaged in serving as athletic personnel or coach for an association. 11
(h) All licensed and certified athletic trainers, doctors, nurses, 12
first responders, and healthcare professionals with acute traumatic life 13
support training are exempt from the youth injury mitigation and information 14
course requirement under this section. 15
(i) This section does not: 16
(1) Eliminate the involvement of athletic trainers at youth 17
athletic events; or 18
(2) Impose any additional liability upon political subdivisions 19
of this state. 20
(j) An athletics personnel member or coach is entitled to a defense 21
from liability for any injury sustained by a youth athlete as a result of 22
participation in a high-risk youth athletic activity upon establishing that 23
the athletics personnel member or coach: 24
(1) Completed the injury mitigation and information course 25
required under subsection (c) of this section; and 26
(2) Reasonably conformed his or her conduct to the safety 27
techniques and methods identified in the injury mitigation and information 28
course. 29
(k) Within one hundred eighty (180) days of the effective date of this 30
section, the Department of Health shall adopt rules to implement, enforce, 31
and administer this section. 32
(l) This section shall not apply to: 33
(1) A licensed teacher with a coaching endorsement on the 34
licensed teacher's teaching license; 35
(2) A licensed teacher who completes the Arkansas Activities 36

coaching endorsement program; or 2
(3) A registered volunteer under the Arkansas Registered 3
Volunteers Program Act, § 6-22-101 et seq., who completes the Arkansas 4
Activities Association and National Federation of State High School 5
Associations coaching endorsement program. 6

SECTION 2. DO NOT CODIFY. Rules. 8
(a) When adopting the initial rules required under this act, the 9
Department of Health shall file the final rules with the Secretary of State 10
for adoption under § 25-15-204(f): 11
(1) On or before January 1, 2024; or 12
(2) If approval under § 10-3-309 has not occurred by January 1, 13
2024, as soon as practicable after approval under § 10-3-309. 14
(b) The department shall file the proposed rules with the Legislative 15
Council under § 10-3-309(c) sufficiently in advance of January 1, 2024, so 16
that the Legislative Council may consider the rules for approval before 17
January 1, 2024. 18

This Organization Contract (“Agreement”) is entered into between Youth Sports Training, Inc. d/b/a Play
Safely Sports (“Company”) and the Organization listed above (“Organization”) as of the last date of
signature below (“Effective Date”). This Agreement is subject to Company’s Terms of Service, as found

online safety course annually.
Organization is approved to use Play Safely Sports’ name and logo for marketing purposes.
Organization will purchase 300 courses for $20.00 per course for a total of $6000. Organization
has the option to purchase more courses upon request.
