BOND PROJECT AND TO APPROVE A BUDGET ADJUSTMENT -2019 STREET IMPROVEMENT BOND
PROJECT
WHEREAS, in June the Engineering Division received a grading permit application from Petroplus,LLC for the
redevelopment of cert~n parcels of land ; and
WHEREAS, the improvements include sidewalks, shared-use trails , trees, lighting, and intersection improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section I : That the City Council of the City of Fayetteville, Arkansas hereby authorizes a cost share with
Petroplus ,LLC in the amount of $102 ,577 .80 , to complete improvements associated with portions of the North Street
Bond Project.
Section 2 : That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a copy of
which is attached to this Resolution .

RECOMMENDATION:
Staff recommends approval of this cost share with Petroplus, LLC to complete improvements associated with
portions the North Street Bond Project including, the trail section along North Street, North Street widening,
North Street curb improvements, North Street retaining wall, street trees, Lindell Ave narrowing, and Lindell
Ave curb improvements for $53,388.00 and a portion of the cost of the proposed retaining wall for $49,189.80.
The total requested cost share amount is $102,577.80. Staff also recommends approval of a budget
adjustment.
BACKGROUND:
In June 2023, the Engineering Division received a grading permit application from Petroplus, LLC for the
redevelopment of parcels of land bounded by N Garland Ave, W Mount Comfort Rd, N Lindell Ave, and W
North St. The development will be completing other street improvements, including sidewalk installation along
N Garland Ave, W Mount Comfort Rd, and Lindell Ave.
Improvements to the North St Corridor are proposed as a part of the city’s 2019 Bond Program. These corridor
improvements will bring much needed sidewalks and street improvements to one of Fayetteville's most
important east-west corridors. Improvements to this corridor are varied, depending on the segment but include
sidewalks, shared-use paved trails, trees, lighting and intersection improvements.
DISCUSSION:
The improvements for the North Street Bond Project along this section include a shared-use trail and other
street improvements including pavement and curb work, street trees, and a retaining wall. During permit review
of the development, a cost share was proposed for installation of these improvements to coincide with
construction associated with the development. Recognizing that simultaneous construction would be beneficial
to the city and the public reducing disruptions and providing an immediate safety improvement for pedestrians,
city staff is recommending this cost share to reimburse the developer for costs associated with portions of the
North Street Bond Project.
BUDGET/STAFF IMPACT:
This cost share will be funded by the 2019 Transportation Bond Fund.

Cost-Share Narrative:
The Road Runner – Fayetteville is located at 1130 N Garland Avenue and consists of 2 parcels, totaling
approximately 1.18 acres. Site features include an asphalt parking lot, EV chargers, gas pumps, improved
landscaping, and bike infrastructure.
EDG is requesting a cost share agreement between the City of Fayetteville and Coulson Oil for the improvements
associated with the North Street Bond Project. These improvements include a trail section along North Street,
North Street widening, North Street curb improvements, North Street retaining wall, street trees, Lindell Ave
narrowing, Lindell Ave curb improvements. Coulson Oil is proposing for the City of Fayetteville to pay for the
improvements required to meet the North Street Bond Project plans.
The attached exhibit shows the areas of the site that overlap with the North Street bond project. All cost
estimates were prepared by Baldwin Shell, the general contractor for the Road Runner project.

portion of wall that was proposed in the North Street Bond Project plans, Coulson Oil will pay for the additional
wall required to develop this project. Please see the attached exhibits and cost analysis for more information.
The attached exhibit shows the limits of the site retaining wall that is to be included in the cost-share agreement.
All cost estimates were prepared by Baldwin Shell, the general contractor for the Road Runner project.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF STREET IMPROVEMENT COSTS
This Agreement, made and entered into on this _____ day of ____________ 2024, by and
between the City of Fayetteville, Arkansas (“City”) and Petroplus, LLC. witnesseth:
WHEREAS, Petroplus, LLC has proposed a new commercial development, approved at
the intersection of Garland Avenue and North Street, and
WHEREAS, the Petroplus, LLC is required to construct street and sidewalk improvements
along the north and east sides of the property, and
WHEREAS, the south side of the project abuts North Street which is within the project
limits of the City’s North Street Corridor Transportation Bond Project, and
WHEREAS, it would benefit the City to have this portion of the North Street Corridor
Project constructed along with the other proposed improvements for this development.
NOW, THEREFORE, the City of Fayetteville, Arkansas and Petroplus, LLC agree as
follows:
1.The City of Fayetteville, Arkansas agrees to:
A.Reimburse Petroplus, LLC for $102,577.80 which represents the cost to install
approximately 2,700 square feet of 10-foot concrete sidewalk, excavation,
select fill, curb and gutter, asphalt, street trees, lights, retaining wall and other
items necessary for construction as shown in Exhibit “A”, attached.
B.Payments due to Petroplus, LLC shall be remitted within sixty (60) days after
receipt of valid invoices and pending successful inspection and acceptance of
the completed work by the City of Fayetteville Engineering Division.
2.Petroplus, LLC agrees to:
A.Provide the necessary and normal project management, inspection, and testing
as necessary to complete the work shown on Exhibit “A”, in accordance with
the City of Fayetteville Minimum Street Standards, and City Standard Details,
both of which are available at http://www.fayetteville-ar.gov/445/Engineering-
Specs-Details
B.Provide a copy of the invoices from the Contractor upon completion and City
approval of the improvements described in Exhibit “A”.
C.Pay for the street improvements with a not to exceed reimbursement of
$102,577.80 of the cost by the City of Fayetteville.

3. It is fu11her understood that the contract for construction is between Petroplus. LLC
and their Contractor and that the City has no contractual obligation with either the
Contractor or any agent for Petroplus, LLC. The City 's only obligation shall be to
participate in a contractual agreement with a not-to-exceed amount of $102,877 .80
for the associated street improvements .
