BACKGROUND: The subject property is in north Fayetteville, roughly '/4 mile north of the intersection of N. Old Wire Road and N. Old Missouri Road; immediately north of the Keenan Towerhouse. The property totals approximately 36.20 acres and is zoned NC, Neighborhood Conservation and NS-G, Neighborhood Services -General. At the Planning Commission meeting on April 11, 2022, a conditional use permit (CUP-2022-0004) was approved to allow multi -family on the portion of the property zoned NS-G, Neighborhood Services -General. The project received large scale development approval at the May 9, 2022 Planning Commission meeting (LSD-2022-0012). Surrounding land uses and zoning are depicted in Table 1. The development will include twenty-seven multi -family townhouse units in three structures, ten single-family units, and a commercial/retail space. The developer plans to subdivide the lots providing a minimum of 18 feet of lot width in accordance with 164.11(B). Water and Sewer System: The applicant has installed water mains to provide necessary domestic water and fire protection for the subdivision. Sewer mains have been installed to provide sewer service. Drainage infrastructure has been installed that meets the 4 Minimum Standards outlined in the Drainage Criteria Manual. The main streets have been installed to provide paved access to the subdivision. The infrastructure is substantially complete, and a final punch list is being completed. Right-of-way to be dedicated: N. Old Missouri Road is a Neighborhood Link Street per the 2040 Master Street Plan. Existing right-of-way for N. Old Missouri Road varies but appears to meet or exceed the typical requirement of 33.5 feet of right-of-way from centerline. Existing right-of-way along E. Rolling Hills Drive, a Neighborhood Link Street, meets the Master Street Plan requirements at 67 feet. Existing right-of-way on internal streets, N. Grace Reign Way and E. Little Crew Dr., meet the Master Street Plan requirements for alternative Residential Link streets (a determination made by the Planning Commission as part of the approval of LSD-2022-0012). Finally right-of-way along internal street, E. Roe Ter., meets the requirements for a Residential Link street. Accordingly, staff recommends no additional right-of-way dedication is required. Street Improvements: N. Old Missouri Road: The Active Transportation Plan shows a planned side -path trail along N. Old Missouri Road. The City and developer are currently in negotiations for a cost -share agreement to facilitate these improvements. The cost share outlines the developer be responsible for costs associated with construction of an 8-foot-wide sidewalk, a cost estimate of approximately $64,750, and the city be responsible for additional costs beyond that to upgrade to a trail, approximately $58,533. This would include an additional 4-foot width of concrete, pavement markings, trail crossings, and signage. Also, since an abundance of right-of-way is shown to be dedicated to prevent the removal of pine trees, the valuation for that additional property could be factored into the developer's contribution and would be equal to, or less than a $10,000 contribution from the City. The cost share agreement would ultimately need to be considered by the City Council. Staff recommends all other street improvements for N. Old Missouri Road are constructed in line with the 2040 Master Street Plan requirements for a Neighborhood Link Street including planting street trees and installation of streetlights at intervals of no more than 300 feet. Additionally, staff recommends that the developer is required to improve the intersection of E. Rolling Hills Drive and N. Old Missouri Road for the addition of a west bound leg, including additional signal equipment and modifications to pavement markings. E. Rolling Hills Drive: E. Rolling Hills Drive is a planned Neighborhood Link Street which requires a 30-foot paved width, two six-inch curbs, and 10-foot greenspace and 8-foot sidewalk on both sides of the street. Little Crew Dr.: These internal streets were determined by the Planning Commission to be alternative Residential Link Streets which requires a 27-foot paved width, two 1.5-foot curbs, and 6-foot green space and 6-foot sidewalks on one side of the street. Tree Preservation: • Canopy minimum requirement: 25% • Existing canopy: 100% • Preserved canopy: 100% • Mitigation required: none Parkland Fees: This project has a credit of 4 multi -family units, or $3,808, for future phases of the project. No additional parkland fees are due. Public Comment: Staff has not received any comments from the public on this item. RECOMMENDATION: Staff recommends forwarding CCP-2023-0006 to the full Planning Commission, with the following conditions: Conditions of Approval: 1. Subdivision Committee recommendation of right-of-way dedication. Staff does not recommend right-of-way dedication. 2. Subdivision Committee recommendation of street improvements. Staff recommends the following street improvements: a. An additional traffic signal must be installed at the intersection of E. Rolling Hills Dr. and N. Old Missouri Rd. for the addition of a west bound leg, including additional signal equipment and modifications to pavement markings. b. N. Old Missouri Road: i. A cost -share agreement for the construction of an eight -foot -wide planned side -path trail along N. Old Missouri Road. ii. Staff recommends all other street improvements for N. Old Missouri Road are constructed in line with the 2040 Master Street Plan requirements for a Neighborhood Link Street including planting street trees and installation of streetlights at intervals of no more than 300 feet. c. E. Rolling Hills Drive: E. Rolling Hills Drive is a planned Neighborhood Link Street which requires a 30-foot paved width, two six-inch curbs, and 10-foot greenspace and 8-foot sidewalk on both sides of the street. d. N. Grace Reign Way and E. Background: Stage Station was submitted for grading permit in June 2022 and approval was granted in October 2022. Since that time the contractor has installed the required infrastructure to plat the proposed lots. Discussion: The applicant has installed water mains to provide necessary domestic water and fire protection for the subdivision. Sewer mains have been installed to provide sewer service. Drainage infrastructure has been installed that meets the 4 Minimum Standards outlined in the Drainage Criteria Manual. The main streets have been installed to provide paved access to the subdivision. The infrastructure is substantially complete, and a final punch list is being completed. One item that must be complete prior to Engineering signing the concurrent plat is the installation of the additional traffic signal at the intersection of Rolling Hills and Old Missouri. The applicant has requested to bond alley construction and trail work to limit potential damage during home construction. The property is the site of the existing Stage Station Large Scale Development which included the installation and construction of roadways, water, sewer & storm drainage infrastructure for 10 single family lots, 26 townhomes and 1 commercial space. The purpose of this proposed Concurrent Plat is to create 41 lots, 37 of which are buildable, and 2 of which are outlots reserved for future development. All right-of-way, utility easements, drainage easements, access easements, and tree preservation easements have been dedicated with the previous Large Scale Development. All utility mains and service connections have been installed. Therefore, no new service taps or meters will be required. Stormwater drainage requirements are also being addressed with the detention pond and stormwater system constructed with the LSD.
