NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends the title of Article III – Department of Parks and Recreation to “Department of Parks, Natural Resources, and Cultural Affairs.” Section 2: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 33.015 Establishment of the City Code and enacts a new § 33.015 as follows: “33.015 Establishment There is hereby established the Department of Parks, Natural Resources and Cultural Affairs.” Section 3: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 33.016 Administration of the City Code and enacts a new § 33.016 as follows “33.016 Administration The Department of Parks, Natural Resources and Cultural Affairs shall be administered and directed by a qualified person appointed by the Mayor, who shall be known as the Director of Parks, Natural Resources and Cultural Affairs. Said director shall have one or more assistants and such staff as the City Council from time to time shall authorize.” Page 2 Section 4: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 33.017 Duties of the City Code and enacts a new § 33.017 as follows: “33.017 Duties It shall be the duty of the Department of Parks, Natural Resources and Cultural Affairs to: A.Develop a ten-year Park System Master Plan to assist the Department and city in providing parks and recreation facilities and services; B.Develop and coordinate all recreation activities of the city; C.Prepare development plans for present parks and for future park areas; D.Investigate federal, state, and private programs for park, recreation and cultural development and prepare necessary forms; E.Provide and manage aquatic venues; F.Develop an Arts and Culture Master Plan and implement programming in alignment with the Plan; G.Coordinate management of the city’s natural resources and urban forest; H.Coordinate city-wide beautification efforts; I.Perform such other duties and conduct such other activities in connection with the park, recreation and cultural needs of the inhabitants of the city, as the City Council shall from time to time provide; J.Coordinate with and advise the Public Works Department concerning park maintenance needs and schedules; and K.Work with other agencies and non-profits to expand arts, parks, and recreation opportunities and amenities in the city where appropriate Section 5: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 33.018 Parks and Recreation Advisory Board of the City Code and enacts a new § 33.018 as follows: “33.018 Parks, Natural Resources and Cultural Affairs Advisory Board (A) Composition. (1) Nine (9) members shall be appointed by the City Council for terms of three (3) years. Such terms shall be staggered so that three (3) members will be appointed each year. (2) All members of the Parks, Natural Resources and Cultural Affairs Advisory Board shall serve without compensation. (B) Meetings of Advisory Board and Responsibilities. (1) The Parks, Natural Resources and Cultural Affairs Advisory Board shall meet monthly with the Director. (2) The Advisory Board shall advise and recommend to the Director, Mayor and City Council on all aspects of parks, natural resources and cultural affairs activities. (3) The Advisory Board shall coordinate with other boards such as the Urban Forestry Advisory Board and the Fayetteville Arts Council as needed to stay informed on topics related to the Parks, Natural Resources and Cultural Affairs Department. (4) Annually, the Advisory Board shall advise on work program priorities. BACKGROUND: In 1965 Ordinance 1526 created the Parks and Recreation Department and the Parks and Recreation Advisory Board. The department has grown significantly and changed since that time and updates are needed. DISCUSSION: In 2021 the Department was restructured to include Arts and Culture, and renamed Parks, Natural Resources and Cultural Affairs. At the same time, maintenance functions were moved into the Public Works department. With this restructuring came new responsibilities. The proposed amendments to Article 33. Major updates include updating the department name throughout, updating the duties of the department to include arts and culture and clarify coordination with Public Works, and updating the duties of the advisory board. The Parks and Recreation Advisory Board reviewed these updates and unanimously recommended approval.
