A RESOLUTION AUTHORIZING AND DIRECTING THE
CITY ATTORNEY TO CONDEMN REAL PROPERTY FROM
JOHN G. BANKS AND DAVID R. BANKS FOR CONSTRUC-
TION OF THE WALTON ARTS CENTER PROJECT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Attorney is hereby authorized
and directed to condemn the real property described in Exhibit "A"
attached hereto and made a part hereof from John G. Banks and
David R. Banks for construction of the Walton Arts Center Project.
PASSED AND APPROVED this 5th day of January , 1988 .

CIRCUIT CLERK
The undersigned, Lucy A. McChristian, being duly
appointed, qualified and acting Executrix of the Will and Estate
of Katharine M. Heagler, deceased pursuant to authorization
C` contained in said Order of Probate Court of Washington County,
Arkansas, (Case Number P 83-60), for and in consideration of Thirty-

five Thousand Dollars ($35,000.00) and other valuable considerations
to me in hand paid by John G. Banks and David R. Banks, do hereby
grant, bargain, sell and convey unto John G. Banks and David
R. Banks, as joint tenants the following described property,
situated in Washington County, Arkansas, to-wit:
A strip of equal width off of the South end of
Lots Numbered Fifteen ( 15), Sixteen (16) and
Seventeen ( 17) in Block Numbered Six (6) in the
original plat of Town (now City) of Fayetteville,
so as to include a certain brick building located
thereon, and being more particularaly described as
beginning at a point three (3) feet North of the
South West corner of said Block Six, and on the
East Line of West Street, as now located, and
running, thence East one hundred fifty-seven ( 157)
feet to a ten foot alley; thence North forty (40)
feet or to the center of the North Wall of said
brick building; thence West one hundred fifty-seven
(157) feet or to the East line of West Street as
same is now located; thence South forty (40) feet,
more or less to the place of beginning.
TO HAVE AND TO HOLD to the said John G. Banks and
David R. Banks, and to their heirs and assigns free and
clear of claims and debts of the estate, specifically and
including but not limited to estate and inheritance tax, together
with all appurtenances thereunto belonging.

in the Office of the Circuit Clerk and.; Ex- —
Officio Recorder for Washington County,
Arkansas, and all being more particularly
described as follows: Beginning at a point
which is forty-three (43) feet North of the
South West corner of Block Six (6) , which point
is on the East line of West Street thence East
one hundred fifty-seven (157) feet or to the
West line of an alley; thence North two hundred
thirty-seven (237) feet, more or less to the

HELEN BASSETT, TOD C. BASSETT, EDWIN C. SUGG, MARK C. SUCG,

BANKRUPTCY ESTATE, spouses of said Grantors, do hereby release
and relinquish unto the said Grantees our dower/curtesy and
homestead in and to said lands and quitclaim unto said Grantee
any interest, right and title we may have therein.
