RESOLUTION NO. 63-88
A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A CONTRACT WITH C.W. CON-
STRUCTION COMPANY TO RAZE AND REMOVE AN UNSAFE
STRUCTURE LOCATED AT 617 NORTH COLLEGE AVENUE.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a contract with C.W. Construction Company to
raze and remove an unsafe structure located at 617 North College
Avenue. A copy of the contract authorized for execution hereby is
attached hereto marked Exhibit "A" and made a part hereof .

CONTRACT ,
This CONTRACT executed this av)N day of
19 8 g , by and between the City of Fayetteville, Arkansas, herein-
after called the "City" , and C. W. Construction Company
hereinafter called the "Contractor" .
WHEREAS, the Fayetteville Board of Directors has adopted an
ordinance ordering the owner of the real property described in
Exhibit "A" attached hereto and made a part hereof to raze and
remove an unsafe structure located on said property and to abate
unsightly conditions existing on said property which is located at
617 North College Avenue
( Street Address)
in the City of Fayetteville, Arkansas ; and
WHEREAS, the owner has failed to raze and remove said unsafe
structure and to abate said unsightly conditions within the time
specified in said ordinance; and,
WHEREAS, the City has taken bids for said work and has
awarded the bid to the Contractor.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
CONTAINED HEREIN, the City and the Contractor hereby agree:
1 . The Contractor shall raze and remove the unsafe struc-
ture located on the real property described in Exhibit "A" hereto.
Said work shall be done by hand or by bulldozer. All portions of
the structure, including the foundation and slab shall be removed,
and hauled to a landfill licensed by the Arkansas Department of
Pollution Control and Ecology. The Contractor shall level the
property.
2 . The Contractor shall remove all trash and debris or
other unsightly materials from the real property described in
Exhibit "A" hereto and shall dispose of said trash, debris and
unsightly materials at a landfill licensed by the Arkansas
Department of Pollution Control and Ecology.
3 . The Contractor shall commence work on the date of this
contract and shall complete all work within thirty ( 30) days from
the date of this contract. Time is expressly made of the essence
of this contract.

4. The Contractor shall provide all labor and tools
necessary to perform the work required by this contract.
5 . Upon completion of the work required by this contract,
the City shall pay the Contractor a lump sum of $ 5.000.00
If the work is not completed within thirty ( 30 ) days as required
by this contract, the City shall have the right to deduct from the
amount due the Contractor the sum of Fifty dollars ( $50 . 00 ) per
day for each day over thirty ( 30 ) days the Contractor requires to
complete the work.
6 . In performing the work under this contract, the Contrac-
tor shall be an independent Contractor and not an employee of the
City.
IN WITNESS WHEREOF, this contract has been executed on the
date first above written.
