HomeMy WebLinkAbout62-88 RESOLUTION • RESOLUTION NO. 62-88 SCAN N E D A RESOLUTION ACCEPTING THE DEDICATION OF LAND BY BRIAN WALKER AND SARAH WALKER FOR CON- STRUCTION AND MAINTENANCE OF A SENIOR CITIZEN SHELTER AND APPURTENANCES. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the Board of Directors hereby accepts the dedication of the real property described in Exhibit "A" attached hereto and made a part hereof by Brian Walker and Sarah Walker for the construction and maintenance of a senior citizen' s shelter and appurtenances. APPROVED By- 47)1)0Aaltr) 9011.444001 ayor ATTEST By: a i Clerk WARRANTY DEED HUSBAND AND WIFE CONVEYING AS TENANTS BY THE ENTIRETY, JOINTLY OR IN COMMON KNOW ALL MEN BY THESE PRESENTS: That we, Bryan Walker and Sarah Walker husband and wife, hereinafter called Grantors, for and in considera- tion of the sum of One Dollar ($1.00) and other _good and valuable consideration to us in hand paid by City ot Arkansas hereinafter called Grantee, do hereby grant, bargain and sell unto the said Grantee and Grantee's heirs and assigns, the, following described land, situate in Washington County, State of Arkansas, to-wit: Lots 1 , 2 , 3 , 4 , 5 and that part of 8th Street adjoining Lot 5 , more or less , in Block H of Archibald Yell Subdivision to the City of Fayetteville, Arkansas. To be used by the City of Fayetteville, Arkansas , solely for the construction and maintenance of a senior citizen shelter, walkways , barbecue pit , picnic area, and croquet , shuffleboard , or related senior citizen recreational facilities , (no parking lots allowed) , with wheel chair access , to be constructed within a reasonable period of time hereafter and to be maintained in perpetuity , as such senior citizen recreational facility as a part of Walker Park. Should the above facilities not be constructed within a reasonable time hereafter, or should the property conveyed herein ever be used by the City of Fayetteville, Arkansas for any purpose or in any manner other than in accordance with the terms of this deed, at any time in the future , the property shall automatically revert to grantors or their heirs . TO HAVE AND TO HOLD the said lands and appurtenances thereunto belonging unto the said Grantee and Grantee's heirs and assigns, forever. And we, the said Grantors, hereby covenant that we are lawfully seized of said land and premises, that the same is unincumbered, and that we will forever warrant and defend the title to the said lands against all legal claims whatever. And we, the respective Grantors, hereby release and relinquish unto the said Grantee our respective dower/curtesy and homestead in and to said lands.
