RESOLUTION NO. 41-88 SCANNED
A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A FIRE PROTECTION CONTRACT
WITH THE BOARD OF TRUSTEES OF THE UNIVERSITY
OF ARKANSAS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a fire protection contract with the Board of
Trustees of the University of Arkansas. A copy of the contract
authorized for execution hereby is attached hereto marked Exhibit
"A" and made a part hereof.

CONTRACT
This CONTRACT executed this 1,`+1'\ day of dttuA.
1988 , by and between the City of Fayetteville, Arkansas, herein-
after called the "City" , and the Board of Trustees of the Univer-
sity of Arkansas, hereinafter called the "University" .
WHEREAS, the City mans and equips an organized fire depart-
ment; and
WHEREAS, the University does not have an organized fire
department; and
WHEREAS, the University desires to contract with the City for
the City to provide fire protection to the University.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
CONTAINED HEREIN, the City and the University hereby agree as
follows:
1. The City shall provide standby fire protection to the
University and shall combat fires occurring on University property
during the term of this contract subject to the conditions set out
herein.
2. The City shall provide firefighting machinery and
equipment with the necessary firemen to operate the same to combat
fires occurring on University property during the term of this
contract; provided, the City shall have the right to limit its
response to any fire on University property if the Fayetteville
City Manager or the Fayetteville Fire Chief determines that such a
response will substantially impair the ability of the Fayetteville
Fire Department to combat a fire or fires occurring in the City of
Fayetteville.
3 . In consideration of the fire protection provided by the
City under this contract, the University shall pay the City a lump
sum of $32 , 476. 00 . Said sum shall be payable within 30 days from
the execution date of this contract.
4 . The term of this contract shall be for a period of one
( 1 ) year commencing on the /,Cr- day of /CCCC`-- , 1988 ,
and terminating on the `C'':// day of 1989 , at
12: 00 p.m.

5. Neither the City, nor any City official or employee
shall be liable for any damage or loss that occurs when the
Fayetteville Fire Department is combatting a fire located on
University property.
6. All Fayetteville firefighters engaged in fimhting a fire
located on the University property shall be considered to be
acting within their line of duty.
7. Any modification of this contract must be in writing and
authorized by the governing bodies of the City and the University.

date first above written.
